Abstract

This article was conducted in the form of community service “training of trainer”. The goal of this activity is to improve youth knowledge, understanding, skills and roles in preventing sexual violence. This research involves the committee and members of mosque youth who trained in preventing sexual violence. Adult education methods are used in community service as well as legal research to analyze participation of mosque youth in preventing sexual violence at worship place use a legal, case and conceptual approach. The research found: (1) The number of sexual violence cases increases every year in susceptible locations such as public spaces, terminals/stations, roadsides/sidewalks, public transportation, mass or social media, residential areas, workplaces/offices and campuses. (2) The absence of worship place on susceptible locations list does not mean sexual harassment against women and children has not existed. It could be happened to anyone regardless of gender, age, religion or social background. (3) knowledge, understanding, ability and role to prevent sexual violence among mosque youth increased after participated and practice through "Let's Practice Being a Trainer/Facilitator on Sexual Violence Prevention ". As conclusions: (1) mosque youth have an important role to reduce the number of various forms of and/or prevent of sexual violence, (2) the Indonesian Mosque Youth Communication Agency (BKPRMI) has capacity and roles to improve the knowledge, ability and role of mosque youth in preventing sexual violence, especially in the mosque/prayer room area.

Abstract

Pemisahan entitas antara pemilik dan perusahaan sering kali disalahgunakan. Permasalahan utama adalah banyak anggota mitra yang belum mengetahui atau memahami bahwa terdapat berbagai Peraturan Perundang-undangan, mulai dari Undang-Undang, Peraturan Pemerintah, hingga Peraturan Lembaga/Institusi, yang mengatur kewajiban pengungkapan pemilik manfaat (beneficial ownership) suatu badan usaha. Ketidaktahuan ini berpotensi meningkatkan risiko penyalahgunaan badan usaha untuk tujuan ilegal. Universitas Sumatera Utara, sebagai institusi pendidikan yang menjalankan Tridarma Perguruan Tinggi, berencana untuk melaksanakan program pengabdian bekerja sama dengan Himpunan Pengusaha Pribumi Indonesia (HIPPI) DPD Sumatera Utara dalam skema Mono Tahun Reguler. Program ini bertujuan untuk: (1) Meningkatkan pemahaman tentang kewajiban pengungkapan pemilik manfaat (beneficial ownership) pada badan usaha kepada negara, dan (2) Mencapai pemahaman yang lebih baik di kalangan pelaku usaha yang tergabung dalam mitra mengenai tata cara pelaporan pemilik manfaat (beneficial ownership) dari badan usaha mereka kepada negara. Pengabdian ini akan dilaksanakan melalui beberapa tahapan, yaitu: (1) Sosialisasi mengenai peraturan perundang-undangan terkait pengungkapan pemilik manfaat (beneficial ownership) suatu badan usaha; dan (2) Diskusi Terfokus yang membahas tata cara pengungkapan pemilik manfaat (beneficial ownership) suatu badan usaha kepada negara

Abstract

This study discusses the regulation of the position of insurance agents as business partners in cooperation agreements with life insurance companies, especially regarding the aspect of legal protection in the event of unilateral termination of the relationship. Although agents are often referred to as "business partners", legally they have the status of representatives of insurance companies based on Law Number 40 of 2014 concerning Insurance and POJK Number 69/POJK.05/2016. This legal relationship is regulated in an agency agreement that contains the rights, obligations, and limits of the agent's authority in marketing insurance products. In practice, unilateral termination of the relationship that is not based on legitimate reasons or does not comply with the agreement has the potential to cause disputes. Agents or business partners who are harmed can claim compensation based on breach of contract (Article 1243 of the Civil Code) or unlawful acts (Article 1365 of the Civil Code). In addition, violations of the principle of fair competition can be reported to the KPPU. Therefore, the cooperation agreement must be drafted clearly and fairly, regulating the time period, termination mechanism, and legal protection. The ultimate goal of this regulation is to create legal certainty, balance of rights and obligations, and protection for all parties involved in life insurance agency relationships.
