Abstract

Latar Belakang : Air Susu Ibu (ASI) memiliki peran vital dalam menunjang pertumbuhan dan sistem kekebalan tubuh bayi, mengandung lebih dari 300.000 sel pelindung dari berbagai penyakit. Dalam menghadapi keterbatasan produksi ASI dari ibu kandung, muncul konsep bank ASI sebagai solusi untuk menyediakan ASI donor bagi bayi, terutama bayi prematur. Namun, keberadaan bank ASI memunculkan persoalan fiqhiyah kontemporer mengenai hukum persusuan dan status mahram. Tujuan : Penelitian ini bertujuan untuk menganalisis pandangan hukum Islam mengenai keberadaan bank ASI menurut Syekh Yusuf Al-Qaradhawi. Metode : Metode yang digunakan adalah penelitian kualitatif dengan pendekatan library research, yaitu mengkaji pustaka dan karya tulis Syekh Yusuf Al-Qaradhawi serta sumber hukum Islam lainnya melalui analisis yuridis kualitatif. Hasil dan Pembahasan : Hasil penelitian menunjukkan bahwa Yusuf Al-Qaradhawi membolehkan keberadaan bank ASI dengan beberapa ketentuan. Menurutnya, persusuan yang menimbulkan hubungan mahram hanya terjadi jika bayi menyusu langsung dari payudara ibu. Jika ASI diberikan melalui media seperti botol atau alat bantu lainnya, maka tidak timbul konsekuensi hukum nasab atau mahram. Ia berpegang pada kaidah ushul fiqih "al-dharar yuzal" (kemudaratan harus dihilangkan), sehingga pemberian ASI melalui bank ASI diperbolehkan dalam kondisi darurat atau kemaslahatan bayi. Kesimpulan : Bank ASI dapat dibolehkan secara hukum Islam menurut ijtihad Yusuf Al-Qaradhawi, selama memperhatikan mekanisme penyusuan tidak langsung yang tidak menimbulkan mahram. Hal ini memberikan solusi praktis dan maslahat dalam pemenuhan kebutuhan ASI, terutama bagi bayi yang sangat membutuhkan.

Abstract

Indonesia is a country rich in culture, tribes, customs, food, and natural resources, making Indonesia one of the countries that the world counts in these matters. In addition to culture, tribes, customs, food, and natural resources, Indonesia is also named as a nation that adheres to the second largest Islamic religion in the world after Pakistan. This religion entered Indonesia around the 7th century AD, more specifically, during the period of the Bani Umayyah caliphate. This research uses a qualitative research methodology that emphasizes literature study to analyze the Ark tradition in Bengkulu, focusing on a comparative perspective on Ark activities when viewed from the perspective of Islamic Law. In the study of fiqh science, there is a rule that reads al-addah al-muhakkamah which is one of the rules of fiqh (Islamic law rules) which states that customs or habits that have been accepted and agreed upon by the community can be the basis or footing in determining the law. When viewed from the point of view of Islam, which has the ahlusunnah wal jama'ah belief.

Abstract

This research is driven by the limited strategic role of schools in instilling moral and social values, which contributes to the emergence of deviant behavior among students. Conversely, schools are also responsible for administering educational sanctions and providing counseling to address such behaviors. The study aims to explore and analyze the role of schools in shaping morality and regulating social behavior, with a specific focus on teaching practices at Al Hasanah Islamic Boarding School in Bengkulu. Utilizing a descriptive qualitative approach, the research investigates the school’s contribution to moral development and its influence in maintaining students’ social standing. The findings reveal that moral education at Al Hasanah is implemented through structured religious routines, such as Qur’an recitation, communal prayers, dhikr, and sunnah fasting—along with teacher role modeling, the reinforcement of discipline, and the cultivation of social practices like greeting, smiling, and showing care for others. These practices have effectively fostered student traits such as integrity, discipline, humility, and leadership. Additionally, the Islamic boarding school functions as a social control institution, successfully minimizing deviant behavior and producing individuals capable of becoming positive role models in society. The study affirms that Islamic boarding schools serve not only as centers of religious education but also as agents of social transformation, contributing to the development of a moral, religious, and socially responsible generation.
