Abstract

The purpose of this paper are: first, to examine critically how the politics of agrarian law in Indonesia canprovide legal protection for land ownership for farmers in Indonesia, so that the transition of function ofthe land from agricultural land into non-agricultural sector still pays great attention to the farmers as thevulnerable groups (poor, abandoned); second, to examine critically how the draft of the land law whichis now being discussed in parliament can give protection to the farmers, so that they have bargainingposition of land ownership equally with those of the capital owners.This paper uses three analysis namely: 1) juridical analysis to understand the legal norms of the land lawfor the farmers in Indonesia; 2) historical analysis to understand the history of land ownership for farmerssince independence of Indonesia which had not been proporsionil compared with the ownership to thoseof investors in Indonesia; 3) analysis of prospective of agrarian law corcerning with the pros and cons ofthe Bill of Land being discussed before the Parliament.This paper wishes to provide alternative for the rule of land for the farmers, so that the politics of lawrelated to land in Indonesia correlated with farmers’ strategic position as one of the main agents of thedevelopment.

Abstract

Indonesian Village Law 2014 states that the purpose of village regulation is to create an independent village. Village management in Indonesia is carried out using a self-governing community system that requires apparatus that has good capacity. On the other hand, the existence of village apparatus in Indonesia still does not have the capacity needed to organize the government to become an independent village. Therefore, it is necessary to do a political law reconstruction to find a solution to the inequality of expectations of village regulation and the reality of the quality of village officials like this. Political law functions as a bridge to the goals to be achieved and is strongly influenced by the social reality of society. This research was conducted using a qualitative approach with the type of library research by reviewing data related to villages in Indonesia, especially village government. The results of this study revealed that only 7.43% were independent villages, most of village apparatuses unprofessional, poverty rate 9.66%, and unemployment rate of 5.01%. This requires a solution through a series of solution policies so that the objectives of village regulation towards independent villages can be achieved so that the prosperous community can be achieved.Undang-Undang Desa Tahun 2014 menyebutkan bahwa tujuan peraturan desa adalah untuk mewujudkan desa yang mandiri. Pengelolaan desa di Indonesia dilakukan dengan sistem kemasyarakatan swakelola yang membutuhkan aparatur yang memiliki kapasitas yang baik. Di sisi lain, keberadaan perangkat desa di Indonesia masih belum memiliki kapasitas yang dibutuhkan untuk menyelenggarakan pemerintahan menjadi desa yang mandiri. Oleh karena itu, perlu dilakukan rekonstruksi politik hukum untuk mencari solusi atas ketimpangan ekspektasi peraturan desa dan realitas kualitas aparatur desa seperti ini. Hukum politik berfungsi sebagai jembatan menuju tujuan yang ingin dicapai dan sangat dipengaruhi oleh realitas sosial masyarakat. Penelitian ini dilakukan dengan menggunakan pendekatan kualitatif dengan jenis studi pustaka dengan mengkaji data-data terkait desa di Indonesia khususnya pemerintahan desa. Hasil penelitian menunjukkan bahwa desa mandiri hanya 7,43%, perangkat desa sebagian besar tidak profesional, tingkat kemiskinan 9,66%, dan tingkat pengangguran 5,01%. Untuk itu diperlukan solusi melalui serangkaian kebijakan solusi agar tujuan peraturan desa menuju desa mandiri dapat tercapai sehingga masyarakat sejahtera dapat tercapai.

Abstract

The state obligations to fulfill and protect the rights of adolescent victim of incest rape post-abortion and other rights have not been exercised during the legal process of investigation until court verdict as it is indicated that the adolescent victim is unfairly detained without due process for illegally practicing abortion. This occasion indicates that the law is being unfair towards the adolescent victim without considering the precondition which inevitably forces the abortion. This article scrutinizes such case of Muara Bulian county in which the local court’s verdict No. 5/Pid.Sus.Anak/2018/PN.Mbn did not accommodate the substantive justice which take stand of the rights of adolescent victim of incest rape. The verdict indicates that such court verdict does not express gender sensitivity to the right of adolescent female victim of incest rape to which the state is obliged to fulfil and protect.

Abstract

Indonesian government does not have “political will” in implementation local government in the land field based on authority principles.This problem can be seen from overlapping regulation in land’s field,on the one hand stipulated that land as local’s autority,on the other hand it still as central’s autority.This tension brings to effect more confflicts in indonesia. To solve the above problem,it needs regulations sincroization in the land field which regulater that land task is local governments authority,while central government only to do preventive and refresif,monitoring through making regulation,standard and norm that will become the rule of the game for local government in implementing the lands authority.Key words :land matter, decentralization, centralization, autorite

Abstract

Management Right on Land (HPL) is right outside in Act No. 5 of 1960 on Basic Regulation on Agrarian Principles (Undang-undang Pokok Agraria/UUPA) that grow and develop in accordance with the demands of the development. Rights that has existed since the colonial era already formulated in a special regulation, so that the holders of HPL with are third parties who utilize HPL within the law and morals. Development held in Indonesia still requires the existence of HPL, due to limited government funds and the empowerment of government agencies central government and local government. HPL may become a test of the right control of the country. Are the economically weak have a place in existence in order to compensate parties who HPL always "land eklpoitation "  the investors.Key word: Management Right, value, development.

Abstract

This article discusses juridical implications about the regulation of state-owned enterprises (BUMD) after the enactment of the Law Number 23 Year 2014 about Regional Government (Regional Government Law 2014) and the application on regulation of BUMD in Jambi Province. Research methode in this study is normative juridical with law approach. Based on the results of the study are known, the enactment of Regional Government Law 2014 has implications for the existence and regulations of existing and future of BUMD, namely in terms of form and naming of BUMD; organ of BUMD; tenure of directors and councils; and intervention of DRPD (Regional People’s Representative Assembly) on BUMD operations. The result of the study also shows that not one regional government in Jambi Province that followed up on the mandate of the article 402 paragraph (1) Regional Government Law 2014 to adjust the regulation of BUMD, and that’s why it is potentially contradicting with Regional Government Law 2014 and central government policy. Abstrak Artikel ini membahas implikasi yuridis pengaturan Badan Usaha Milik Daerah (BUMD) pasca berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah (UU Pemda 2014) dan penerapannya pada regulasi BUMD di lingkungan Provinsi Jambi. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan. Berdasarkan hasil kajian diketahui, berlakunya UU Pemda 2014 berimplikasi terhadap eksistensi dan regulasi BUMD baik yang telah ada maupun yang akan dibentuk, yaitu dalam hal bentuk hukum dan penamaan BUMD; persyaratan pendirian dan kelayakan usaha BUMD; penyertaan modal daerah dan kepemilikan modal dalam BUMD; organ BUMD; masa jabatan Direksi dan Dewas/Deris; dan campur tangan DPRD dalam operasional BUMD. Hasil penelitian juga menunjukkan belum ada satu pun Pemda di lingkungan Provinsi Jambi yang menindaklanjuti amanat Pasal 402 ayat (1) UU Pemda 2014 untuk menyesuaikan regulasi BUMD, dan dengan demikian potensial bertentangan dengan UU Pemda 2014 dan kebijakan pemerintah pusat.

Abstract

Belum ditemukan akta Perusahaan Terbatas (PT) dalam mencantumkan kesadaran lingkungan berupa tanggung jawab sosial dan lingkungan pada akta pendirian PT dan Anggaran Dasar Perusahaan Terbatas (PT), sehingga terkesan tanggung jawab sosial perusahaan atau lebih dikenal dengan CSR terkesan pengeluaran biaya (cost center) perusahaan, karena adanya tekanan luar yakni berbagai peraturan perundangan dan kebijakan pemerintah dan tekanan globalisasi yang mewajibkan hal tersebut. Padahal klausul pendirian dan perubahan PT yang dapat menjadi agenda pada saat pendirian dan RUPS sangat memungkinkan dapat dimuat oleh Notaris melalui kewajibannya memberikan penyuluhan hukum dan keinginan perusahaan untuk menyadari bahwa kesadaran perusahaan atas lingkungan yang baik dan sehat adalah bagian yang melekat atas kehadiran perusahaan di muka bumi (kewajiban hukum dan moral). Tujuan Penelitian ini adalah : Pertama :Untuk menjadikan kesadaran lingkungan sebagai suatu peryataan kesadaran perusahaan dalam mewujudkan tanggung jawab sosial dan lingkungan perusahaan sebagai kewajiban hukum perusahaan Kedua untuk meningkatkan peran perusahaan dalam pembangunan berkelanjutan sebagai suatu kewajiban moral. Metode Penelitian yang digunakan adalah yuridis normative dengan menjadikan akta notaris pada pendirian atau perubahan Anggaran Dasar sebagai ruang yang sangat memungkinkan notaris dan perusahaan dapat membangun kesadaran hukum melalui keadilan lingkungan, dengan pendekatan historis, dan pendekatan perundang-undangan serta pendekatan konsep yang diperolah melalui bahan hukum primer, sekunder dan tersier, maka teknik pengumpulan bahan hukum yang dipergunakan adalah, menginventarisir, ketentuan Anggaran Dasar perusahaan untuk dilakukan klasipikasi dan sistematisasi dan selanjutnya dengan mengunakan interpretasi, maka dilakukan analisis, sesuai dengan perkembangan hukum perusahaan dan hukum lingkungan serta peran notaris sebagai pejabat umum yang melaksanakan sebagian tugas pemerintah dalam mendorong perusahaan guna menjalankan kewajikannya melalui prinsip-prinsip pembangunan berkelanjutan yakni mewujudkan lingkungan hidup yang baik dan sehat. Kesimpulan penelitian ini menunjukkan, pertama: bahwa fungsi klausul tanggung jawab sosial dan perusahaan tetap harus didorong dalam prosedur peraturan perundang-undangan terutama di daerah berupa perda dan kebijakan lainnya serta Ikatan Notaris Indonesia (INI) untuk selalu memberikan rambu-rambu bagi anggotanya dalam pengembangan akta perusahaan sebagai tanggung jawab hukum dan moral INI dalam mengembangkan prinsip-prinsip moral notaris dalam pembuatan akta .Kedua Pembangunan berkelanjutan bagi perusahaan yang ada di indonesia belum menjadi instrumen dasar bagi perusahaan untuk berbagi keuntungan karena masih dipandang memberatkan perusahaan, dan prosedur perizinan yang menjadi kewenangan pememerintah daerah selaku eksekutor dalam mengawasi klausul tanggung jawab sosial sebagai instrumen lingkungan dalam mewujudkan lingkungan yang baik dan sehat sebagai ujung tombak pembangunan.

Abstract

Legal Procedure in the Implementation of Cyber ​​Notary in the future is closely related to legal development, community development and the development of science and technology. The development of technology and information is a phenomenon that continues to grow, can hardly be balanced with the development of law. Notary is a certain position that runs the profession in legal services to the community, needs to get protection and guarantees in order to achieve legal certainty. The development of technology and information is characterized by the era of informatics technology that introduces cyberspace, namely with the presence of Interconnected networks (Internet), this communication does not use media such as paper and the actual pens in Law are a tool for legal actions. In the Notary Protocol, there are minuta deeds in the form of a collection of documents which are State Archives that must be stored and maintained by a Notary and can be used as evidence in the event of legal actions in civil law. Digitally documenting (storage media) and CCTV as supporting documents for legal actions in signatories Contract agreements and as a Notary Protocol can be done using a computer / device and / or a computerized system or using the Internet. Computers are human tools in completing daily work, both personal work, in government and private offices. Storage media tools / equipment for decoding archives that are currently and are still being used in the form of diisket, laser disk, CD, DVD, HD-DVD and Blu-Ray, Memory Card, Memory Card, Flashdisk. USB Flash Drive, Hard Disk, External Hard Disk, and storage of data / documents Archives online, known as Cloud Storage. CCTV can be used as a supporting document for legal actions in signatories to contract agreements and as a notary protocol, because CCTV can record activities that are being carried out in the form of a video record, can store documents electronically and can connect objects to one another.

Abstract

The purpose of this study is to find out and analyze about electronic signatures application in manufacture of authentic deeds reviewed from Indonesia legislation perspective and the validity of authentic deed that signed electronically. The legal issue that will be examined in this paper is existance of law conflict between Article 15 paragraph (3) Law Number 2 of 2014 concerning amendment to Law Number 30 of 2004 concerning Notary Position with Article 5 Juncto Article 6 Juncto Article 11 of Law Number 19 of 2016 concerning amendment to Law Number 11 of 2008 concerning electronic information and electronic regarding the use of electronic signatures in authentic deeds. The type of research in this research is normative juridical law research. The approach used in this research is the law approach, phylosophical law approach, and conceptual approach. The results of this research show if there is no explicit explanation about notary authority to make deeds electronically. That makes electronic deeds including electronic signatures on it based on the concept of cyber notary didn’t have perfect evidentiary power. The application of electronic signatures is very closely related to electronic deeds. However, the deeds manufacture must be conducted in front of authorized official. Thus, the deeds were manufacture and signed electronically are not considered authentic deeds but  privately made deed. Abstrak                                                      Penelitian ini bertujuan untuk mengetahui dan menganalisis mengenai penerapan tanda tangan elektronik dalam pembuatan akta otentik dri perspektif peraturan perundang-undangan di Indonesia dan keabsahan akta otentik yang ditanda tangani secara elektronik. Isu hukum yang akan diteliti dalam penelitian ini adalah adanya konflik hukum antara Pasal 15 ayat (3) Undang-Undang Nomor 2 Tahun 2014 tentang perubahan Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dengan Pasal 5 Juncto Pasal 6 Juncto Pasal 11 Undang-Undang 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik mengenai penggunaan tanda tangan elektronik dalam akta otentik. Tipe penelitian dalam penelitian ini adalah yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah Pendekatan Undang-Undang (Statute Approach), Pendekatan Filosofis (philosophical approach), Pendekatan Konseptual (Conseptual Approach). Adapun hasil dari penelitian ini menunjukan bahwa tidak ada penjelasan secara tegas tentang kewenangan notaris membuat akta secara elektronik. Hal itu mengakibatkan akta elektronik termasuk tanda tangan elektronik didalamnya berdasarkan konsep cyber notary tidak memiliki kekuatan pembuktian yang sempurna. Penerapan tanda tangan elektronik sangat erat hubungannya dengan akta elektronik. Akan tetapi pembuatan akta harus dilakukan dihadapan pejabat yang berwenang. Sehingga, akta yang dibuat dan ditandatangani secara elektronik tidak dianggap sebagai akta otentik melainkan akta dibawah tangan.

Abstract

Stamps in documents of a civil nature are very important for legal certainty in fulfilling evidence to be submitted to court. Therefore, stamp duty is very important in terms of proof in court so that in the use of stamp duty there are of course legal rules that regulate it. Even though there are legal rules that regulate it, often the Land Deed Making Officer violates the applicable legal rules. The problem to be studied is the regulation of the use of stamp duty on the copy of the deed of the Land Deed Official and the validity of the copy of the deed of the Land Deed Maker who uses stamp duty as evidence in court. The research method used is normative juridical so that the research is descriptive and the data source comes from secondary data, then this study uses a legal approach and a conceptual approach and analyzes the data using qualitative analysis. As for the results of the research, namely the regulation of the use of stamp duty on the copy of the deed of the Land Deed Official is regulated in Law Number 13 of 1985 concerning Stamp Duty, Draft Law of 2016, Law Number 10 of 2020 concerning Stamp Duty and the validity of the copy. Land Deed Officials who use stamps as evidence in court are regulated in Law Number 10 of 2020 concerning Stamp Duty that must put stamps on the signatures of Land Deed Making Officials so that they have legal force and fulfill legal certainty in order to be used as evidence. in the court.
