Abstract

This study aims to determine the legal implications of the Constitutional Court Decision Number 46/PUU-VIII/2010 on the inheritance rights of illegitimate children. In the Indonesian legal system, referring to Law Number 1 of 1974 concerning Marriage, it states that illegitimate children only have a civil relationship with their mother, so they are not entitled to inheritance from their father. However, the Constitutional Court's decision changed this paradigm by recognizing the civil relationship of illegitimate children with their biological father if it can be proven scientifically and technologically, such as through DNA testing. This study uses a normative legal research method with primary and secondary legal materials. The results of the study indicate that the legal implications of the Constitutional Court's Decision provide fairer and more equal legal protection for illegitimate children in obtaining recognition of inheritance rights from their father which can be proven scientifically from the science and technology recognized by applicable law.

Abstract

As a developing country, particularly in the fields of science and technology, it is undeniable that the existence of information technology, in this case various electronic media, has become the basis for people to conduct various transactions in order to fulfill all basic needs and certain desires, such as purchasing equipment and even vehicles. In Indonesia, there are various regulations governing transactions carried out electronically, although some of them do not directly regulate the implementation of electronic transactions.

Abstract

Drug abuse has become a national problem that has spread to rural areas, including Setanggor Village, West Praya District, Central Lombok Regency, which has experienced an increase in drug cases. The low level of legal literacy among rural communities is a major factor that exacerbates this problem, where many people do not yet understand the provisions of Law No. 35 of 2009 on Narcotics along with its criminal sanctions. Community service activities in the form of legal socialization were carried out on August 25, 2025 using lecture methods and interactive discussions with the community and village officials. This program successfully increased public understanding of the definition of narcotics, classification of groups, health impacts, and legal consequences that users and dealers can receive. The enthusiasm of participants was evident from active participation in question and answer sessions, demonstrating the effectiveness of the program in increasing public legal awareness about the dangers of narcotics and the importance of early prevention.

Abstract

Kitab Undang-Undang Hukum Pidana (KUHP) di Indonesia saat ini masih menggunakan warisan hukum kolonial Belanda yang tidak sepenuhnya sesuai dengan nilai dan falsafah bangsa Indonesia. Pembaharuan KUHP telah dilakukan dan KUHP Nasional baru resmi diberlakukan pada tahun 2026. Dalam konteks tindak pidana keamanan negara, KUHP lama membedakan antara makar dan pemberontakan, sedangkan KUHP baru mengintegrasikan pemberontakan ke dalam tindak pidana makar. Studi ini membandingkan pengaturan makar dan pemberontakan antara KUHP lama dan KUHP baru, menganalisis pergeseran konsep dan unsur, serta implikasinya terhadap ketentuan hukum, termasuk pengaturan niat dan tindakan kolektif. Penelitian normatif komparatif ini juga mencermati dampak pembaruan KUHP terhadap perlindungan hak asasi dan demokrasi. Hasil analisis menunjukkan KUHP baru membawa penegasan dan modernisasi konseptual makar sebagai kejahatan politik dan tindak pidana terhadap kedaulatan negara, sekaligus menimbulkan tantangan terkait kepastian hukum dan kebebasan berekspresi.
