Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Teori Hukum Murni yang dikembangkan oleh Hans Kelsen baik dari aspek kelebihan maupun kelemahannya. Selain itu, menganalisis sejauh mana teori tersebut relevan dan aplikatif dalam konteks hukum kontemporer. Metode penelitian yang digunakan adalah metode normative dengan pendekatan konseptual untuk memahami secara mendalam konsep-konsep dasar dari Teori Hukum Murni. Penelitian ini berbasis data sekunder yang bersumber dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang bersumber dari studi kepustakaan dan dokumentasi. Analisis data yang digunakan yaitu analisis kualitatif deskriptif.  Berdasarkan hasil penelitian bahwa teori yang dirumuskan oleh Hans Kelsen merupakan pondasi yang penting bagi disiplin ilmu, dengan menekankan bahwa hukum harus dipahami sebagai sistem normatif yang otonom, terlepas dari pengaruh nilai-nilai moral, sosial, dan politik. Namun, dinamika sosial yang terus berubah, seperti globalisasi, perkembangan teknologi digital, dan krisis lingkungan, Teori Hukum Murni menghadapi tantangan besar karena sifatnya yang kaku dan terbatas dalam merespons kompleksitas isu lintas batas. Sementara teori ini tetap penting sebagai landasan yang menjamin obyektivitas hukum, ketidakmampuannya dalam merangkul dinamika sosial menunjukkan bahwa hukum membutuhkan pendekatan yang lebih fleksibel dan adaptif.

Abstract

Zakat is the obligation of every Muslim who fulfills the conditions to give a portion of his income or wealth to those who are entitled, according to the provisions of Islamic law. In conducting this research, the authors used a normative approach, namely an approach based on the verses of the Qur'an and Hadith as well as the opinions of the scholars regarding the principles of Fiqhiyah Ma'nawiyah, namely understanding plural texts through the skills of their meanings and using the approach socio-historical through studying the background of the life of the character discussed in this case is Yusuf Qardhawi. The technology for tracking legal materials is based on literature studies. The data analysis method used in making this work is logical thinking. The search results show that Yusuf Qardhawi asked that a muzak be given a sanction for not paying zakat, so a warning must be given. When warning after warning failed, he had to be delivered into the hands of the authorities with a lawful whip so that he could do his job. The Istinbath-Muzak that Yusuf Qardhawi legally uses for the obligation to pay zakat is the use of Ijtihad Tarjih. Yusuf Qardhawi's reason for imposing sanctions on muzakki who do not pay zakat is that zakat is one of the main taxes in Islam. A philanthropist Muslim who is required by applicable law to spend Zakat from his wealth for the benefit of the people.

Abstract

The theory of Social Engineering is a legal theory that views law as a tool for social engineering. However, the concept of Social Engineering in the context of legal development in Indonesia faces gaps in its implementation, often clashing with social, economic, political, and cultural realities. This research aims to analyze the concept of Social Engineering, as proposed by Roscoe Pound, within the framework of modern law. It also seeks to evaluate the relevance of this theory to legal development in Indonesia. This study adopts a normative juridical method with a conceptual approach. The data used is secondary in nature, derived from primary, secondary, and tertiary legal sources. Data collection is conducted through a literature review, while data analysis is performed qualitatively. Roscoe Pound's Social Engineering theory views law as a tool to create a balance of interests within society, aiming to meet its ever-evolving needs. In a modern context, this theory aligns with an approach that considers the impact of legal policies on social welfare. In Indonesia, the application of this theory is evident in legal reforms focused on social justice and public welfare. However, challenges such as weak law enforcement and discrepancies between policies and social realities need to be addressed in order to achieve effective legal development.
