Abstract

This study aims to examine the application of halal certification in Micro, Small, and Medium Enterprises (MSMEs) food products in Pekalongan District, East Lampung Regency, from the perspective of Maqosid Sharia. Halal certification is an important effort to ensure the halalness of products consumed by the Muslim community. This aligns with the government's policy to strengthen the guarantee of halal products in Indonesia. This study uses a descriptive qualitative approach with interview and documentation methods from 11 MSME actors. The study results show that several MSMEs in Pekalongan have obtained halal certification. Still, many have not met the requirements due to a lack of knowledge, administrative costs, and the complexity of the bureaucratic process. From the perspective of Maqosid Syariah, halal certification provides benefits in protecting the religion, soul, and property of consumers, as well as increasing the competitiveness of products in the market. It is hoped that there will be wider socialization and simplification of the administrative process to support MSME actors in obtaining halal certification.

Abstract

Transaksi online berkembang di dalam masyarakat sebagai dampak dari adanya perkembangan teknologi. Banyak pelaku usaha dan konsumen melakukan transaksi jual beli melalui online. Realitasnya konsumen masih ada yang dirugikan dengan menggunakan transaksi online,hal ini disebabkan karena konsumen masih banyak yang menggunakan transaksi online dengan tidak berhati-hati tidak melihat penilaian atau komentar pada toko. Pihak yang dirugikan tidak melaporkan atau mengadu ketika terjadi sesuatu permasalahan dalam melakukan transaksi online. Padahal konsumen dalam melakukan transaksi online dilindungi oleh Undang-undang No.11 Tahun 2008 Tentang Informasi serta Transaksi Elektronik dan Peraturan Pemerintah No. 71 Tahun 2019 Tentang Penyelenggaraan Sistem dan Transaksi Elektroni dan oleh Undang-undang No. 8 Tahun 1999 yang mengatur tentang perlindungan terhadap konsumen. Konsumen mempunyai kewajiban untuk membaca dan mencari informasi ketika melakukan pembelian dalam transaksi online dan melaporkan permasalahan yang terjadi ketika melakukan pembelian dalam transaksi online. Pentingnya budaya hukum pada konsumen dalam transaksi online karena budaya hukum unsur yang penting dalam sistem hukum, karena budaya hukum memperlihatkan pemikiran masyarakat dalam menentukan bagaimana hukum tersebut ditaati atau tidak.Penelitan ini bertujuan untuk mengetahui bagaimanakah budaya hukum konsumen dalam transaksi online. Pengumpulan data dilakukan dengan menggunakan teknik wawancara dan dokumentasi. Sedangkan analisa data menggunakan metode analisis kualitatif. Hasil dari penelitan yaitu problema budaya hukum konsumen terlihat dari sikap konsumen yang masih kurang berhati-hati dalam melakukan pembelian pada transaksi online, kurangnya pengetahuan konsumen antara membedakan akun-akun penipuan atau bukan pada transaksi online dan kesadaran hukum konsumen dalam transaksi online masih cukup rendah karena lebih memilih diam ketika mengalami permasalahan – permasalahan ketika melakukan transaksi online.

Abstract

Health is an important factor in human life because in healthy conditions, humans can carry out activities comfortably and do a lot of good by providing benefits to others. Everyone always strives for various ways and efforts that are considered good to support health. Transplantation is one of the many ways to cure disease that can be done using technology. Transplantation is a problem that falls within the scope of Islamic law which is not only a classical problem but has also entered the scope of contemporary problems. In looking at a legal phenomenon that occurs, Islamic legal experts analyze legal cases by looking at what has been determined by the Al-Quran and Hadith. The response of Islamic law to the emergence of the phenomenon of organ transplantation is proof of the relevance of Islamic law in covering problems in the health sector. Therefore, this research will discuss the concept of health in Islamic law through an analysis of the law on organ transplantation. Regarding organ transplants, Islam highly respects the glory of humans, both living and dead. Humans are blessed with a perfect body shape, intelligent mind and the ability to regulate this universe. So it is natural that God glorifies humans above other creatures. That's why we are prohibited from trampling on other people's dignity. One must not destroy one's soul, self-esteem, feelings, even towards a corpse.
