Abstract

This research aims to overcome important gaps in the development of Islamic economic scholars' human resources (HR), including limited understanding of Fiqh Muamalah, unclear profiles of graduates, and lack of linkages with the Islamic industry. The implications of current conditions include the quality of Islamic products and services, the sustainability of industry growth, and the relevance of graduates. This research will provide guidance and best practice strategies to connect graduate profiles with the dynamics of the sharia industry, strengthen the human resources of sharia economic scholars, and support the development of a better sharia industry.

Abstract

The objective of this paper is to examine the methodology employed by the National Sharia Board of the Indonesian Council of Ulama (DSN-MUI) in deriving legal rulings (istinbath) within the dynamic framework of the intersection between classical Islamic jurisprudence and contemporary societal needs. The study seeks to provide a detailed analysis of the approach adopted by the DSN-MUI, with a particular emphasis on its predominant utilization of the Intiqa’i or Takhyiri framework. This approach underscores the significance of considering maslaha (public interest) and makharij (solutions) over tarjih (preferential selection based on the strongest evidence). Employing a qualitative research methodology, the paper conducts a thorough content analysis of the fatwas issued by the DSN-MUI and relevant scholarly literature to delve into their istinbath process. The research findings suggest that the DSN-MUI occasionally resorts to collective ijtihad (ijtihad jama’i) in exceptional circumstances, diverging from the prevailing consensus on issues such as non-cash gold transactions and the conversion of tabarru’ contracts into mu`awadhat contracts. By shedding light on the application of the principles of tafriq al-halal wa-al-haram (differentiation between what is permissible and impermissible) and al-’ibrah fi al-’uqud bi al-alfazh wa al-mabani (legal reasoning in accordance with the teachings of Imam Shafii), this study significantly contributes to the field of Islamic jurisprudence. Moreover, this research offers a comprehensive analysis of the istinbath methodology of the DSN-MUI, providing valuable insights into how classical Islamic jurisprudence is adapted to address contemporary economic and social challenges in the Indonesian context.

Abstract

The enforcement of sharia compliance in LKS has not run optimally, even though sharia compliance can affect customer satisfaction. One of the determinants of the success of implementing sharia compliance in LKS is the Sharia Supervisory Board (DPS). This study aims to determine the role of DPS PT. BPRS XXX in Bogor Regency and DPS PT. BPRS YYY in Cianjur Regency in implementing the governance of BPRS POJK Number 24/POJK.03/2018. This type of research is a field research with a qualitative approach. The results of this study are that DPS BPRS XXX and BPRS YYY have carried out their roles well even though there are several tasks that are not in accordance with OJK regulations, such as mentioning the reasons for taking samples, not explaining concurrent positions and remuneration in detail in the governance report. From the results of the assessment of the role of DPS in the two BPRS, BPRS XXX is slightly superior to BPRS YYY because BPRS YYY has one transaction that is not sharia-compliant. In the Implementation Scale of DPS Governance, both BPRS received good predicate. Recommendations in this study include for DPS in addition to knowing the sciences of fiqh muamalah, DPS also needs to know the ins and outs of the transaction flow in LKS. In addition, DPS also needs to know statistics so that the inspection of documents by sampling is more accurate and represents other documents that were not examined.

Abstract

Learning Management System (LMS) training aims to introduce and improve mastery of the Learning Management System for lecturers and students. Training was carried out at the Postgraduate School of Ibn Khaldun University, Bogor. This training is part of community service activities which is a concrete manifestation of academics' contribution to improving the quality of education in Indonesia. The training was held on June 15 2024 with the number of participants involved being 25 people who were students and lecturers at the Postgraduate School of Ibn Khaldun University, Bogor. The training results showed a 90% increase in participants' understanding and ability to use the Learning Management System. It can be concluded that the Learning Management System training at the Graduate School of Ibn Khaldun University Bogor succeeded in increasing the understanding and ability of lecturers and students to use the Learning Management System. This training proves that with the right guidance, the use of technology in education can be optimized. In the future, it is hoped that similar training can be held regularly to ensure that the entire academic community can make maximum use of the LMS in the learning process.
