Abstract

In classical fiqh studies, scholars agree that having children is a desired outcome of marriage. However, in modern times, the promotion of the childfree lifestyle is increasingly advocated through scientific discourse. The question arises: what factors contribute to childfree becoming a goal of marriage, and what is the contribution of this research to the renewal of contemporary Islamic family law? The purpose of this research is to challenge societal paradigms about childfree and work towards building a new perspective as part of the renewal of contemporary Islamic family law. This research is a field study (field research) in the form of qualitative research with a socio-psychological approach using the iceberg theory. Data was collected through interviews with respondents, specifically from the younger generation. The results of the study indicate that the childfree paradigm exists because it is promoted through mass media, print media, scientific articles, and other scholarly discussions that deliberately instill the idea that childfree is a lifestyle choice. The researcher suggests that education on this matter should be provided by various parties, including religious leaders through organizations, religious counselors, health professionals, as well as psychologists and psychiatrists, to build a perspective that having children is one of the main purposes of marriage.

Abstract

Abstrak Penelitian ini membahas pengembangan pembangunan masjid di luar tanah wakaf di Desa Batang Hari Rawa Pitu dan analisis perspektif Undang-Undang Wakaf No. 41 Tahun 2004 terkait hal tersebut. Masalah utama yang diangkat dalam penelitian ini adalah kurangnya kejelasan status hukum tanah yang digunakan untuk pembangunan masjid, karena tanah tersebut tidak diwakafkan secara sah, sehingga berpotensi menimbulkan masalah hukum di masa depan, baik mengenai hak atas tanah maupun pengelolaannya. Tujuan dari penelitian ini adalah untuk mengetahui pengembangan pembangunan masjid di luar tanah wakaf di Desa Batang Hari, Kecamatan Rawa Pitu, serta menganalisisnya dari perspektif hukum yang diatur dalam Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan wawancara mendalam kepada pihak-pihak terkait, yaitu Wakif (pemberi tanah) dan Nadzir (pengelola wakaf), serta kajian dokumen hukum terkait peraturan wakaf di Indonesia. Hasil penelitian menunjukkan bahwa meskipun pembangunan masjid memiliki dampak positif dalam hal sosial dan keagamaan, pengelolaan tanah yang digunakan tidak sesuai dengan ketentuan hukum wakaf yang berlaku, sehingga dapat berisiko menimbulkan permasalahan hukum di kemudian hari. Penelitian ini menyarankan agar ada kepastian hukum mengenai status tanah dan pengelolaan masjid sesuai dengan Undang-Undang Wakaf No. 41 Tahun 2004 untuk memastikan keberlanjutan dan keberhasilan pengelolaan wakaf. Kata Kunci: Pembangunan Masjid, Tanah Wakaf, Undang-Undang Wakaf No. 41 Tahun 2004, Pengelolaan Wakaf, Masalah Hukum.   Abstract This study discusses the development of a mosque outside of waqf land in Batang Hari Rawa Pitu Village and analyzes the perspective of Law No. 41/2004 on Waqf in relation to the issue. The primary problem addressed in this research is the lack of legal clarity regarding the land used for mosque construction, as the land has not been officially endowed as waqf, which could potentially lead to legal issues in the future concerning land rights and management. The purpose of this research is to analyze the legal, social, and administrative aspects related to mosque development outside of waqf land, as well as the legal perspective outlined in Law No. 41/2004 on Waqf. The research uses a qualitative approach with in-depth interviews with relevant parties, including the waqf donor (Wakif) and the waqf manager (Nazir), as well as document analysis of relevant legal regulations on waqf in Indonesia. The findings indicate that although the mosque development has positive social and religious impacts, the land used for the mosque does not comply with the waqf law, which could lead to legal issues in the future. The study suggests that there should be legal certainty regarding the status of the land and the management of the mosque in accordance with Law No. 41/2004 on Waqf to ensure the sustainability and success of waqf management.
