Abstract

Bajapuik is a unique marriage tradition of the Minangkabau people, in which the woman approaches the man to propose marriage. This tradition is rooted in the strong matrilineal system of Minangkabau culture. This study aims to examine the Bajapuik traditional marriage process and the reciprocal values within it from the perspective of qira'ah mubjadi, which emphasizes interconnectedness and partnership between men and women, parents and children, as well as inter-ethnic communities. This study employs a qualitative method with a phenomenological approach to understand the experiences and meanings behind this tradition. The findings indicate that the Bajapuik marriage procession consists of three stages: (1) the pre-wedding procession, (2) the wedding procession, and (3) the post-wedding procession. Additionally, there are three reciprocal values in Bajapuik traditional marriage: (1) the reciprocal relationship between children and parents, (2) the reciprocal relationship between the bride and groom, and (3) the reciprocal relationship between the two extended families. The theoretical implications of this study suggest that the qira'ah mubjadi perspective offers an alternative framework for understanding cultural practices that emphasize relational balance and social harmony in Minangkabau society.

Abstract

Pernikahan dilaksanakan dengan sighat ijab dan qabul antara walinikah dengan mempelai pria. Bagaimana jika wali mempelai putritidak berada di tempat pernikahan (berada di tempat yang jauh/masyafatul qoshri). Wali hakim merupakan alternatif bagimempelai perempuan yang demikian itu. Persoalan masyafatulqoshri menjadi fenomena menarik di wilayah Kantor UrusanAgama (KUA) Kecamatan Kota Kota Kediri. Fokus penelitian ini 1)Bagaimana prosedur Pernikahan oleh Wali Hakim ataspertimbangan Masyafatul Qoshri di KUA Kecamatan Kota KotaKediri? 2) Bagaimana pelaksanaan pernikahan oleh Wali Hakimatas pertimbangan Masyafatul Qoshri di KUA Kecamatan KotaKota Kediri?. Hasil penelitiannya yaitu: 1) Prosedur perkawinansebab masyafatul qoshri adalah Pemberitahuan kehendak nikaholeh calon mempelai dengan membawa surat-surat yangdiperlukan, antara lain Surat keterangan yang menerangkan WaliNasab calon mempelai perempuan berada di tempat yang jauh,sejauh masyafatul qoshri 2) Pelaksanaan pernikahan oleh walihakim sebab masyafatul qoshri di KUA Kecamatan Kota KotaKediri sama dengan pernikahan pada umumnya, hanya ditambahsurat keterangan dari kepala desa tentang wali hakim.

Abstract

This article discusses the dual role of women in the family within the context of Islamic family law and the need for its reconstruction to achieve gender equality. The aim of this research is to analyze the challenges women face in performing dual roles, both in domestic and public spheres, and to explore how Islamic family law can be reformed to be more responsive to women's needs. The methodology employed in this study is a qualitative approach with document analysis and literature review from various legal sources and Islamic feminist theories. The main discussion focuses on gender inequality in Islamic family law, the analysis of women’s roles in the workforce, and critiques of the patriarchal structure in conventional Islamic family law. The findings indicate that current Islamic family law still prioritizes women’s domestic roles, while their economic contributions are often overlooked. A reconstruction of Islamic family law based on maqashid sharia and gender equality principles is necessary to ensure that women can perform their dual roles without facing legal discrimination.
