Abstract

Positive law in Indonesia has recognized the importance of child protection, both as citizens and minors. However, in practice there are still conflicts regarding the balance between law enforcement and the protection of children's rights. Therefore, the purpose of this study is to understand and analyze the effect of positive law on children as innocent victims in Indonesian law. The research method used is normative qualitative research with a focus on legislation. The research findings show that (a) the protection and enforcement of child protection law in Indonesia is specifically outlined in the Child Criminal Justice System (SPPA) (Law Number 11 of 2012). In terms of child punishment, diversion and restorative justice are important alternatives in resolving children's cases; (b) children who commit criminal offenses are still subject to sanctions even with special considerations, in accordance with the provisions of Law Number 3 of 1997 and the SPPA Law. The sanctions can be in the form of actions or criminal sanctions, with an emphasis on rehabilitation and education.

Abstract

Tindak pidana pencurian ringan seringkali diselesaikan melalui pemidanaan formal yang berorientasi retributif, padahal masyarakat memiliki mekanisme hukum adat yang mengedepankan keadilan restoratif. Penelitian ini bertujuan untuk menganalisis penerapan sanksi adat Melayu Bengkulu dalam penyelesaian tindak pidana pencurian ringan di Kecamatan Teluk Segara, Kota Bengkulu, serta mengidentifikasi hambatan dalam implementasinya. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan socio-legal. Data dikumpulkan melalui wawancara dan studi kepustakaan, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa sanksi adat Melayu Bengkulu masih diterapkan dan dipercaya oleh masyarakat. Bentuk sanksinya meliputi ganti rugi materiil, arak-arakan adat, serta penyediaan nasi kunyit untuk memulihkan keharmonisan sosial. Namun, pelaksanaannya menghadapi hambatan berupa sulitnya mencapai kesepakatan ganti rugi, penolakan sepihak dari korban yang dapat berujung pada sanksi pengucilan sosial, ketidakpatuhan pelaku terhadap putusan adat, serta menurunnya pemahaman generasi muda terhadap nilai-nilai adat. Disimpulkan bahwa hukum adat Melayu Bengkulu masih sangat relevan sebagai alternatif penyelesaian perkara, namun memerlukan upaya pelestarian dan harmonisasi yang lebih terstruktur dengan sistem hukum nasional.

Abstract

The development of artificial intelligence technology, particularly deepfake, has transformed the landscape of digital crime because its impact not only harms individuals but also has the potential to disrupt social, political, and international security stability. However, legal regulations that explicitly govern the misuse of deepfake within the framework of international criminal law are still unavailable. This study aims to analyze legal regulation of deepfake from the perspective of international criminal law and to examine the urgency of its criminalization as a new form of international crime. This study used a normative legal method with a statute approach and a conceptual approach. The legal materials used included primary legal materials in the form of international legal instruments and secondary legal materials in the form of books, journals, and relevant scientific literature. The results showed that legal regulation of deepfake in international criminal law remains indirect and has not provided adequate legal certainty. Deepfake has not yet been recognized as a stand-alone international crime but is still positioned as a means of committing other crimes. This normative gap creates various problems, including difficulties in law enforcement, jurisdictional conflicts, and challenges in proving and attributing perpetrators. The findings of this study confirm that the criminalization of deepfake as a new international crime needs to be considered because of its broad impact on human rights, social stability, and international security. Deepfake meets the criteria as an emerging international crime because it causes significant harm, violates universal values, and requires international cooperation in its handling. Thus, reform of international criminal law that is adaptive to developments in digital technology is needed through the formulation of a specific legal instrument on deepfake to provide legal certainty and effective protection for the international community.
