Abstract

This research aims to explore in depth the problems related to facilities and infrastructure as well as follow-up programs in the field of student management at SMP Muhammadiyah 1 Medan. This research uses qualitative research with a descriptive approach. Qualitative research is research that is descriptive in nature and tends to use analysis. The results of this research show that the implementation of the Facilities and Infrastructure Development Sector is related to the problem of inadequate fields at SMP 1 Muhammadiyah, the author can draw the conclusion that student extracurricular activities are really needed in developing students' talents. Inadequate fields can affect students' extracurricular limitations, for example in the field of sports. The management of facilities and infrastructure at SMP I Muhammadiyah is said to be good, however, field facilities that are inadequate need to focus on development to make them better.

Abstract

This study aims to analyze Legal Protection and Gender Justice for Women in the Practice of Siri Polygamy: Analysis of the Principles of Islamic Civil Law. The practice of polygamy in Indonesia often causes injustice for women, who do not receive adequate legal protection. This study analyzes the relationship between the principles of Islamic civil law and the reality faced by women in the practice of siri polygamy. Although Islamic law emphasizes justice and protection of women's rights, many women are trapped in situations of injustice due to a lack of legal understanding and social stigma. This study uses a normative juridical method to explore the truth between legal norms and practices in the field. The results of the study indicate that minimal social support, lack of understanding of legal rights, and social stigma contribute to the injustice experienced by women. To improve legal protection and gender justice, it is recommended that there be recognition and registration of siri polygamous marriages, strengthening of legal regulations, assistance for women, and education and socialization regarding legal rights. With these steps, it is hoped that women's rights in the practice of siri polygamy can be fulfilled fairly within the framework of Islamic law and state law.

Abstract

Poligami merupakan praktik perkawinan yang dibolehkan dalam Islam dengan batas maksimal empat istri dan syarat utama mampu berlaku adil. Penelitian ini bertujuan untuk menganalisis poligami dalam perspektif hukum Islam dengan menyoroti aspek kebolehan dan keadilan, sekaligus mengkaji relevansinya dengan hukum positif Indonesia. Metode penelitian yang digunakan adalah kualitatif melalui studi pustaka, dengan menelaah literatur Al-Qur’an, hadis, fikih klasik, regulasi perundang-undangan, serta hasil penelitian terdahulu. Hasil penelitian menunjukkan bahwa dalam hukum Islam, poligami merupakan dispensasi yang diperbolehkan dalam kondisi tertentu, bukan kewajiban, dan pelaksanaannya mensyaratkan keadilan lahiriah seperti nafkah, tempat tinggal, dan pembagian waktu, sementara keadilan batiniah sulit dicapai. Dalam hukum positif Indonesia, poligami diatur secara ketat melalui Undang-Undang Nomor 1 Tahun 1974 dan Kompilasi Hukum Islam, yang mewajibkan izin pengadilan, persetujuan istri, serta bukti kemampuan finansial. Implikasi penelitian ini menunjukkan bahwa poligami hanya dapat dibenarkan jika prinsip keadilan ditegakkan secara menyeluruh, karena tanpa keadilan praktik tersebut berpotensi menimbulkan ketidakadilan gender, pelanggaran hak keluarga, dan kerentanan sosial.
