Abstract

Artikel ilmiah ini membahas mengenai Pengaturan Pembangunan Rumah dan Toko atau Ruko di Kota Jambi berdasarkan konsep Tata Ruang Perkotaan. Permasalahan yang di bahas dikarenakan banyaknya bangunan rumah dan toko atau ruko yang pemanfaatan kurang efektif dan efisien serta letaknya yang sering kali tidak sesuai dengan konsep Tata Ruang Perkotaan. Penelitian ini bertujuan untuk memahami dan mengetahui peraturan pembuatan izin mendirikan bangunan rumah dengan toko atau ruko berdasarkan konsep tata ruang wilayah perkotaan. Metode penelitian yang digunakan adalah yuridis normatif, yaitu suatu penelitian yang mengkaji adanya kekosongan hukum, konflik hukum, dan/atau ketidak jelasan/kekaburan suatu norma hukum, isu hukum atas penelitian ini adalah kekaburan hukum atau yang biasa disebut dengan ketidak jelasan suatu aturan. Dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menujukkan bahwa adanya ketidak jelasan norma tentang izin mendirikan bangunan ruko berdasarkan konsep tata ruang wilayah perkotaan. Sebagaimana yang tercantum di dalam rangkuman pada Pasal 44 Undang-Undang Nomor 26 Tahun 2007, yang menyebutkan bahwa ruang kawasan metropolitan dan/atau kawasan megapolitan harus memuat tujuan, arah kebijakan, startegi penataan ruang, rencana struktur ruang kawasan, rencana pola, arah pemanfaatan ruang dan pengendalian ruang serta sanksi. Namun, kenyataanya dalam Peraturan Daerah Nomor 9 Tahun 2013 Tentang Rencana Tata Ruang Wilayah Kota Jambi Tahun 2013-2033 tidak ada penjelasan atau pasal terkait dengan arahan seperti dalam Undang-Undang Tata Ruang, yaitu terkait seperti apa izin lokasi, lokasi seperti apa yang tidak membahayakan atau yang tidak menimbulkan gangguan kepada masyarakat serta tidak adanya arahan penempatan lokasi yang baik dan benar.

Abstract

This article discusses the Enforcement of State Administrative Law Against Hazardous Waste Treatment in the Crumb Rubber Industry in Jambi City. The purpose of this study was to determine the proper and proper mechanism for processing hazardous waste in the rubber smoking industry, in addition to knowing the government's legal actions against perpetrators of violations of hazardous waste processing in Jambi City. The research method used is empirical juridical, namely research that emphasizes in terms of observation, which seeks to observe legal facts that apply in society, where it requires knowledge to be observed and proven openly. The results of the study indicate that there is a conflict between das sollen and das sein regarding the treatment of B3 waste from the Rubber Smoking Industry in Jambi City in accordance with Jambi City regulations Number 7 of 2017 which states that the location for storing B3 waste is required to be free from flooding and not prone to natural disasters. there are buildings that are rusty, emitting noise, vibration and also the smell produced by the B3 waste. Therefore, it is necessary for the government's role in the B3 waste treatment mechanism in accordance with applicable regulations and the government's role in providing administrative law enforcement against perpetrators of B3 Waste Treatment violations.

Abstract

This study addresses the crossroads facing notary organizations in Indonesia and emphasizes the need for the government to anticipate this situation in order to preserve the role of notaries as public officials and holders of a noble legal profession, as well as their function as makers of authentic deeds. The study critically examines the extent of governmental decisiveness regarding the division of notary organizations, which has emerged as both a challenge and a potential opportunity, particularly in the debate between a single-bar and a multi-bar organizational model. This issue is significant given that notaries are public officials whose guidance and supervision are closely linked to the government through delegated authority exercised by the National Supervisory Council (Majelis Pengawas Notaris) and professional notary organizations. This research employs a normative juridical method, incorporating historical, conceptual, legislative, and comparative approaches, including comparisons with other professional legal organizations. The analysis is conducted through legal reasoning aimed at realizing the fundamental objectives of law, namely order, legal certainty, and societal welfare. The study finds that the division of notary organizations in Indonesia may generate both internal and external impacts. Internally, such division creates disharmony among notaries and undermines professional solidarity, thereby disrupting the effectiveness of routine supervisory mechanisms, including annual notarial examinations. Externally, organizational fragmentation risks producing deeper institutional divisions, as observed in other legal professions, which may weaken ethical enforcement mechanisms, erode adherence to the notarial code of ethics, and ultimately diminish the dignity of the notarial profession as a public office entrusted with public responsibility. This study concludes that maintaining a unified notary organization under a single-bar model is essential to safeguarding professional integrity, strengthening supervision, and enhancing the institutional credibility and public trust in the notarial profession in Indonesia.
