Abstract

Indonesia as an archipelagic country with thousands of islands, ethnic groups, regional languages, and religions, is a real portrait of a multicultural society. This article discusses the strategic role of educational institutions in building a multicultural culture that is in line with the values ​​of Islamic law. In the context of a pluralistic society, education is the main means to instill the values ​​of tolerance, justice, and mutual respect between ethnic, cultural, and religious differences. Islamic law, as the normative foundation of Muslims, teaches the principles of peaceful coexistence and upholds humanity. Through an inclusive curriculum, character building, and exemplary behavior from educators, educational institutions can become agents of change in creating social harmony rooted in Islamic teachings. This article uses a qualitative-descriptive approach with an analysis of Islamic literature and education policies in Indonesia. The results of this study illustrate that the integration of multicultural values ​​and Islamic law in a more inclusive education system can strengthen social foundations and minimize the potential for conflict in a plural society.

Abstract

Tujuan penelitian ini adalah Menjelaskan pengertian, karakteristik, dan cakupan konsep ‘Am (umum) dan Khash (khusus) dalam ilmu Ushul Fiqh. Menganalisis metode ulama ushul dalam mengidentifikasi, mengklasifikasi, dan memahami dalil yang bersifat ‘Am dan Khash dalam sumber-sumber syariat (Al-Qur’an dan Hadis). Menggambarkan bagaimana interaksi antara dalil ‘Am dan Khash dapat mempengaruhi proses istinbat hukum (penggalian hukum Islam). Mengkaji implikasi praktis dari konsep ‘Am dan Khash dalam penetapan hukum-hukum fiqih kontemporer. Menilai sejauh mana pemahaman terhadap konsep ini berkontribusi dalam harmonisasi antara teks umum dan khusus dalam pemecahan masalah hukum Islam. Bentuk penelitian ini adalah deskriptif, analitis, dan kritis. Oleh karena itu, penulis dapat menjelaskan secara komprehensif bagaimana Konsep ‘Am dan Khash dalam Ushul Fiqh serta Implikasinya. Dalam penelitian ini, penulis secara optimal menggunakan dua sumber data yang terkait dengan penelitian ini, yaitu. Sumber data primer dan sumber data sekunder. Konsep ‘Ām dan Khāṣ merupakan instrumen fundamental dalam Ushul Fiqh yang digunakan untuk memahami makna teks syar’i (nash) secara tepat. ‘Ām mengacu pada lafaz yang mencakup seluruh individu dalam cakupan tertentu, sementara Khāṣ membatasi cakupan tersebut hanya pada sebagian. Para ulama sepakat bahwa dalil ‘ām dapat ditakhsis (dikhususkan) oleh dalil khāṣ, baik yang datang dari Al-Qur’an, hadis, ijma', maupun qiyas. Pemahaman ini membentuk dasar dalam metodologi istinbat hukum. Perbedaan pandangan ulama muncul dalam beberapa aspek, seperti takhsis dengan dalil yang zanni, takhsis dengan akal, dan takhsis dengan perbuatan Nabi. Hal ini menunjukkan dinamika ijtihad dalam Ushul Fiqh. Interaksi antara dalil ‘ām dan khāṣ memiliki implikasi hukum yang signifikan, seperti dalam penentuan siapa saja yang terkena kewajiban atau larangan tertentu. Contoh klasiknya adalah ayat warisan, hudud, dan hukum jual beli. Implikasi kontemporer dari konsep ini terlihat dalam fatwa dan fiqh modern, di mana mujtahid kontemporer harus teliti dalam menyaring dalil umum yang tampaknya berlaku luas, namun sebenarnya telah ditakhsis oleh dalil khusus dalam konteks sosial-historis tertentu. Pemahaman terhadap konsep ini sangat penting dalam mencegah kesalahan istinbat hukum, menjaga kehati-hatian dalam memberi fatwa, dan menjamin bahwa hukum yang ditetapkan bersifat kontekstual serta adil.

Abstract

This study examines the educational thoughts of Ki Hadjar Dewantara (KHD) from the perspective of Islamic law to reveal the common ground and its relevance. KHD, as a pioneer of Indonesian national education, offers a liberating educational philosophy, Tri Pusat Pendidikan, and Among System as well as the fundamental concept of Tri Nga concept of Tri Nga (Understand=know), (Feel=understand), (Nglakoni=do). On the other hand, Islamic law provides a universal value framework based on the Qur'an and Sunnah, with Maqashid Syariah as its main objective which includes the maintenance of religion, soul, mind, descendants, and property. Using the method of library research and comparative analysis. This study finds significant alignment between KHD's educational philosophy and the principles of Islamic law. The implication of the synthesis of these two thoughts is the development of a more integrative, innovative, and holistic model of Islamic education in Indonesia, capable of producing a generation that is intelligent, has noble character, is independent, and cares about society. This study contributes to interdisciplinary studies and provides practical guidance for the curriculum and practice of Islamic education.

Abstract

Reason is the primary tool for learning. Learning is the process of understanding, analyzing, and then drawing conclusions. This learning process is a complex activity that involves the interaction of various systems in the brain, including attention (cognitive), memory, language, and the execution of cognitive functions. Brain disorders, both developmental and acquired, have a significant impact on an individual's cognitive abilities in the learning process. Essential cognitive functions such as attention, memory, language, and executive function are greatly affected by certain neurological conditions such as dyslexia, ADHD, autism, traumatic brain injury, and disorders due to brain infections. This article aims to identify the types of brain disorders that affect learning, analyze the specific impact on cognitive function, and formulate intervention strategies that can be applied. Intervention approaches include educational strategies based on differentiation and Individualized Education Program (IEP), therapeutic interventions such as speech and occupational therapy. With a comprehensive understanding of neurological conditions and individual needs of learners, the learning process can be optimized in an inclusive and adaptive manner.
