Abstract

Masalah utama dalam penelitian ini adalah: Bagaimana hukumnya cerai melalui media sosialbaik SMS, Face Book, CHAT (BBM, YM, Skype, dan WhatsApp). Apakah dengan mentalak melalui mediasosial tersebut talak suami lansung jatuh kepada istrinya? Bagaimana pula kedudukan talak tersebut jikadilihat dari hukum di Indonesia?Metodologi yang penulis gunakan dalam menemukan jawaban dari pertanyaan di atas adalahmetode kualitatif dengan research pustaka. Data-data diperoleh dari sumber skunder dan primer yangdiolah secara analitik.Dari permasalahan yang penulis carikan solusinya dalam penelitan ini, maka penulismenyimpulkan bahwa: 1. Hukum talak melalui media sosial seperti SMS, Face Book, CHAT (BBM, YM,Skype, dan WhatsApp). Adalah sah dan diqiyaskan kepada talak dengan tulisan dengan Illatnya adalahbahwa keduanya merupakan pesan cerai melalui teks yang bukan verbal (lisan). Para ulama fikih (fuqaha)sepakat bahwa hal itu efektif jatuh talak 1 (tulisan dinilai sama dengan ucapan). 2. Syarat untuk jatuhnyatalak melalui media sosial adalah:a). Si Suami benar-benar meniatkan talak kepada istrinya. (berdasar kanpendapat ibnu qudamah). b). Si istri harus melakukan komfirmasi terlebih dahulu kepada si suami. Atassemua kemungkinan ini maka Al-Qur‟an sudah memerintahkan pentingnya tabayyun (klarifikasi) ketikamemperoleh informasi, sebagaimana firman Allah SWT Surat al-Hujurat ayat 6, 3. Meskipun secara syar‟italak melalui media sosial adalah sah, namun secara hukum positif talak tidak lansung jatuh karena mestilahdiikrarkan dulu di hadapan Pengadilan Agama sebagai legalitas dan akurasi talak secara administratifberdasarkan hukum positif yang berlaku di Indonesia.4. Menurut penulis untuk menutup pintu dari tindakansemena-mena dari seorang suami kepada istrinya dengan sikap yang merendahkan kaum perempuan, makahukum bagi orang yang mentalak melalui media sosial adalah makruh atau lebih baik dilarang. Hal inisesuai dengan kaidah kulliyah fikih yaitu:2 Hukum itu mengikuti kemashlahatan yang paling banyak.”Kata kunci: medsos (media sosial), talak, perceraian

Abstract

Artikel ini bertujuan untuk menyelidiki konstruksi identitas antara Muslim tradisional dan Muslim modernis di Indonesia. Tujuannya adalah untuk memahami bagaimana kedua kelompok ini membentuk identitas mereka, baik secara individu maupun sebagai komunitas, serta bagaimana identitas ini tercermin dalam praktik keagamaan, pemikiran, dan tindakan mereka dalam konteks sosial, budaya, dan politik Indonesia.. Metode yang digunakan mencakup analisis kualitatif data yang diperoleh dari literatur ilmiah dan penelitian lapangan. Hasil kajian menunjukkan perbedaan signifikan dalam konstruksi identitas antara Muslim tradisional dan Muslim modernis di Indonesia. Muslim tradisional cenderung mengedepankan praktik keagamaan yang lebih terkait dengan tradisi lokal dan kearifan lokal, sementara Muslim modernis cenderung lebih terbuka terhadap pengaruh global dan menekankan pada pembaruan pemikiran keagamaan dan adaptasi terhadap perubahan zaman. Meskipun demikian, ditemukan juga kesamaan dalam nilai-nilai agama yang mendasari kedua kelompok tersebut, seperti kepatuhan pada ajaran agama dan rasa solidaritas dalam komunitas Muslim. Kesimpulan dari penelitian ini memberikan wawasan yang lebih dalam tentang dinamika konstruksi identitas dalam masyarakat Muslim Indonesia, serta implikasinya dalam berbagai aspek kehidupan sosial, budaya, dan politik.

Abstract

Muhammadiyah sebagai salah satu organisasi Islam terkemuka di Indonesia, telah memainkan peran penting dalam pembentukan dan evolusi Islam di Jawa, Indonesia. Sejak didirikan oleh K.H. Ahmad Dahlan pada tahun 1912 di Yogyakarta, Muhammadiyah telah berkomitmen pada misi memurnikan praktik Islam dengan menolak pengaruh tradisi lokal yang dianggap tidak sesuai dengan ajaran Islam murni. Organisasi ini mengadvokasi pendekatan berbasis teks suci, yaitu Al-Qur'an dan Hadis, dan menekankan pentingnya pendidikan, kesehatan, dan kegiatan sosial sebagai sarana untuk memajukan masyarakat. Dalam kajian ini, kami menyelidiki bagaimana Muhammadiyah berinteraksi dengan kultur Jawa, yang terkenal dengan kekayaan tradisi dan sinkretismenya. Kami menjelajahi tantangan dan strategi Muhammadiyah dalam mengadaptasi dan kadang-kadang menolak aspek-aspek tertentu dari budaya Jawa dalam upayanya untuk menegakkan versi Islam yang dianggap lebih 'murni'. Fokus utama dari penelitian ini adalah pada dinamika antara pemeliharaan identitas keagamaan dan kebutuhan adaptasi kultural, yang tercermin dalam pendekatan Muhammadiyah terhadap pendidikan, aktivisme sosial, dan partisipasi dalam politik lokal. Analisis ini juga membahas bagaimana Muhammadiyah berusaha menciptakan "Islam Berkemajuan", yang memadukan nilai-nilai keislaman dengan modernitas dan responsif terhadap perubahan sosial. Dengan mengkaji peran Muhammadiyah di Jawa, penelitian ini memberikan wawasan tentang bagaimana organisasi keagamaan bisa mempengaruhi dan di pengaruhi oleh konteks kulturalnya, serta implikasinya terhadap pembentukan wajah Islam kontemporer di Indonesia. Kajian ini penting untuk memahami interaksi antara agama dan budaya dalam konteks pluralistik dan dinamis di Indonesia.

Abstract

The occurrence of reunions has been recognized as a contributing reason to the increasing divorce rates in Padang City, with evidence of infidelity frequently associated with these gatherings. This paper examines the research gap about the function of reunions in divorce proceedings within the Religious Court jurisdiction of Padang City. The main aim is to investigate the impact of Islamic legal principles on divorce cases prompted by considerations connected to reunion. The study use a descriptive qualitative methodology to collect empirical data from real-world examples for comprehensive examination. This research distinctly emphasizes the convergence of social activities, such reunions, with legal and theological contexts, providing innovative insights into their role in marital strife. The results suggest that reunions may serve as a catalyst for marital breakdown, especially when preexisting relational difficulties are present. Court proceedings frequently exhibit elevated emotional tension, with judges and legal practitioners crucially responsible for upholding civility. Mediation efforts are often impeded by mistrust arising from reunion situations. Nonetheless, the application of Islamic law principles, including the prevention of harm and the promotion of justice, provides fair resolutions for both parties while striving to uphold the sanctity of marriage when possible. This research enhances the debate by recognizing reunions as a distinct and consequential social catalyst in divorce cases and suggesting Islamic legal strategies to alleviate their effects. These findings offer a novel viewpoint for policymakers and legal professionals to tackle rising issues in family law.

Abstract

Islam as a doctrine capable of addressing every aspect of the community’s issues, will continue to evolve with the times. Muslims are expected to be critical and to have a moderate conceptual framework in interpreting religious texts. This approach will inevitably influence individual movements and religious practices. Muhammadiyah, as one of the largest social organizations in Indonesia, has a deeply rooted religious movement that extends down to the grassroots. This article discusses the concept of moderation as a religious foundation that underpins the Muhammadiyah Islamic Movement in Indonesia. The research method employed is a literature review of the thoughts and teachings embraced by the Muhammadiyah Movement. From this analysis, the article concludes that the religious foundation of the Muhammadiyah Movement includes moderate Islamic principles, an emphasis on education, inclusive da’wah, and social services. This conclusion provides a deeper understanding of the role of the Muhammadiyah Movement in shaping religious identity and its contributions to community development in Indonesia.

Abstract

Objective: This study aims to analyze the religious foundation of the Muhammadiyah da'wah movement, focusing on the concept of al-ummah and cultural da'wah, as well as the application of the concepts of al-khair, al-ma'ruf, and al-munkar in the practice of da'wah and its impact on the social and economic empowerment of Muslims in Indonesia. Theoretical Framework: The theoretical framework of this research focuses on the concepts of al-ummah, al-khair, al-ma'ruf, and al-munkar in Islamic da'wah, as well as a contextual and progressive approach to cultural da'wah to understand the role of Muhammadiyah in the social and economic development of the people. Literature Review: The literature review discusses the religious foundation of Muhammadiyah which is rooted in the Qur'an and Sunnah, as well as the importance of social empowerment through contextual and cultural da'wah. Although many studies have discussed Muhammadiyah's da'wah, there is still a gap in the application of da'wah to socio-economic empowerment. Methods: This study uses a qualitative approach with case studies and content analysis. The data was collected through in-depth interviews with Muhammadiyah administrators and observation of da'wah practices in several regions, then analyzed thematically. Results: Muhammadiyah da'wah focuses on spiritual aspects as well as socio-economic empowerment through contextual cultural da'wah. However, challenges such as the ideologization of education and the management of pragmatic da'wah still hinder the effectiveness of this movement. Implications: This study emphasizes the importance of developing da'wah more systematically and comprehensively, as well as the integration of education and da'wah to ensure the relevance of Muhammadiyah in social and global dynamics. Novelty: The novelty of this research lies in the analysis of the application of the concepts of al-khair, al-ma'ruf, and al-munkar in Muhammadiyah da'wah which includes spiritual and socio-economic aspects, as well as the identification of challenges in education and pragmatic da'wah management.

Abstract

Latar Belakang: Reaksi pertama orang tua terhadap kelahiran anak disabilitas intelektual dapat berupa kombinasi antara keputusasaan, kehilangan, dan kebencian baik terhadap diri sendiri maupun terhadap keadaan. Artikel ini akan membahas mengenai dampak psikoedukasi keluarga untuk mengurangi stress keluarga yang mendampingi anak dengan retardasi mental. Metode: Tinjauan literatur yang mengacu pada pedoman Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) guideline checklist. Jurnal atau artikel didapatkan dari database yang telah digunakan secara internasionak, seperti: Google Scholar, SagePub, dan PubMed. Artikel yang kami cari membahas mengenai dampak psikoedukasi keluarga untuk mengurangi stress keluarga yang mendampingi anak dengan retardasi mental. Hasil: Kami mendapatkan sebanyak tujuh penelitian yang paling relevan untuk menjawab pertanyaan penelitian ini. Penelitian yang kami dapatkan terkait dengan intervensi perilaku, baik untuk orangtua maupun pengasuh anak. Adapun penelitian yang kami libatkan pada umumnya adalah kohort prospektif, sedangkan untuk uji klinis acak hanya dua penelitian. Intervensi yang dilakukan dikaitkan dengan intervensi keluarga, program instruksional, dan dukungan perilaku pada anak yang terkait dengan interaksi anak terhadap orangtua. Kesimpulan: Mereka yang bergerak di bidang pelayanan kesehatan mental perlu menyadari masalah ini, sehingga skrining dan tatalaksana masalah kesehatan mental yang tepat dapat digunakan untuk pengasuh anak dengan disabilitas intelektual.

Abstract

The purpose of this research is to illustrate the genuine progress of the Islamic movement, which has long disappeared from the vocabulary of modern Muslims. This paper employs a historio-futuristic study, initially touching upon the classical Islamic progress of the Abbasid Caliphate as a mirror of Islamic advancement, which is then converted by drawing the same indicators as a form of real development. Muhammadiyah's commitment and efforts to build a higher quality human civilization clearly have a significant impact, especially in shaping the image of Islam. The accumulation of this movement is manifested in various forms, such as the establishment of thousands of educational institutions, hundreds of clinics and hospitals, thousands of places of worship, and involvement in social activities such as disaster relief and zakat distribution. The exploration of Muhammadiyah's charitable endeavors is demonstrated in a highly universal manner, making it accessible to all people.

Abstract

This research aims to discuss Progressive Islam from Najib Burhani's perspective. The approach in this research is to use a literature study approach with a qualitative method. The results of his research, namely, Najib Burhani includes concepts and thoughts about how Islam can adapt and develop along with changing times. In this perspective, Najib Burhani outlined several main principles that teach Islamic teachings with social, economic and technological progress. He invited Muslims not only to view Islam as a rigid doctrine but also as a dynamic system that is able to provide solutions to various current problems. In this work, Najib Burhani emphasizes the importance of education, intelligence and innovation in creating a progressive Muslim society. He also reviewed the role of religious institutions in ensuring proper understanding of Islamic teachings in a modern context. Thus, it is hoped that "Progressing Islam" can become a guide for Muslims to integrate Islamic values ​​with worldly progress without sacrificing their original teachings and principles.

Abstract

Islamic intelligence in Indonesia has experienced ups and downs, both politically and intellectually. The transformation of Indonesian Islamic Information Services, which were initially marginalized by intellectuals, politics, and bureaucracy in Indonesia, to a central position is one example of the long journey of Islamic Information Services in Indonesia. The emergence of Indonesian intellectuals at the end of the 19th century and the first two decades of the 20th century manifested in several names that continued to evolve, from the birth of figures to the emergence of Bangsawan Oesoel and Kaoem Muda. Kaoem, educated youth, or john. The emergence of the Secret Service was influenced by the ethical revolution in the Dutch East Indies due to the liberal economic crisis in the Dutch East Indies. Additionally, this period was marked by the entry of modernist Islamic reformism, which sought to balance the Western secularism trend. The 20th century witnessed various struggles for recognition and political authority. From the late 20th century to the early 21st century, many changes occurred in the economic and political systems, with successive government changes. This period was also marked by an economic crisis, signaling the beginning of the second economic era after the ethical reforms in the Dutch East Indies. Therefore, it can be said that active participation and power struggles took place among Indonesian Islamic intellectuals. Thus, the formation of Indonesia’s political and bureaucratic elite cannot always be separated from the development and changes in the map of Indonesia’s Islamic intelligence institutions. In fact, they have been at the core of Indonesia’s political elite, from the implementation of Dutch ethical policies to the post-reform regimes.
