Abstract

This research discusses the importance of strengthening regulatory oversight of grant funds in the private sector to prevent misuse and increase accountability. The background to the problem includes the increasing allocation of grant funds to private institutions and current challenges in supervision. The method used in this discussion includes normative analysis of Law no. 17 of 2003 as well as case studies that show weaknesses in existing supervision and sanctions. The results of the analysis show that regulatory revisions are needed to establish stricter audit standards, increase reporting obligations, and strengthen legal sanctions for violators. The conclusion of this research confirms that by strengthening regulations, it is hoped that the management of grant funds by private institutions can be carried out in a more transparent and accountable manner, thereby increasing public trust in the use of these funds.

Abstract

This study is a normative investigation that seeks to evaluate the review process associated with the allocation of HGU on HPL land. This regulation stands in contradiction to the UUPA, which stipulates that HGU should only be assigned on state-owned land; however, the legitimacy of the recent regulations offers a pathway for granting HGU on HPL territory. Additionally, this paper employs both the statutory approach and the conceptual approach. Legally speaking, the UUPA does not recognize HPL as a "land right," but rather designates it as "management." HPL emerged as one of the land rights through the Agrarian Ministerial Regulation No. 9 of 1965 and has evolved to the present as outlined in PP 18 of 2021. Perspectives regarding the definition of "management" differ. The UUPA defines "management" as authority, whereas PP 18 of 2021 interprets "management" as a form of land right. Moreover, concerning the HGU concept addressed in Article 28 of the UUPA, the land allocation must originate from the state's direct control, rather than from land that has been utilized by the holder of the HPL certificate for agricultural, fishery, or livestock purposes. This discrepancy clearly indicates conflicting norms, resulting in legal ambiguity and a possibility for judicial review.

Abstract

This study explores the legal provisions concerning the waiting period (iddah) for men using A Contrario reasoning within Indonesia’s positive law framework. Adopting a normative legal research approach, the study finds that Indonesian positive law, particularly Law Number 1 of 1974 on Marriage jo Law Number 16 of 2019 and Government Regulation Number 9 of 1975, explicitly regulates iddah only for women following divorce or the death of a spouse. In contrast, no legal requirement mandates men to undergo a waiting period before remarrying. Applying the Argumentum A Contrario method, which derives legal interpretation by considering the inverse of existing provisions, the study concludes that since the law exclusively prescribes iddah for women, men are not legally required to observe a waiting period.

Abstract

This research investigates whether the ban on absentee land ownership retains its significance in today's context. The goal is to provide an updated perspective on the prohibition of absentee ownership of agricultural land in Indonesia. This investigation is normative, supported by empirical evidence, and employs both a statutory and a conceptual framework throughout the paper. The findings yield the following conclusions: initially, the underlying rationale for banning absentee land ownership is to ensure that agricultural land is actively cultivated and managed by its rightful owner for optimal yield. This emphasizes the principle that agricultural land should be actively utilized by its owner, as outlined in Article 10 of the UUPA. There is a necessity for oversight and preventive actions, such as rejecting registration applications, enforced by the district or city land office, to halt the ongoing issue of absentee land registration. Secondly, the importance of the absentee land ownership prohibition in Indonesia has diminished in light of contemporary realities, as the legislative framework established sixty years ago is no longer aligned with present-day societal conditions. The regulations regarding absentee land ownership require modernization; previously, ownership of agricultural land was restricted to the sub-district level, which should be revised or replaced by new laws allowing agricultural land ownership at the district or city level. This transformation would enable the new regulations to respond to the evolving landscape and address the increasingly complex challenges that arise.

Abstract

Perkawinan anak usia dini masih menjadi fenomena serius di Indonesia. Praktik ini dipengaruhi faktor sosial, ekonomi, pendidikan, serta anggapan keliru bahwa perkawinan dini dapat “mengubah nasib”. Mengingat, dampaknya sangat merugikan, maka kegiatan pengabdian masyarakat yang dilaksanakan di SMPN 3 Labuhan Haji, Desa Korleko Selatan, Lombok Timur, dengan meberikan penyuluhan hukun bertujuan memberikan edukasi mengenai batas minimal usia kawin dan bahaya perkawinan dini. Metode yang digunakan meliputi ceramah, diskusi interaktif, konsultasi, dan evaluasi (pre-test dan post-test). Kegiatan ini diikuti oleh 60 siswa siswi yang di SMPN 3 Labuhan Haji dengan hasil menujkan bahwa penyuluhan hukum dilaksanakan dengan efektif terlihat bahwa adanya peningkatan pengetahuan dari perkawinan dini dan implikasinya. Tindak lanjut dari penyuluhan hukum ini merupakan kegiatan pendampingan dengan tujuan untuk mencegah terjadinya perkawinan usia dini yang terjadi pada siswa siswi pada SMPN 3 Labuhan Haji serta merubah paradigma bahwa perkawinan anak usia dini (perkawinan anak) bukan solusi untuk mengubah nasib.

Abstract

Fenomena di masyarakat Lombok Barat sebanyak 143.000 bidang tanah belum bersertipikat terlebih di Desa Perampuan terdata sampai saat ini sebanyak 500 bidang tanah yang belum bersertipikat. Pasca berlakunya PP 18 Tahun 2021 membawa implikasi besar terhadap kedudukan tanah yang belum bersertipikat, terutama dalam konteks kepastian hukum dan perlindungan hak atas tanah masyarakat tidak dapat terpenuhi. Metode yang digunakan ceramah, diskusi, konsultasi dan kuesioner.Penyuluhan hukum yang dilaksanakan guna memberikan pemahaman pentingnya pendaftaran hak atas tanah dengan produk sertipikat guna memberikan perlindungan hukum, kepastian, dan keadilan bagi masyarakat. Dalam Penyuluhan melibatkan 125 masyarakat. Hasil yang diperoleh dalam hal ini peningkatan pemehaman masyarakat akan pentingnya legalitas kepemilikan tanah dan menyelesaikan 1 dari 4 sengketa yang sedang terjadi di Desa Perampuan. Selanjutnya pemerintah desa mendata tanah belum bersertipikat dan berkoordinasi dengan BPN Lombok Barat sebagai pelaksana utama. Diperlukan juga kolaborasi dan penyuluhan hukum berkelanjutan agar pelaksanaan PTSL efektif, transparan, dan adil.

Abstract

This study aims to analyze the effectiveness of legal education activities titled Land Administration Digitalization: Digital-Based Land Registration to Realize Legal Certainty conducted in Penujak Village, Praya Barat District, Central Lombok Regency. The program was motivated by the low level of legal awareness and community readiness toward the national policy of land digitalization and the implementation of the Systematic Land Registration Program (PTSL). The research employed a Participatory Action Research (PAR) approach, emphasizing active involvement of local communities and village government in problem identification, legal counseling, and evaluation. The results indicate a significant increase in community understanding regarding the urgency of land registration, the concept of land digitalization, and readiness to participate in the PTSL program. Before the intervention, only about 20% of participants understood the importance of land registration, which rose to 80% afterward, while digital literacy increased from 10% to 70%. Theoretically, these findings support theory of legal awareness, asserting that knowledge and active participation are essential for strengthening legal compliance. This study concludes that participatory legal education effectively bridges national policy and local social realities. Practically, it enhances rural community readiness in supporting digital land certificate policies, while theoretically, it contributes to the discourse on integrating community legal awareness with digital transformation in the agrarian sector. ABSTRAKPenelitian ini bertujuan untuk menganalisis efektivitas penyuluhan hukum bertema Digitalisasi Administrasi Pertanahan: Pendaftaran Tanah Berbasis Digital dalam Rangka Mewujudkan Kepastian Hukum di Desa Penujak, Kecamatan Praya Barat, Kabupaten Lombok Tengah. Kegiatan ini dilatarbelakangi oleh rendahnya kesadaran hukum dan kesiapan masyarakat terhadap kebijakan nasional digitalisasi pertanahan serta implementasi Program Pendaftaran Tanah Sistematis Lengkap (PTSL). Metode yang digunakan adalah Participatory Action Research (PAR), yang menekankan keterlibatan aktif masyarakat dan pemerintah desa dalam proses identifikasi masalah, pelaksanaan penyuluhan, serta evaluasi hasil. Hasil penelitian menunjukkan peningkatan signifikan terhadap tingkat pemahaman masyarakat mengenai urgensi pendaftaran tanah, konsep digitalisasi pertanahan, dan kesiapan berpartisipasi dalam program PTSL. Sebelum kegiatan dilaksanakan, hanya sekitar 20% masyarakat memahami pentingnya pendaftaran tanah, sedangkan setelah kegiatan meningkat hingga 80%. Selain itu, literasi digital masyarakat juga meningkat dari 10% menjadi 70%. Secara teoritis, temuan ini memperkuat teori kesadaran hukum yang menekankan bahwa pengetahuan dan partisipasi aktif masyarakat merupakan kunci peningkatan kepatuhan terhadap hukum. Penelitian ini menyimpulkan bahwa penyuluhan hukum partisipatif berperan penting dalam menjembatani kebijakan nasional dengan realitas sosial di tingkat lokal. Secara praktis, kegiatan ini berimplikasi pada meningkatnya kesiapan masyarakat desa dalam mendukung kebijakan sertipikat tanah digital, sementara secara teoritis, hasilnya memperluas pemahaman tentang integrasi antara kesadaran hukum dan transformasi digital di bidang agraria.

Abstract

The phenomenon of early marriage in West Lombok Regency remains a complex social issue influenced by social, economic, and educational factors. This study aims to enhance community legal awareness through a legal outreach program entitled “Family Law Series: Protection of Women Against Early Marriage and Implications for Property After Divorce.” The research employed a Participatory Action Research (PAR) approach, emphasizing community participation in identifying problems, implementing activities, and evaluating outcomes. The findings indicate that the legal counseling significantly improved public understanding of the legal age of marriage, the negative impacts of child marriage, and women’s rights to joint property after divorce. Based on the achievement indicators, the community’s legal awareness increased by more than 50% on average after the intervention. Theoretically, these results reinforce Legal Awareness Theory, which posits that understanding, habituation, and active social participation can cultivate lawful behavior within society. Additionally, this study supports Gender Equality Theory, emphasizing that the relationship between men and women must be founded on justice and balanced rights. Practically, this program demonstrates the effectiveness of community-based legal outreach in fostering gender-equitable legal awareness and strengthening women’s protection within family law. It serves as a sustainable model for community legal empowerment aimed at reducing early marriage rates and promoting family resilience based on justice and gender equality. ABSTRAKFenomena perkawinan dini di Kabupaten Lombok Barat masih menjadi persoalan sosial yang kompleks, dipengaruhi oleh faktor sosial, ekonomi, dan pendidikan. Penelitian ini bertujuan untuk meningkatkan kesadaran hukum masyarakat melalui kegiatan penyuluhan hukum bertema “Serial Hukum Keluarga: Perlindungan Perempuan terhadap Perkawinan Dini dan Implikasi Harta Kekayaan Pasca Perceraian.” Metode yang digunakan adalah Participatory Action Research (PAR), yang menekankan partisipasi aktif masyarakat dalam proses identifikasi masalah, pelaksanaan kegiatan, dan evaluasi hasil. Hasil penelitian menunjukkan bahwa penyuluhan hukum secara signifikan meningkatkan pemahaman masyarakat mengenai batas usia perkawinan, dampak negatif perkawinan anak, serta hak perempuan terhadap harta bersama pasca perceraian. Berdasarkan indikator capaian, tingkat pengetahuan masyarakat meningkat rata-rata di atas 50% setelah kegiatan berlangsung. Secara teoritis, hasil ini memperkuat teori kesadaran hukum yang menjelaskan bahwa pemahaman dan pembiasaan hukum melalui partisipasi sosial dapat menumbuhkan perilaku hukum yang taat aturan. Selain itu, penelitian ini juga memperkuat teori kesetaraan gender bahwa hubungan laki-laki dan perempuan harus dibangun atas prinsip keadilan dan keseimbangan hak. Secara praktis, kegiatan ini membuktikan efektivitas penyuluhan hukum berbasis komunitas dalam membentuk kesadaran hukum yang berkeadilan gender serta memperkuat perlindungan perempuan di ranah keluarga. Program semacam ini diharapkan menjadi model pemberdayaan hukum masyarakat yang berkelanjutan guna menekan angka perkawinan anak dan memperkuat ketahanan keluarga berbasis keadilan sosial dan kesetaraan gender.

Abstract

Drug abuse has become a national problem that has spread to rural areas, including Setanggor Village, West Praya District, Central Lombok Regency, which has experienced an increase in drug cases. The low level of legal literacy among rural communities is a major factor that exacerbates this problem, where many people do not yet understand the provisions of Law No. 35 of 2009 on Narcotics along with its criminal sanctions. Community service activities in the form of legal socialization were carried out on August 25, 2025 using lecture methods and interactive discussions with the community and village officials. This program successfully increased public understanding of the definition of narcotics, classification of groups, health impacts, and legal consequences that users and dealers can receive. The enthusiasm of participants was evident from active participation in question and answer sessions, demonstrating the effectiveness of the program in increasing public legal awareness about the dangers of narcotics and the importance of early prevention.

Abstract

Land acquisition for public interest constitutes a fundamental aspect of national development; however, it frequently generates conflicts owing to the tension between development objectives and the protection of community rights. Prior to the enactment of Law Number 11 of 2020 on Job Creation, the legal framework governing land acquisition was regulated by Law Number 2 of 2012, which, despite providing a comprehensive statutory basis, continued to face obstacles, including lengthy procedures, high costs, and dissatisfaction with the compensation determination process. The enactment of the Job Creation Law introduced significant changes through the simplification of procedures, expansion of the definition of public interest, strengthening of institutional mechanisms, digitization of processes, and introduction of the land bank concept. This new regulation aims to accelerate infrastructure development while safeguarding community rights through more flexible compensation mechanisms and effective dispute resolution processes. However, these reforms raise concerns about a potential reduction in protection for vulnerable groups due to procedural acceleration. This study employs a normative and conceptual approach, drawing on statutory analysis and legal doctrine to assess the implications of the new regulatory framework. The findings indicate that although the Job Creation Law enhances the efficiency of land acquisition, the success of its implementation ultimately depends on the quality of on-the-ground execution, strict oversight, and the active participation of affected communities in the decision-making process.
