Abstract

Labour law reform in Indonesia is a strategic step to create welfare for workers in the face of the challenges of globalization and an ever-evolving labour market. With the fast-paced changes in the work environment, along with globalization and technological advancements, it is important to make regulatory adjustments that can effectively protect workers' rights while also considering the needs of employers. This research takes a closer look at the importance of labor law reform in Indonesia, particularly focusing on improving workers' welfare. We use normative legal research methods with statutory and conceptual approaches. The data we collected included relevant laws regarding labor, legal literature, and official documents. The results show that several aspects of labor law in Indonesia still need to be reformed, including the wage system, social security, protection of contract and outsourced workers, and industrial relations dispute resolution mechanisms. We hope that these reforms will pave the way for a more equitable, responsive and adaptable labor law system that can truly improve workers' welfare in a sustainable manner

Abstract

The legal framework known as international criminal law is used to punish and prosecute those who commit international crimes, including mass murder, human rights violations, and illegal military operations. In the midst of the phenomenon of globalization, individuals who commit international crimes are increasingly difficult to be held accountable because they often try to escape abroad. Thus, the implementation of the provisions of international criminal law becomes very crucial to ensure integrity at the global level and prevent the perpetrators of international criminal acts from avoiding punishment. The implementation of international criminal law plays an important role in realizing justice globally and ensuring that the perpetrators of international criminal acts cannot avoid legal liability. However, its implementation faces various obstacles that are increasingly complex along with the development of globalization. The genocide case against the Rohingya ethnic group in Myanmar reflects various obstacles in the implementation of international criminal law, such as the difficulty of extraditioning cross-border perpetrators and the challenge of collecting strong, legitimate, and reliable evidence to bring the case to the realm of international justice. Abstrak Kerangka hukum yang dikenal sebagai hukum pidana internasional dipakai untuk menghukum dan menuntut mereka yang melakukan kejahatan internasional, termasuk pembunuhan massal, pelanggaran hak asasi manusia, dan operasi militer yang ilegal. Di tengah fenomena globalisasi, individu yang melakukan kejahatan internasional semakin sulit untuk dimintai pertanggungjawaban karena seringkali mereka berupaya meloloskan diri ke luar negeri. Dengan demikian, penerapan ketentuan hukum pidana internasional menjadi sangat krusial guna memastikan integritas di tingkat global serta mencegah pelaku tindak pidana internasional terhindar dari hukuman. Pelaksanaan hukum pidana internasional berperan penting dalam mewujudkan keseimbangan secara global serta menjamin bahwa para pelaku tindak pidana berskala internasional tidak dapat menghindari pertanggungjawaban hukum. Meskipun demikian, penerapannya menghadapi beragam hambatan yang semakin kompleks seiring perkembangan globalisasi. Kasus genosida yang dihadapi etnis Rohingya di Myanmar mencerminkan berbagai kendala dalam pelaksanaan hukum pidana internasional, seperti kesulitan melakukan ekstradisi terhadap pelaku lintas negara serta tantangan dalam mengumpulkan alat bukti yang kuat, sah, dan dapat dipercaya guna membawa perkara tersebut ke ranah peradilan internasional.
