Abstract

In the property world, housing procurement agreements between developers and banking institutions such a PT Bank Niaga play an important role in supporting the provision of affordable and quality housing for the community. However, the implementation of this agreement pften raises various legal challenges, both for developers and banks, which can affect the smoothness of the procurement process. Therefore, this study examines housing procurement agreements with a normative legal approach that includes the regulations of Law Number 1 of 2011 concerning Housing and Residential Areas and the regualtions of the Financial Services Authority (OJK), which are expected to provide a deeper understanding of the legal basis, procedures, right, obligations and risks involved in the legal relationship between the two parties. The purpose of this paper is to explore the implementation of housing procurement agreements by developers at PT Bank Niaga, with a focus on the legal aspects and implications of practies in the field. The results of the study indicate that housing procurement agreements by developers at PT Bank Niaga have generally referred to the applicable legal framework, this study highlights the importance of implementing prudential principles by PT Bank Niaga in financing housing procurement projects. At the same time, it is emphasized that the implementation of the housing procurement agreements by developers at PT Bank Niaga requires stronger legal certainty and strengthening of supervision in its implementation.

Abstract

Penelitian ini mengkaji implementasi pendekatan keadilan restoratif dalam penanganan kasus kekerasan dalam rumah tangga (KDRT) di Indonesia, dengan fokus khusus pada perlindungan hak-hak perempuan sebagai korban. Permasalahan KDRT masih menjadi fenomena yang kompleks dalam masyarakat Indonesia, dimana pendekatan hukum konvensional seringkali belum mampu memberikan solusi yang komprehensif bagi pemulihan korban. Melalui metode penelitian yuridis empiris dengan pendekatan socio-legal, penelitian ini menganalisis data primer dari wawancara mendalam dengan korban KDRT, penegak hukum, dan pendamping korban di tiga kota besar di Indonesia, serta data sekunder dari dokumentasi kasus dan regulasi terkait. Hasil penelitian menunjukkan bahwa implementasi keadilan restoratif dalam penanganan KDRT memiliki potensi signifikan dalam memulihkan hak-hak korban, namun masih menghadapi berbagai tantangan sistemik dan kultural. Penelitian menemukan bahwa keberhasilan pendekatan restoratif sangat bergantung pada tiga faktor utama: kapasitas fasilitator dalam proses mediasi, dukungan sistem hukum yang memadai, dan pemberdayaan ekonomi korban. Studi ini merekomendasikan perlunya penguatan kerangka hukum yang mengakomodasi pendekatan restoratif, peningkatan kapasitas aparat penegak hukum, serta pengembangan sistem pendampingan korban yang terintegrasi.

Abstract

This research analyzes the legal aspects of bank credit agreements with tangible collateral in Indonesia. Credit agreements with significant collateral play an important role in the banking system by providing security to creditors against the risk of default. This study uses a qualitative approach to assess existing regulations, including mortgage and trust laws, and challenges in their implementation. The findings show that although the existing legal framework is very comprehensive, there are still some challenges in practice, such as low legal certainty, slow implementation process, and high costs. Furthermore, the study examines the legal protection of creditors and debtors and provides recommendations to improve the effectiveness and efficiency of credit agreements with tangible collateral. This research is expected to contribute to the development of better banking laws and better protection of the interests of all parties involved.

Abstract

In the ever-growing business world, business contracts are the basis for legal certainty and good relations between parties. This article discusses the enforcement of business agreements in an effort to prevent disputes in court. By analyzing various real cases. Clear and detailed agreements can minimize the risk of disputes. In addition, good communication and negotiation when making legal contracts with business competitors means that there is authority over the production and use of certain services by an entity or economic group. The existence of competition law prevents monopolistic practices and unfair business competition, so that trust is obtained in the implementation of contracts, and all trust is obtained in the form of objects, property, and others. Trust is generally considered the basis of a successful relationship and is therefore very sensitive in law and business. This study aims to assist entrepreneurs in drafting and enforcing contracts to reduce the possibility of disputes and ensure more effective legal protection. Most business settlements are carried out using litigation or through a conference process. The settlement begins with filing a lawsuit with the district court and ends with a judge's decision. However, apart from settlement through the litigation process, there are also settlements through non-litigation.

Abstract

This article discusses the relationship between developers, debtors, and consumers in the procurement of housing and pharmaceutical management, focusing on consumer trust and legal protection. The research identifies key factors influencing this relationship, including the unclear legal status of properties in the housing sector, issues with credit transactions, and consumer protection in the pharmaceutical industry. The findings reveal that uncertainty faced by consumers in the housing sector, such as delays in construction and properties not meeting promises, can decrease consumer trust in developers. In the pharmaceutical sector, strong consumer protection and strict oversight of drug distribution play a crucial role in enhancing consumer satisfaction and trust in pharmaceutical products. This article suggests the need for clear regulations, stricter oversight, and transparency in both sectors to protect consumer rights and ensure healthy relationships between service or product providers and consumers. The government is expected to strengthen supervision and law enforcement to improve consumer trust and the sustainability of businesses in both sectors.

Abstract

This study undertakes a comprehensive examination of the legal aspects that govern agreements in house sales transactions. It specifically focuses on key issues such as the criteria for a valid contract, the legal ramifications of a breach, and the protections available for buyers. Employing a normative approach, the research analyzes relevant laws, regulations, court rulings, and pertinent legal literature. The findings indicate that house sale agreements possess unique characteristics that must be taken into account, highlighting the significance of written contracts in mitigating disputes. Furthermore, the study identifies several legal gaps that need to be addressed in order to enhance the protections afforded to all parties involved in house sales transactions.

Abstract

The capital market is one of the key instruments in Indonesia’s economy, facilitating companies to raise capital and offering investment opportunities to the public. However, the increasingly complex nature of transactions in the capital market also presents risks that may harm investors. One of the main issues is the lack of adequate protection for investors, which can lead to substantial financial losses. This study aims to examine and analyze the legal protection of investor rights in capital market transactions in Indonesia, focusing on the effectiveness of existing regulations. The primary legal framework includes Law No. 8 of 1995 on Capital Markets and regulations issued by the Financial Services Authority (OJK) and the Indonesia Stock Exchange (IDX). This research adopts a normative juridical method with a descriptive-analytical approach. The findings suggest that despite the presence of clear regulations, challenges such as suboptimal supervision, a lack of investor legal literacy, and slow law enforcement hinder effective protection. Therefore, enhancing supervision and providing investor education are necessary to optimize investor protection.

Abstract

Resolving defaults in used motorbike sale and purchase agreements is an important aspect in the business world, especially in Indonesia which has a large used motorbike market. Default, which occurs when one party fails to fulfill the obligations agreed to in the contract, can cause losses for both the seller and the buyer. This research aims to identify various methods of resolving defaults, whether through negotiation, mediation, or formal legal channels, as well as analyzing the effectiveness of each method in overcoming problems that arise. With a better understanding of dispute resolution mechanisms, it is hoped that safer and fairer transactions can be created, as well as maintaining healthy business relationships between the parties involved in buying and selling used motorbikes

Abstract

Business dispute resolution is a critical aspect of the business world, often arising from differences in contract interpretation, contract breaches, or disagreements between the involved parties. One effective method of dispute resolution is arbitration, a process outside of court involving an independent and neutral arbitrator or panel of arbitrators. In Indonesia, the Indonesian National Arbitration Board (BANI) is the most well-known arbitration institution widely used in resolving national business disputes. In addition to arbitration, mediation has become an increasingly popular alternative dispute resolution method, especially within the court system. The judicial institutions in Indonesia, in an effort to create more efficient and effective justice, have developed a court-connected mediation mechanism for civil cases, a progressive initiative by the Supreme Court.
