Abstract

Sebagai tokoh utama dalam positivisme hukum, Hans Kelsen menjelaskan hukum dalam sebagai sistem norma, sebuah sistem yang didasarkan pada keharusan-keharusan (das sollen). Menurut Hans Kelsen, norma adalah hasil produk pemikiran manusia yang bersifat deliberatif. Sebuah norma terbentuk jika dikehendaki menjadi norma, berdasarkan moralitas dan nilai-nilai yang baik. Kelsen berpendapat bahwa dasar pertimbangan sebuah norma bersifat metayuridis. Sesuatu yang metayuridis bersifat das sollen dan belum menjadi hukum yang mengikat masyarakat. Singkatnya, bagi Hans Kelsen, norma hukum selalu diciptakan melalui kehendak. Norma-norma tersebut akan menjadi mengikat masyarakat, jika dikehendaki menjadi hukum dan dituangkan dalam bentuk tertulih oleh lembaga yang berwenang serta memuat perintah. Pandangan Kelsen ini menunjukkan bahwa positivisme hukum menganggap diskusi tentang moral, nilai-nilai selesai saat hukum positif dibentuk. Oleh karena itu, Kelsen terkenal dengan kata-katanya: hukum ditaati bukan karena dinilai baik atau adil, tetapi karena hukum itu telah ditulis dan disahkan penguasa. Ini adalah salah satu teori yang diperkenalkan oleh Hans Kelsen dalam Teori Hukum Murni. Positivisme hukum dijelaskan secara mendalam dari sisi filsafat oleh Kelsen. Penjelasannya berakar pada pemikiran Immanuel Kant, dimana Kelsen memberikan isi pada cara berpikir Kant untuk menjelaskan tentang positivisme hukum. Kant membagi kehidupan menjadi dua bidang: fakta dan ideal. Bidang fakta (alam nyata) melibatkan hubungan sebab-akibat yang terjadi secara alami dan pasti. Misalnya, jika seseorang diancam untuk menyerahkan sesuatu, ia pasti akan memberikannya. Dalam alam fakta, tidak bisa dikatakan bahwa seseorang yang dipaksa menyerahkan sesuatu seharusnya melakukannya

Abstract

Exploitation of children has changed the perspective and morality of humans towards criminal law, at the same time government policies have made a clear regulation on the enforcement of legal protection for children who are victims of exploitation. The study is based on the argument that there is no law enforcement on the practice of child exploitation so that exploitation continues to occur continuously. This study applies a literature study approach and policy review and various data sourced both online and offline which will later be able to provide an objective picture of how child exploitation is in law from the perspective of Islamic family law. As has been found in previous research on punishment for perpetrators of child exploitation, it has ignored the justice of children victims of exploitation by their parents, close people and community agencies. Law enforcement cannot guarantee absolute rights for children autonomously, this is due to many considerations so that legal protection for child victims of exploitation is very difficult to enforce. Thus, a discussion is needed to provide legal protection for child victims of exploitation with the perspective of Islamic family law.

Abstract

Education is a conscious and planned effort to increase the potential of human resources through learning activities aimed at helping students develop all their potential and personal characteristics in a better direction. (Herdiansyah et al., 2021). The learning process is expected to enable students to improve their knowledge, attitudes and skills which are very important for achieving educational goals Types of Research Classroom Action Research (PTK) is a type of research carried out by teachers in their own classes by (1) planning, (2) implementing, and (3) reflecting on actions carried out collaboratively and participatively with the aim of improving their performance as teachers and improve student learning outcomes. Classroom action research is a type of research that aims to improve the quality of learning and includes increasing knowledge about values that can ultimately be applied, as well as increasing student activity and creativity.From the results of the analysis of the results of classroom action research conducted at SMK Negeri 1 Rejotangan to improve PPKn learning outcomes for class This is indicated by a positive increase for each variable studied. The results of classroom action research show an increase in learning outcomes. Problem-based learning (PBL) in Civics subjects can improve learning outcomes. The results of the first cycle of research, with an average of 70 results, showed that only 13 students (or 32.5% of the total students) and 27 students (or 67.5% of the total students) did not reach the Minimum Completeness Criteria (KKM) for PPKn subjects of 75% . As a result, researchers had to continue the research to cycle II. After being implemented and improved, the problem-based learning (PBL) model was used in the second cycle of relearning actions. PPKn learning outcomes increased with an average score of 86 and a classical completion rate of 100%, with 40 students completing and 0 students not yet completing. Thus, researchers do not need to continue to the next cycle because student learning outcomes have reached the expected KKM scores and criteria.

Abstract

Suatu perjanjian jual beli antara kedua belah pihak yang menimbulkan hak dan kewajiban. Yang dimana pembeli sudah melakukan pembayaran dan penjual berkewajiban menyerahkan barang yang dijual, akan tetapi penjual tidak melakukan prestasinya yaitu penjual membatalkan secara sepihak tanpa pemberitahuan kepada pembeli. Penjual membatalkan pesanan yang sudah dibayar harusnya dikirim tetapi dibatalkan sehingga menimbulkan kerugian. Perbuatan ini tidak dibenarkan menurut Hukum Positif dan Hukum Islam. Rumusan masalah penelitian adalah bagaimana perlindungan hukum akibat dari pembatalan transaksi jual beli online yang dilakukan oleh penjual di tiktok shop, bagaimana Perspektif Hukum Ekonomi Syariah terhadap pembatalan transaksi jual beli online di tiktok shop. Metode penelitian adalah kualitatif deskriptif, jenis penelitian library research, pengumpulan data dengan mencari informasi dari buku serta tulisan yang sesuai objek pembahasan dengan cara membaca dan menelaah. Hasil dari penelitian bahwa pembatalan sepihak suatu perjanjian disebut ketidaksediaan salah satu pihak (penjual) untuk memenuhi prestasi yang telah disepakati. Hal ini tidak dibenarkan menurut Undang-undang Perlindungan Konsumen Nomor 8 Tahun 1999 yaitu pada pasal 16 dan penjual dikenakan sanksi penjara 2 tahun atau denda Rp 500.000.000 rupiah pada Pasal 62 ayat 2. Menurut Perspektif Hukum Ekonomi Syariah pembatalan sepihak tidak boleh dilakukan apabila transaksinya telah memenuhi rukun dan syarat yaitu bahwa dalam perjanjian telah disepakati bersama, tidak boleh dibatalkan secara sepihak tanpa memberitahukan kepada pembeli, karena pembeli sudah membayar yang seharusnya mendapatkan barang akan tetapi tidak mendapatkannya, itu tidak dibenarkan seperti dalam surat An-Nisaa’ ayat 29, surat Al-Israa’ ayat 34, surat An-Nahl ayat 91 dan Kompilasi Hukum Ekonomi Syariah Pasal 36 dan sanksinya pasal 38.

Abstract

Many people carry out ta'lim assembly activities in order to learn religious knowledge. One of the aims of the ta'lim assembly is to foster an attitude of concern for society. However, there are still many people who do not care about the surrounding environment, both those who actively participate in ta'lim assembly activities and those who are less active. Therefore, this service was carried out with the aim of fostering an attitude of social care for members of the Tanjung Barangan Ta'lim al-Akbar Council, Palembang City. The material in this service is carried out directly by providing direct understanding and also using qualitative descriptive methods to collect data obtained through observation, unstructured interviews and documentation. This service activity can be said to be successful in providing guidance to the management of the Ta'lim al-Akbar Council to have a caring attitude towards others, especially towards people in need. This service activity was successful because there were supporting factors such as: public awareness of good things; assistance and support from local authorities; and adequate facilities. However, there are also inhibiting factors, namely the lack of comprehensive information and miscommunication between congregations.

Abstract

Service to Msyarakat is one of the three mandatory duties of lecturers listed in the tri dharma of higher education, as an implementation of the results that have been learned and can be beneficial to the wider community. Part of the service activity is social service, education and motivation for children in the orphanage, this activity aims to provide benefits to the community in the orphanage. This community service activity was carried out at the Palembang City Divine Blessing Orphanage. Several arrangements of activities such as compensation, motivation to children, and giving a little game (ice breaking) to the children in the orphanage, the service activities carried out at the Divine Blessing Orphanage went well after a series of events, as evidenced by the enthusiasm of the children in participating in these activities. In addition, all related parties also took part in the success of this service activity, which was attended by lecturers and the management of the Indonesian Association of Sharia Scholars (HISSI) South Sumatra. With this togetherness, it can provide a little help to meet the needs for them and benefits for the orphanage, share happiness with our brothers and sisters in the orphanage and can strengthen the bond of friendship between others and create a sense of mutual care and love for fellow humans on earth.

Abstract

The purpose of this study is to (1) describe the types of expressive speech acts carried out by the characters in the web series How Much Progress? (2) describe the function of expressive speech acts in the web series How Much Progress? and (3) describe its relevance to fantasy story learning in junior high schools. This study uses a qualitative method with the research subjects being the web series How Much Progress? and the form of data in the form of speech from the dialogue in the web series How Much Progress? In addition, the data collection procedure uses the listening and note-taking method. The data analysis used is the analysis of the content of speech in the web series How Much Progress? dialogue and the data validity checking technique carried out using triangulation and member check techniques. The results of this study indicate that (1) regarding its form, expressive speech acts contained in the web series How Much Progress? consist of 4 forms of speech, namely the type of direct literal speech act, the type of direct non-literal speech act, the type of indirect literal speech act, and the type of indirect non-literal speech act. (2) regarding the function of expressive speech acts in the web series How Much Progress? consists of 6 functions, namely thanking, apologizing, praising, complaining, sympathizing, and expressing anger. The results of the study are relevant to fantasy story learning in junior high schools, students can identify characters and characterizations in web series What is the percentage of progress?

Abstract

The implementation of the Hajj and Umrah pilgrimages, causing delays and cancellations which have given rise to legal and economic problems. The main point of this research is the form of responsibility of AFI Tour Travel towards delayed Hajj pilgrims and how sharia economic law reviews the responsibilities of AFI Tour Travel towards delayed Hajj pilgrims. The purpose of this research is to determine the form of responsibility of AFI Tour travel towards delayed Hajj pilgrims and to find out a review of sharia economic law regarding the responsibility of AFI Tour travel towards delayed Hajj pilgrims. There were 6 respondents to this research, namely 2 AFI Tour Travel travel administrators and 4 pilgrims who were delayed. The research method used is empirical juridical research, namely research that combines law with observational data analysis by means of field observation, direct interviews with respondents, and documentation. Data analysis in this research is qualitative analysis. The results of this research are that AFI Tour Travel's responsibility for Hajj pilgrims who are delayed due to Covid is included in force majeure or default. The responsibilities given are to negotiate with the congregation and reschedule departures to a time that allows as well as providing communication and transparency to the congregation. In reviewing sharia economic law regarding AFI Tour's responsibility towards pilgrims who are delayed due to Covid, it is correct and appropriate because through deliberation they made a new contract and fulfilled the contents of the contract.

Abstract

Implementasi kinerja Aparatur Dinas kependudkan di atur dalam Undang-Undang Nomor 24 Tahun 2013 tentang Administrasi Kependudukan menegaskan bahwa pelayanan administrasi kependudukan harus dilakukan secara transparan, cepat, dan tanpa biaya. Namun, di Kabupaten Sambas pelaksanaannya masih menghadapi kendala seperti keterbatasan aparatur, kurangnya pemanfaatan teknologi informasi, serta rendahnya kualitas evaluasi terhadap kinerja pegawai. Hal ini berdampak pada belum optimalnya pelayanan yang diterima masyarakat. Dengan demikian, peneliti akan mengkaji Implementasi Undang-Undang Nomor 24 Tahun 2013 tentang Administrasi Kependudukan terkait Evaluasi Aparatur Dinas Kependudukan dalam Meningkatkan Pelayanan Administrasi Kependudukan di Kabupaten Sambas. Adapun fokus masalah dalam penelitian ini yaitu: (1) Bagaimana implementasi UU No. 24 tahun 2013 pasal 79A dalam pelayanan administrasi kependudukan, (2) Apa saja kendala yang dihadapi Aparatur Dinas Kependudukan dalam menerapkan UU No. 24 tahun 2013. Penelitian ini menggunakan metode kualitatif dengan jenis penelitian field research, serta menggunakan pendekatan hukum normatif-empiris, yakni dengan menggabungkan antara studi normatif terhadap regulasi yang berlaku dengan observasi langsung terhadap realitas implementasi di lapangan. Pengumpulan data dilakukan melalui wawancara mendalam dan observasi terhadap pelayanan administrasi kependudukan di Kabupaten Sambas. Penelitian ini mengkaji implementasi Undang-Undang Nomor 24 Tahun 2013 Pasal 79A dalam pelayanan administrasi kependudukan serta kendala yang dihadapi aparatur. Secara umum, implementasi sudah berjalan baik dengan layanan gratis sesuai amanat undang-undang, namun masih terhambat keterbatasan sarana prasarana, kualitas SDM, rendahnya kesadaran masyarakat, serta belum optimalnya digitalisasi layanan. Kondisi ini menunjukkan adanya kesenjangan antara regulasi dan praktik di lapangan, sehingga diperlukan peningkatan kapasitas aparatur, penguatan teknologi informasi, dan sosialisasi berkelanjutan untuk mewujudkan pelayanan yang lebih efektif dan berkualitas.

Abstract

This community service program focuses on addressing the problem of low reading skills among lower grade students in Kahayan Tengah Subdistrict, Pulang Pisau Regency. Data from the Education Office (2023/2024) reveals that around 40% of third grade students in several elementary schools, such as in Bahu Palawa and Pamarunan, are not yet fluent in reading. This shows the urgency of improving teachers' capacity to deal with these learning difficulties. As a solution, a syllable learning model was introduced, designed to provide a systematic conceptual framework for letter recognition and word formation, thereby making it easier for students to achieve reading proficiency, which is also the foundation for writing. This reinforcement activity was carried out using a classic method that combined counseling, discussion, and hands-on practice. There were 38 participants, all teachers from the Hapakat Cluster 4 Teacher Working Group (KKG), which covers four elementary schools. Based on observations, 90% of the target participants successfully practiced the lessons well. Evaluation of the students showed an average score of 59.06 with a classical completeness of 25%, indicating the need for continuous intervention. The output of this program is an increase in teachers' knowledge and understanding in implementing early reading learning, which is expected to improve the quality of learning in the classroom. More broadly, the targeted final output is the publication of scientific articles in the PengabdianKu Journal of Muhammadiyah University Palangka Raya and the registration of Intellectual Property Rights .
