Abstract

Peran notaris dalam pendirian yayasan sangat vital, terutama dalam memastikan proses pendirian dan operasional yayasan sesuai dengan ketentuan hukum yang berlaku. Notaris tidak hanya berfungsi sebagai saksi otentik dalam pembuatan akta pendirian, tetapi juga bertanggung jawab dalam memastikan bahwa akta tersebut memenuhi syarat administratif dan substantif yang diatur oleh peraturan perundang-undangan. Dalam hal ini, pengesahan oleh notaris memberikan kepastian hukum mengenai keabsahan yayasan sebagai entitas hukum yang sah di mata negara. Proses pengesahan ini mencakup pembuatan akta pendirian yang memuat tujuan, struktur organisasi, serta aturan dasar yayasan, yang selanjutnya diajukan kepada Kementerian Hukum dan HAM untuk memperoleh pengesahan. Tanpa pengesahan ini, yayasan tidak dapat beroperasi secara sah dan menghadapi risiko permasalahan hukum di kemudian hari. Notaris juga berperan dalam memberikan penjelasan terkait peraturan perundang-undangan yang relevan dengan pendirian yayasan, termasuk UU Yayasan dan peraturan lainnya. Oleh karena itu, kehadiran notaris dalam pendirian yayasan sangat penting guna menjamin kepastian hukum, menghindari potensi konflik di masa depan, dan mendukung tujuan sosial yang ingin dicapai oleh yayasan tersebut. Dengan peran yang jelas dan profesional, notaris membantu menciptakan fondasi hukum yang kuat bagi keberlanjutan yayasan.

Abstract

The advancement of information technology has significantly increased online buying and selling (e-commerce) activities, but it has also raised issues regarding the protection of consumers' personal data. This journal discusses the legal regulations governing the security of personal data in online transactions and the responsibilities of business actors in safeguarding such data. The research uses a normative juridical approach by analyzing various laws and regulations, including Law No. 8 of 1999 on Consumer Protection, the Electronic Information and Transactions Law (ITE Law), and Law No. 27 of 2022 on Personal Data Protection. The findings reveal that although several regulations provide rights and protection for consumers' personal data, there remains a legal gap concerning the specific responsibilities of e-commerce operators. Personal data protection in e-commerce requires transparency, clearly defined legal accountability, and standardized privacy policies. Therefore, regulatory harmonization and increased legal awareness among business actors and consumers are essential to ensure the optimal protection of consumer rights in the digital era.

Abstract

Talking about the floods that have occurred in Padang city in the last four years (2020-2024), many of them are caused by extreme weather that often changes, which makes it difficult to predict weather that can pose a flood risk. The main cause of flooding is that there is a drainage system that is not optimal and is also influenced by people's behavior in disposing of garbage, and the lack of government supervision is also one of the factors for flooding. Lack of supervision in the transfer of land functions, logging, implementation of infiltration area regulations and licensing of disaster-prone areas. The government said all of this was due to a limited government budget, so a problem formulation emerged: 1) How are regulations related to flood management in the city of Padang; 2) What are the factors inhibiting the difficulty of implementing regulations related to flood management efforts in the city of Padang. To answer this problem, a type of normative juridical research is used in this journal to find and review Padang City laws related to flooding so that conclusions are obtained: 1) regulations related to flood management in the city of Padang based on Law Number 24 of 2007 according to article 1 paragraph 6 of Government Regulation No. 21 of 2008 concerning the Implementation of Disaster Management, namely a series of efforts to reduce disaster risks, both through physical development and public education and capacity building to deal with disaster threats. Factors inhibiting the difficulty of implementing regulations related to flood management efforts in Padang city are due to a lack of coordination between agencies and the involvement of various institutions as well as different departments that may not be well coordinated in flood prevention and mitigation efforts.
