Abstract

The correctional system in Indonesia faces significant challenges, including overcapacity, low effectiveness of rehabilitation, and a lack of integration of spiritual values. This research aims to explore the application of maqāṣid al-syarīʿah as a value foundation in the reform of the correctional system to enhance the effectiveness of rehabilitation and reintegration of inmates. This research employs a qualitative method with a normative-empirical approach, encompassing an analysis of regulatory frameworks, particularly Law Number 22 of 2022 concerning Corrections and observational techniques. The research results show that maqāṣid al-syarīʿah, with principles such as the protection of life (hifz an-nafs), intellect (hifz al-aql), spirituality (hifz ad-din), lineage (hifz an-nasl), and property (hifz al-māl) provide a holistic framework to support the rehabilitation of prisoners. Programs based on religious values and practical skills have proven capable of supporting individual moral and economic changes, while community involvement through community mentors strengthens social reintegration. However, challenges such as limited resources, cultural resistance to religious-based approaches, and the lack of oversight based on maqāṣid al-syarīʿah indicators hinder optimal implementation. Therefore, this research recommends a revision of more specific regulations, including the provision of religious-based facilities, officer training, and the strengthening of technology-based evaluations. This research includes formulating more humane and inclusive correctional policies in line with Islamic values and universal human rights. By integrating maqāṣid al-syarīʿah, the correctional system in Indonesia can transform into an instrument that is punitive and rehabilitative, creating sustainable social harmony.

Abstract

Putusan Mahkamah Konstitusi Nomor 132/PHPU.BUP-XXIII/2025 yang mendiskualifikasi petahana Bupati Tasikmalaya, Ade Sugianto, dalam Pilkada Serentak 2024 telah memunculkan perdebatan yuridis serius terkait batasan dua periode masa jabatan kepala daerah. Perbedaan tafsir antara Mahkamah Konstitusi yang menggunakan pendekatan substantif dan Komisi Pemilihan Umum (KPU) yang menggunakan pendekatan administratif menimbulkan pertanyaan mendasar mengenai kepastian hukum dan perlindungan hak konstitusional warga negara. Penelitian ini bertujuan untuk mengkaji dasar pertimbangan hukum Mahkamah Konstitusi dalam putusan tersebut, menganalisis kerangka hukum yang mengatur masa jabatan kepala daerah, serta mengevaluasi implikasi tafsir hukum tersebut terhadap sistem demokrasi. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Teknik pengumpulan data dilakukan melalui studi kepustakaan terhadap peraturan perundang-undangan, putusan Mahkamah Konstitusi, serta dokumen hukum lainnya. Data dianalisis secara kualitatif dengan teknik deskriptif, komparatif, dan evaluatif. Hasil penelitian menunjukkan bahwa dasar pertimbangan hukum dalam Putusan Nomor 132/PHPU.BUP-XXIII/2025, Mahkamah Konstitusi menggunakan pendekatan kontekstual-substantif dengan mempertimbangkan prinsip keadilan elektoral dan integritas pemilu. Dalam putusannya, Mahkamah Konstitusi secara tegas menolak pendekatan formalistik dan meneguhkan doktrin riilitas masa jabatan, yakni masa jabatan yang dihitung berdasarkan pelaksanaan kekuasaan secara nyata, bukan semata pada pelantikan administratif. Putusan ini memperkuat prinsip pembatasan kekuasaan dan mencegah manipulasi melalui celah hukum jabatan non-definitif. Implikasinya, meskipun memperkuat integritas konstitusional, putusan ini juga menuntut harmonisasi regulasi teknis oleh KPU dan peningkatan literasi hukum konstitusi bagi para aktor elektoral. Dengan demikian, putusan ini bukan hanya korektif terhadap praktik elektoral, tetapi juga menjadi fondasi baru dalam penguatan demokrasi konstitusional di Daerah.

Abstract

In Indonesia, the rules governing that can bring a legal case to the Constitutional Court often unclear and unevenly applied. This creates challenges for individuals and communities trying to protect their constitutional rights. In this article, we take a critical look at these obstacles by examining the Court’s past decisions. We show how the current legal framework overlooks issues of collective harm and structural inequalities, particularly affecting marginalized groups. To better understand these issues, we compare Indonesia’s approach to those of India, South Africa, and the United States, seeking out more inclusive models of judicial decision-making. Our findings show that Indonesia’s focus on specific interpretations of direct and personal harm limits the judiciary’s ability to meet its constitutional responsibilities. The paper draws on insights from other countries as well as Indonesia’s own legal traditions, such as adat (customary law) and musyawarah (deliberation), to propose a more inclusive and culturally sensitive approach to legal standing. We recommend several specific reforms, including rethinking existing laws, creating clearer judicial guidelines, and providing targeted judicial training for judges to improve access to constitutional justice for everyone.
