Abstract

Ijtihad dan Mujtahid adalah dua kategori konsekwensi ilmiah yang tidak dapat dipisahkan. Ijtihad yang lahir mengatasnamakan metode ketrampilan menggali suatu peristiwa hukum yang terjadi, kehadirannya menuntut varian lain yaitu dimensi keahlian. Dimensi keahlian tidak terwujud tanpa seseorang yang dipandang cakap menggali peristiwa hukum tadi dengan kualifikasi-kualifikasi yang telah tersedia.Dalam konteks ini, maka varian mujtahid perlu dihadirkan dengan penjelasan-penjelasan berdasarkan tingkatan-tingkatan atau derajat yang kemudian disebut mujtahid dengan berbagai dimensinya. Seperti dikemukakan dalam tulisan ini, antara lain, tentang kualifikasi mujtahid mutlak, mujtahid fatwa dan mujtahid madzhab.Kata Kunci: ijtihad, mujtahid, kualifikasi mujtahid

Abstract

The jurists have different perspectives and method choices in ijtihad. Salaf scholars, who were spearheaded by Imam Ahmad ibn Hanbal and Ibn Taimiyah, tended to use the Koran and as-Sunnah as the basis and main reference in establishing Islamic law. They involved very little ra'yu in performing establishment of law. Even if ra'yu is used in the process of establishment of law, they tend to only choose qiyâs as the only involvement of ra'yu in jijtihad. On the other hand, the jurists who are at the rational pole give a large portion of the role of reason (ra'yu) in jihad. Imam Abu Hanifah, for example, one of the proponents of a rational school of thought, placed ra'yu (istihsân) in the process of establishment of law with a sizable portion, even when compared to the portion of the hadith. This article tries to parse Ridla's thoughts about the position of the Koran, hadith, and ra'yu, both in their position as sources and methods of ijtihad. The results of the discussion concluded that Muhammad Rasyid Ridla fervently fought for the use of the Koran and Hadith as the main basis and reference in jihad, while not being hesitant to use qiyâs and mashlahat as ijtihad methods. For him, ijtihad is a demand for thinking that must be continuously opened and encouraged because it is a dynamic and universal teaching of the Koran. Ridla show that Islam is a dynamic, flexible, and friendly teaching towards the development of society

Abstract

Mizan exegesis is a set of book explained many different aspects such as worship, legal social, history, philosophy, and political leadership. Each of this topic described based on contextual approach and methodology. The author of this book attempted to respond the social phenomenon that developed from materialism of western scholarship. Within this problem, this essay will answer the following main questions: to what extent does Al­ Mizan has a contextual legal implication toward usury?. How does Al-Mizan contextualize the marriage verses, slavery, and politics (siyasah Syar'iyyah)? This research is library research that is qualitative, and to analyze the data there are methods that will be employed such as ijmali, tahlili, muwarran (comparative), and maudhui.The conclusion notified that the usury prohibition implied social problem among people, the one who gets benefits and the other doesn't get any, this problem arise a social enry, therefore usury is prohibited. The verses related to marriage lies on the problem of polygamy, those verses contextualized that it is allowed yet must be founded by fairness. Third, the author's of Al-Mizan explained that slavery verses goes along with the prohibition of human slavery, because all human being must treated equally, and the last the politics contextualized with the obligation of obeying the leader in many ways.Keywords: exegesis, contextuality, Tabatabia'i

Abstract

Almost every human needs wealth because it becomes a supporting tool for human life in the World. Besides, it also becomes both the help and the load for its owners in the hereafter. Nobody does not need wealth. Indeed, one ungrudgingfy goes early and comes in the dark time to earn the money. Ructions and losing of soul sometimes happened because of fighting over the wealth. Wealth is a tryout (slander) for human (Q.S. at-Tagabun: 15). Because of wealth one may enter into either the heaven or the hell. This article tries to discuss on the wealth based on the Qur'an. Based on the Quranic perspective, wealth is not merely a tool for satisfying for human needs, but it becomes a medium God mates for human in which it may become either comfort or curse for human being. Wealth, according to the Qur'an, has several functions. Firstly, it becomes a tryout (slander) for human, whether one will be grateful or vice versa. Secondly, it may also become mata' al-hayat ad-dunya (wordly fixings). Thirdly, it becomes wasilat al-jihad (means for jihad) for the owners. Abstract

Perbedaan pendapat dalam fiqh adalah suatu yang tidak terhindarkan. Karena itu pula fiqh kerap diidentikkan dengan perbedaan pendapat. Di antara persoalan yang sejak dulu senantiasa diperdebatkan dalam pemikiran fiqh adalah masalah Ahl a-Kitab dan Khilafah. Dalam masalah Ahl al-Kitab, perbedaan tidak hanya di seputar persoalan siapa saja yang masuk golongan ahl al-kitab tersebut, melainkan juga pada masalah definisi dan perkembangan makna ahl al­ kitab itu sendiri. Perbedaan pendapat pada masalah-masalah tadi berimplikasi pada perdebatan yang lebih keras dalam persoalan status pernikahan seorang muslim dengan ahl al-kitab. Sementara itu, dalam masalah Khilafah, perdebatan juga muncul dalam hal keharusan mendirikan institusi pemerintahan Islam yang mengurusi masalah-masalah agama dan dunia umat Islam.Sebagai salah seorang pemikir terkemuka di dunia Islam, Muhammad Rasyid Ridla memiliki pandangannya tersendiri dalam kedua masalah di atas. Dalam masalah ahl al-kitab, model pemikiran liberal Ridla nampak dalam ijtihadnya mengenai ahli kitab. Baginya, golongan ahl al-kitab tidak hanya meliputi kelompok Yahudi dan Nasrani, melainkan juga umat beragama lainnya seperti Hindu, Budha, dan Konghucu. Namun demikian, pemikiranya yang liberal itu tidak tampak pada pemikiran tentang khilafat. Baginya, umat Islam perlu membangun kembali khilafah Islamiyah sebagaimana yang pernah terjadi pada masa khulafa al-rasyidin.

Abstract

Abad ke-19 yang merupakan abad kebangkitan industri di dunia Barat telah memunculkan respon baru terutama bagi dunia pemikiran Islam. Respon itu muncul sebagai reaksi intelektual atas kematian panjang umat Islam dari kejayaan masa silam yang telah tercapai. Kejayaan silam bagi umat Islam boleh dicatat telah merekam dinamika historis yang sangat spektakuler, bahkan pernah menjadi buaian nostalgia yang tidak menguntungkan umat.Munculnya abad kebangkitan industri seolah-olah menjadi pukulan berat bagi umat Islam untuk menggugah kesadaran umat dari kemunduran. Kondisi umat Islam saat ini memang sangat kontras dengan kemajuan yang dicapai Barat dalam abad kebangkitan Islam. Umat Islam di zaman ini tidak lagi jaya seperti dulu.Dahulu umat Islammenggunakan akal atau nalarnya yang bersumber dari Al-Qur’an dan Hadis untuk menggugah kemajuan. Tapi kini terjerat di alam ketumpulan akal dengan mencintai tahayul, khurafat dan membenci kemajuan. Sementara yang paling kritis dialami umat Islam adalah belum menghilangnya situasi pembenaran terhadap adanya klaim ijtihad tertutup.Dalam situasi inilah, lahir para pembaharu yang menggugah pentingnya merumuskan kembali pemikiran keagamaan yang sejalan dengan perkembangan zaman. Dengan kata lain, ijtihad harus dibuka kembali sebagai satu-satunya metode yang dapat mengentaskan kebekuan umat berhadapan dengan dinamika dan komplekitas perubahan zaman.Rasyird Ridha adalah salah satu pembahau/pemikir Islam yang sangat tangguh dan gigih mendengungkan kembali peran ijtihad. Ia dalam tulisannya menyoroti pentingnya akal diperankan untuk membuktikan keunggulan syari'ah Islam di atas hukum Barat. Menurut Rasyid Ridha, umat Islam dengan akalnya tidak boleh taklid (terikat) membabi-buta pada pikiran orang lain, tetapi juga harus toleran (terbuka) menggali dan mnyerapi pemikiran orang lain tanpa melakukan liberalisasi. Dengan pengaruh umat Islam akan mampu mengejar kemajuan, seperti yang dialami dahulu.Kata Kunci : Rarsid Ridha, Metode Pemikiran, Qur'an, hadits.
