Abstract

ABSTRAKPermasalahan tanah terlantar pada saat ini merupakan akumulasi penelantaran tanah yang terjadi pada masa lalu yang tidak terselesaikan. Adanya tanah terlantar disebabkan oknum pemilik tanah yang tidak mengusahakan tanah yang dimiliki/ketidaksesuaian pemanfaatan tanah sebagaimana dasar pengajuan permohonan penguasaan hak atas tanah yang dimiliki. Seakan telah dapat diprediksikan akan timbulnya tanah terlantar, dalam UUPA menyebutkan akan hilang hak kepemilikan atas tanah salah satunya karena “diterlantarkan”, oleh sebab itu pemilik hak diwajibkan mengelola tanah yang dimiliki sesuai dengan peruntukannya.Penelitian ini menggunakan metoda yuridis normatif, menggunakan perundang-undangan dan konseptual sebagai dasar penelitian ,dan ditunjang dengan data-data yang diperoleh dari BPN Kanwil Provinsi Kalbar yang kemudian dianalisis agar dapat ditarik suatu kesimpulan.Tujuan penelitian dilakukan untuk mengetahui bagaimana seharusnya peraturan Pemanfaatan dan Pendayagunaan Tanah Terlantar dapat memberikan perlindungan hukum kepada pihak penggarap tanpa menimbulkan konflik kepemilikan dan juga mencari bentuk hambatan pemanfaatan tanah terlantar dalam upaya perwujudan peningkatan perekonomian masyarakat pertanian.Hasil penelitian menunjukkan tidak adanya peraturan yang secara langsung memberikan perlindungan kepada masyarakat penggarap. Selain itu masih terdapat kendala dalam usaha pemanfaatan tanah terlantar. Dan dari uraian tersebut dapat disimpulkan bahwa adanya tanah terlantar menimbulkan paradoks antara pihak yang memiliki tapi tidak memanfaatkannya, dengan pihak yang membutuhkan tetapi tidak memiliki lahan untuk di manfaatkan. Dalam pemanfaatan tanah untuk mendukung kesejahteraan penggarap masih terdapat kendala dalam pelaksanaannya.Kata Kunci : Tanah Terlantar, Kesejahteraan, Pemanfaatan dan Pendayagunaan.2ABSTRACT The problem of neglected land at the moment is the accumulation of land abandonment occurred in the past are not resolved . The existence of neglected land caused unscrupulous land-owners who do not cultivate the land which owned / non- use of the land as the basis of application of land property owned . If it had been able to predict the onset of the land will be abandoned , in the UUPA thus be lost ownership of the land either because they " abandoned " , therefore the owner of the rights required to manage the land owned in the manner intended . This study uses normative juridical method ,using legislation and conceptual as basic research, and is supported by data obtained from BPN Regional Office of West Kalimantan Province are then analyzed in order to be drawn to a conclusion . The purpose of research was conducted to determine how it should be use the regulations and Abandoned Land Utilization Utilization and can provide legal protection to the tenants without conflicting ownership and also seek the form of abandoned land utilization barriers in an effort to increase economic farming community . The results showed the lack of legislation that directly provide protection to tenants . In addition there are obstacles in the business use of wastelands . And from the description can be concluded that the existence of abandoned land raises the paradox between parties who have the neglected soil but do not use it , the parties in need but has no land to be utilized . In the use of land to support the well-being of tenants there are problems in implementation . Keywords : Neglected Soil , Welfare , Utilization and Usefulness .

Abstract

Corruption in Indonesia is growing very rapidly, corruption is widespread everywhere and happens systematically. Often corruption is done with sophisticated engineering and utilizing modern technology. The prevention and prevention of corruption can take the form of various kinds, one of which is to instill an anti-corruption culture through anti-corruption counseling in adolescents, youth, and / or students in school. In order to improve the nation's morals, the strengthening of aspects through an anti-corruption culture from an early age is a crucial task for the academic community as a form of community service, nation and state. Through anti-corruption counseling in schools (in this case Muhammadiyah 1 Pontianak High School), it is expected that the younger generation (students or students) are able to absorb the material from the anti-corruption education. This is done to increase students' knowledge about what factors a person commits corruption, about prohibitions and criminal threats against someone who commits corruption, behavior, morality and morals of a person in life in society.

Abstract

Warga Negara Indonesia wajib mentaati segala peraturan atau hukum tujuannya untuk menciptakan ketertiban, ketenteraman, kesejahteraan, kemakmuran, kebahagiaan, dalam upaya memberikan kepastian hukum yang berkeadilan bagi seluruh rakyat Indonesia tanpa terkecuali.Setiap warga Negara bersamaan kedudukannya di dalam hukum dan pemerintahan dan wajib untuk mentaati hukum yang ada dan hal ini sudah tertulis di dalam Undang-undang Dasar 1945. Konsekuensinya setiap warga Negara wajib memiliki dokumen kependudukan dan lain-lain baik yang dikeluarkan oleh instansi kependudukan dan instansi Pencatatan Sipil maupun instansi pelaksana sesuai dengan yang telah ditetapkan pemerintah.Ketentuan yang perlu diperhatikan adalah dalam setiap hubungan yang terjadi di dalam masyarakat menimbulkan terjadinya peristiwa hukum seperti kelahiran, kematian, perkawinan, perceraian, pengakuan anak, pengesahan anak, pengangkatan anak, perubahan nama dan perubahan status kewarganegaraan semua peristiwa tersebut akan menimbulkan akibat hukum yang kesemuanya itu diatur oleh aturan-aturan hukum. Seperti apabila terjadi suatu Perkawinan, bagi semua warga Negara Indonesia baik yang berada di dalam wilayah yurisdiksi Indonesia ataupun tidak sepanjang status nya sebagai warga Negara Indonesia maka harus mentaati dan tunduk pada ketentuan Undang-Undang nomor 1 tahun 1974 tentang Perkawinan.Setiap warga Negara Indonesia wajib memiliki dokumen administrasi keperdataan sebagai tertib hukum dalam kehidupan bermasyarakat untuk menciptakan ketentraman dan keadilan.Terkait dengan persoalan tersebut maka diperlukan sosialisasi dan penyuluhan hukum tentang pentingnya dokumen yang berhubungan dengan administrasi keperdataan bagi warga masyarakat.

Abstract

The development of thinking supported by the ease of obtaining information in real-time with the assistance of a smartphone has changed a person’s pattern of life and the way to socialize. With the current technology, face-to-face socialization has been shifted to video calls. Not only socializing patterns, trading patterns have also been affected. Today trading process is not only held conventionally (buyers come to the store), but also by using the available applications. Through the applications, we can buy goods without having to leave the house. The presence of this change cannot be separated from the role of technology-based startups which create an application offering a variety of convenience services. The growth of the nation’s startups has now penetrated the world market. Some Indonesian startups have a valuation of US $ 1 billion and are included in the Unicorn class such as Tokopedia, Buka Lapak, and Traveloka. Now Go-Jek has also entered the Decacorn class. To protect their business, businessmen need to register their brands for intellectual property. Considering the importance of intellectual property in the industrial revolution 4.0, the researchers carried out this research to protect digital startups in Pontianak, especially in terms of intellectual property registration.

Abstract

Indonesia's land registration system, which adopts a negative publication system with positive elements, has not fully ensured legal certainty, justice, and public welfare because land certificates may still be annulled through court decisions. This study aims to analyze the deficit of welfare and justice values in Indonesia's land registration regulations, examine the principles of the positive publication system implemented in Germany, Switzerland, and England, and formulate an appropriate regulatory reform model for Indonesia. This research employs a normative legal method using statutory, comparative, and conceptual approaches. The findings reveal that, first, Indonesia's current land registration system has not optimally guaranteed legal certainty, justice, and welfare because land certificates remain subject to cancellation. Second, the positive publication systems in Germany, Switzerland, and England provide stronger legal protection through rigorous verification procedures, state guarantees of registered data, and compensation mechanisms for administrative errors. Third, Indonesia should reform its land registration system by adopting a positive publication system through strengthening the legal framework, improving verification procedures, digitalizing land administration, and reinforcing state responsibility. These reforms are expected to enhance legal certainty, reduce land disputes, and promote justice and public welfare.
