Abstract

This article was conducted in the form of community service “training of trainer”. The goal of this activity is to improve youth knowledge, understanding, skills and roles in preventing sexual violence. This research involves the committee and members of mosque youth who trained in preventing sexual violence. Adult education methods are used in community service as well as legal research to analyze participation of mosque youth in preventing sexual violence at worship place use a legal, case and conceptual approach. The research found: (1) The number of sexual violence cases increases every year in susceptible locations such as public spaces, terminals/stations, roadsides/sidewalks, public transportation, mass or social media, residential areas, workplaces/offices and campuses. (2) The absence of worship place on susceptible locations list does not mean sexual harassment against women and children has not existed. It could be happened to anyone regardless of gender, age, religion or social background. (3) knowledge, understanding, ability and role to prevent sexual violence among mosque youth increased after participated and practice through "Let's Practice Being a Trainer/Facilitator on Sexual Violence Prevention ". As conclusions: (1) mosque youth have an important role to reduce the number of various forms of and/or prevent of sexual violence, (2) the Indonesian Mosque Youth Communication Agency (BKPRMI) has capacity and roles to improve the knowledge, ability and role of mosque youth in preventing sexual violence, especially in the mosque/prayer room area.

Abstract

Pemisahan entitas antara pemilik dan perusahaan sering kali disalahgunakan. Permasalahan utama adalah banyak anggota mitra yang belum mengetahui atau memahami bahwa terdapat berbagai Peraturan Perundang-undangan, mulai dari Undang-Undang, Peraturan Pemerintah, hingga Peraturan Lembaga/Institusi, yang mengatur kewajiban pengungkapan pemilik manfaat (beneficial ownership) suatu badan usaha. Ketidaktahuan ini berpotensi meningkatkan risiko penyalahgunaan badan usaha untuk tujuan ilegal. Universitas Sumatera Utara, sebagai institusi pendidikan yang menjalankan Tridarma Perguruan Tinggi, berencana untuk melaksanakan program pengabdian bekerja sama dengan Himpunan Pengusaha Pribumi Indonesia (HIPPI) DPD Sumatera Utara dalam skema Mono Tahun Reguler. Program ini bertujuan untuk: (1) Meningkatkan pemahaman tentang kewajiban pengungkapan pemilik manfaat (beneficial ownership) pada badan usaha kepada negara, dan (2) Mencapai pemahaman yang lebih baik di kalangan pelaku usaha yang tergabung dalam mitra mengenai tata cara pelaporan pemilik manfaat (beneficial ownership) dari badan usaha mereka kepada negara. Abstract

This study discusses the regulation of the position of insurance agents as business partners in cooperation agreements with life insurance companies, especially regarding the aspect of legal protection in the event of unilateral termination of the relationship. Although agents are often referred to as "business partners", legally they have the status of representatives of insurance companies based on Law Number 40 of 2014 concerning Insurance and POJK Number 69/POJK.05/2016. This legal relationship is regulated in an agency agreement that contains the rights, obligations, and limits of the agent's authority in marketing insurance products. In practice, unilateral termination of the relationship that is not based on legitimate reasons or does not comply with the agreement has the potential to cause disputes. Agents or business partners who are harmed can claim compensation based on breach of contract (Article 1243 of the Civil Code) or unlawful acts (Article 1365 of the Civil Code). In addition, violations of the principle of fair competition can be reported to the KPPU. Therefore, the cooperation agreement must be drafted clearly and fairly, regulating the time period, termination mechanism, and legal protection. The ultimate goal of this regulation is to create legal certainty, balance of rights and obligations, and protection for all parties involved in life insurance agency relationships.

Abstract

Abstract: Paylater has become popular because it is inclusive, flexible, and offers a simple registration process and various attractive promos. However, the increasing use of Paylater, such as SPayLater from Shopee, poses a risk of bad debt and personal data theft. Several cases, such as billing that does not comply with regulations and hacking of ShopeePay balances, show weaknesses in data security and management on the E-commerce platform. Therefore, research is needed to strengthen legal protection of consumer personal data in Shopee E-commerce transactions. The research uses a juridical-normative method with a legislative and literature approach. The results of this study are summarized in several conclusions, namely that legal protection of consumer personal data in e-commerce in Indonesia has developed, especially with the enactment of Law No. 27 of 2022. Although e-commerce service providers are obliged to maintain data confidentiality and security, challenges in implementing the law and consumer understanding of their rights still need to be overcome. From this conclusion, it is recommended that the government needs to strengthen supervision and enforcement of Law No. 27 of 2022 concerning Personal Data Protection by tightening security requirements and conducting periodic audits on e-commerce platforms.Keyword: Personal Data, Consumer, E-Commerce Abstrak: Paylater menjadi populer karena inklusif, fleksibel, dan menawarkan proses pendaftaran yang sederhana serta berbagai promo menarik. Namun, meningkatnya penggunaan Paylater, seperti SPayLater dari Shopee, menimbulkan risiko kredit macet dan pencurian data pribadi. Beberapa kasus, seperti penagihan yang tidak sesuai aturan dan peretasan saldo ShopeePay, menunjukkan kelemahan dalam keamanan dan manajemen data di platform E-commerce. Oleh karena itu, diperlukan penelitian untuk memperkuat perlindungan hukum terhadap data pribadi konsumen dalam transaksi E-commerce Shopee. Penelitian menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan dan literatur. Hasil penelitian ini dirangkum dalam beberapa kesimpulan yakni bahwa perlindungan hukum terhadap data pribadi konsumen dalam e-commerce di Indonesia telah mengalami perkembangan, terutama dengan adanya UU No. 27 Tahun 2022. Meskipun penyedia layanan e-commerce berkewajiban menjaga kerahasiaan dan keamanan data, tantangan dalam penerapan hukum dan pemahaman konsumen tentang hak-hak mereka masih perlu diatasi. Dari kesimpulan ini, disarankan pemerintah perlu memperkuat pengawasan dan penegakan UU No. 27 Tahun 2022 tentang Perlindungan Data Pribadi dengan memperketat persyaratan keamanan dan melakukan audit berkala pada platform e-commerce.Kata kunci: Data Pribadi, Konsumen, E-Commerce

Changestotheprovisions in Law Number 6 of 2023 concerningJobCreation, such as articlesthat are open tomultipleinterpretations, make MSME actorsreluctanttotakecareofpermitsdueto legal uncertainty, complicatedprocesses, andconcernsabouttaxes. Therefore, itisnecessarytostrengthenthe legal umbrella, simplifythebureaucracy, andoptimizeempowermentfromthegovernmentsothatMSMEscandevelop, competehealthily, andbecomethe main pillars in supportingthenationaleconomy. Thesematerials were thenanalyzedqualitativelywith a descriptiveanalyticalapproach. Legal certainty in theempowermentanddevelopmentofMSMEsthroughbusinesslicensingbasedon Law Number 6 of 2023 concerningJobCreationand Law Number 20 of 2008 concerningMicro, Smalland Medium Enterprises isseenfromArticle 87 whichstatesthewordsexemptlicensingfeeswhileArticle 92 Paragraph 2, thisprovidesdifferentinterpretationsofwhethermicrobusinessesactuallygetfreefeesor not. Becausethephrase "can" in Article 92 Paragraph 2 canmeanyesorno, whilethephrase "freeinglicensingfees" in Article 87 meanscompletelyfreeing. The contradictionbetweenthesearticlescreates legal uncertaintyregardingtheexemptionoflicensingfeesandthereductionoflicensingfeesforMSMEs.  Keyword:Micro, Small and Medium Enterprises (MSMEs), Licensing, Empowerment and Development  Abstrak: UMKM masih menghadapi berbagai kendala, terutama dalam aspek regulasi dan perizinan yang seringkali membingungkan dan tidak sinkron antara undang-undang dan aturan pelaksananya. Perubahan ketentuan dalam Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja, seperti pasal yang multitafsir, membuat pelaku UMKM enggan mengurus perizinan karena ketidakpastian hukum, proses yang rumit, serta kekhawatiran terhadap pajak. Oleh karena itu, diperlukan penguatan payung hukum, penyederhanaan birokrasi, serta pemberdayaan yang lebih optimal dari pemerintah agar UMKM dapat berkembang, bersaing secara sehat, dan menjadi pilar utama dalam menopang perekonomian nasional. Bahan-bahan tersebut kemudian dianalisis secara kualitatif dengan pendekatan deskriptif analitis Kepastianhukumdalampemberdayaan dan pengembangan UMKM melaluiperizinanberusahaberdasarkanUndang-UndangNomor 6 Tahun 2023 Tentang Cipta Kerja dan Undang-UndangNomor 20 Tahun 2008 Tentang Usaha Mikro Kecil Menengahdilihatdari Pasal 87 yang menyebutkan kata membebaskanbiayaperizinansedangkan Pasal 92 Ayat 2, halinimemberikanpenafsiran yang berbeda-bedaapakahsejatinya Usaha mikromendapatkanbebasbiayaatautidak. Karena frasa kata dapat pada Pasal 92 Ayat 2 bisaberartiyaatautidak, sedangkanfrasamembebaskanbiayaperizinandalam Pasal 87 berartisepenuhnyamembebaskan.
