Abstract

Ideally, the TAPERA policy in Indonesia is designed to help the public, particularly workers, own decent housing through a systematic housing savings program. However, in reality, many people do not fully understand this program and question its implementation, especially regarding its alignment with the principles of Islamic economics. The purpose of this study is to analyze the government's policy on TAPERA in Indonesia and examine its application from the perspective of Islamic economic principles. This article falls under literature research with a qualitative approach, using normative legal studies methodology, explained with descriptive analysis. In conclusion, the Indonesian government's policy on TAPERA aims to improve access to decent and equitable housing for the public, especially those with limited income, while reducing social disparities. From the perspective of Islamic economics, TAPERA applies the principles of justice, maslahat, ta'awun, and balance, offering interest-free financing and focusing on more sustainable social welfare.

Abstract

Tulisan ini menyoroti hukum berfungsi sebagai instrumen yang mengatur, melindungi, dan mendorong tercapainya tujuan pembangunan ekonomi kerakyatan. Namun, dalam kenyataannya, implementasi hukum dalam pembangunan ekonomi kerakyatan di Indonesia masih mempunyai berbagai rintangan. Dalam penelitian ini adalah kajian ilmu hukum berdasarkan pendekatan yuridis - normatif. Hasil Penelitian menjelaskan Dengan menjadikan Pancasila sebagai acuan, hukum dapat berperan lebih optimal dalam mewujudkan pembangunan ekonomi yang berkeadilan dan berkelanjutan. Pancasila, sebagai dasar negara, menekankan pentingnya keadilan sosial bagi seluruh rakyat Indonesia. Oleh sebab itu, regulasi ekonomi yang berpihak pada rakyat kecil seperti UMKM dan koperasi adalah salah satu cara untuk mewujudkan cita-cita tersebut. This paper highlights that the law functions as an instrument that regulates, protects, and encourages the achievement of the goals of people's economic development. However, in reality, the implementation of the law in the development of the people's economy in Indonesia still has various obstacles. In this study, it is a study of legal science based on a juridical-normative approach. The results of the study explain that by using Pancasila as a reference, the law can play a more optimal role in realizing fair and sustainable economic development. Pancasila, as the basis of the state, emphasizes the importance of social justice for all Indonesia people. Therefore, economic regulations that favor small people such as MSMEs and cooperatives are one way to realize these ideals.
