Abstract

The petition submitted to the Pangkalan Balai Religious Court under case No. 202/Pdt.P/2023/PA.Pkb sought judicial clarification regarding the legal status of a child born prior to the formal registration of the parents' marriage. The study explored how the status of such children is determined and examined the judge's reasoning in this case. Using an empirical approach with qualitative data from interviews, documentation, and literature reviews, the research found that the child was declared legitimate as no one contested the child's status as the petitioner's, with witnesses supporting the claim. In reaching its decision, the court took into account the validity of the unregistered marriage based on Islamic legal principles, supported by witness statements, while also emphasizing the safeguarding of the child's rights and placing paramount importance on the child's best interests.

Abstract

  E-court  merupakan kebijakan yang dibuat Mahkamah Agung guna mewujudkan proses peradilan yang sederhana, cepat dan biaya ringan.  Layanan ini juga sebagai respon atas perubahan sosial di era digital. Layanan e-court ini belum dilaksankan dengan baik. Ada beberapa problematika yang muncul seperti, keterbatasan jaringan, ketidaktahuan adanya layanan ini, pihak berperkara tidak dapat menggunakan IT, respon para pihak yang lambat, para pihak lebih nyaman dengan layanan offline dan lain-lain. Di Pengadilan Agama Pangkalan Balai perkembangan penggunaan layanan e-court sangat lambat, dalam tiga tahun terkahir hanya 295 perkara yang menggunakan layanan ini dari jumlah perkara yang ada. Secara diskriftif kualitatif didapatkan adanya kendala atau problematika penggunaan e-court di Pengadilan Agama Pangkalan Balai yang menyebabkab e-court ini dilaksanakan secara insidentil saja.

Abstract

Service to Msyarakat is one of the three mandatory duties of lecturers listed in the tri dharma of higher education, as an implementation of the results that have been learned and can be beneficial to the wider community. Part of the service activity is social service, education and motivation for children in the orphanage, this activity aims to provide benefits to the community in the orphanage. This community service activity was carried out at the Palembang City Divine Blessing Orphanage. Several arrangements of activities such as compensation, motivation to children, and giving a little game (ice breaking) to the children in the orphanage, the service activities carried out at the Divine Blessing Orphanage went well after a series of events, as evidenced by the enthusiasm of the children in participating in these activities. In addition, all related parties also took part in the success of this service activity, which was attended by lecturers and the management of the Indonesian Association of Sharia Scholars (HISSI) South Sumatra. With this togetherness, it can provide a little help to meet the needs for them and benefits for the orphanage, share happiness with our brothers and sisters in the orphanage and can strengthen the bond of friendship between others and create a sense of mutual care and love for fellow humans on earth.
