Abstract

Personal data protection is a crucial issue in the digital era, which is characterized by the processing and widespread dissemination of information on the internet. In this context, the different legal approaches between Indonesia and the United States raise questions regarding the effectiveness and scope of privacy protection in each country. The focus of this research is to analyze the legal systems applicable in both countries to identify the strengths, weaknesses, and potential for cross-system policy adoption. Using a normative juridical method and a comparative law approach, analysis is conducted on key regulations such as Law No. 27 of 2022 in Indonesia as well as various sectoral regulations in the United States. The findings show that Indonesia has integrated regulations but faces challenges in implementation, while the United States has more established enforcement despite its sectoral and fragmented nature. The synthesis of these two approaches emphasizes the importance of finding a balance between regulatory comprehensiveness and enforcement effectiveness. In conclusion, efforts to strengthen personal data protection in Indonesia can be directed towards strengthening institutions and oversight, while the United States can draw lessons from its centralized regulatory model to improve consistency of protection across sectors.

Abstract

This study aims to analyze the forms of human rights violations in the case of Wadas Village and evaluate the state's responsibility based on Law Number 39 of 1999 concerning Human Rights. The focus of the study includes the right to security, land ownership, freedom of expression, and community participation in national strategic development projects. The approach used is qualitative, juridical-sociological, with secondary data collection from legal documents, official reports, journal publications, and media reports. The analysis was conducted using descriptive-thematic and deductive-inductive methods. The findings revealed clear violations, including arrests without warrants, restrictions on citizen participation, and non-compliance with legal procedures by officials. These results emphasize the importance of human rights-based due diligence mechanisms and active community involvement to ensure equitable development.

Abstract

Wacana pembentukan Daerah Istimewa Surakarta (DIS) kembali mencuat dalam diskursus hukum tata negara dan keadilan sosial. Berbeda dengan Daerah Istimewa Yogyakarta yang telah memperoleh legitimasi hukum, Surakarta masih menghadapi ketidakpastian status hukum meski memiliki warisan sejarah yang kuat. Penelitian ini bertujuan mengkaji secara kritis konsep keistimewaan DIS dari perspektif hukum dan filsafat hukum, serta menelaah respons masyarakat terhadapnya. Metode yang digunakan adalah pendekatan kualitatif deskriptif dengan teknik wawancara semi-terstruktur terhadap sepuluh responden dari berbagai kecamatan di Kota Surakarta. Hasil penelitian menunjukkan bahwa mayoritas responden menolak wacana DIS karena dinilai tidak demokratis, cenderung memperkuat dominasi elite lokal, serta minimnya partisipasi publik. Hanya dua responden mendukung, itupun dengan syarat bahwa proses keistimewaan harus transparan, akuntabel, dan partisipatif. Penolakan masyarakat bukan sekadar reaksi emosional, melainkan didasarkan pada pertimbangan rasional tentang keadilan sosial dan relevansi kebijakan terhadap kesejahteraan. Temuan ini menegaskan pentingnya pendekatan partisipatif dalam perumusan kebijakan keistimewaan, agar tidak menjadi instrumen elitis yang bertentangan dengan prinsip demokrasi substantif. Ke depan, pemerintah perlu membuka ruang dialog publik yang inklusif dan mempertimbangkan dimensi historis, legal, serta sosiologis secara seimbang. Penelitian ini diharapkan dapat menjadi kontribusi evaluatif dalam merumuskan kebijakan yang lebih adil dan demokratis terkait keistimewaan daerah.
