Abstract

This study aims to examine the practice of two marriage contracts for illegitimate daughters in Deli Serdang Regency from the perspective of mashlahah. This study uses a qualitative approach with a descriptive analytical method through interviews, observations, and documentation. The study results indicate that the first contract carried out by the guardian judge is legally valid under Islamic law because it fulfills the pillars and requirements of marriage. In contrast, the second contract carried out by the biological father is only symbolic and has no legal force. Implementing the second contract is intended to maintain the honor of the family and cover up past disgrace, so it is seen as a form of mashlahah mursalah that is tolerated as long as it does not conflict with the basic principles of sharia. Therefore, this phenomenon reflects a social need that demands a wise, contextual, and community-oriented Islamic legal approach

Abstract

Munasabah Al-Qur’an merupakan salah satu cabang dari ilmu-ilmu Al-Qur’an yang mengkaji korelasi susunan ayat dan surat dalam Al-Qur’an. Keberadaanya sangat penting dan dibutuhkan dalam penafsiran sehingga para mufassir sangat perlu untuk mendalami ini. Dianggap penting dan sangat dibutuhkan keberadaannya sebab memiliki peran penting dalam mengungkap aspek kemukzijatan Al-Qur’an. Selain itu, juga dapat membantu dalam memahami inti persoalan dalam sebuah ayat atau sebuah surat. Hal tersebut mendapatkan beragam respon dari para ulama akan ketertarikan mereka dengan ilmu munasabah Al-Qur’an. Tercatat banyak ulama yang berpartisipasi menuangkan perhatian dan pemikirannya terhadap ilmu munasabah al-Qur’an. Maka, sangat penting bagi tiap intelektual dan akademisi yang ingin berkonsentrasi dalam keilmuan Al-Qur’an mempelajari dan mendalami ilmu munasabah Al-Qur’an. Penelitian ini mengambil pendekatan studi pustaka untuk menganalisis berbagai perspektif ulama terkemuka mengenai bagaimana mereka memahami dan menerapkan konsep tersebut dalam Al-Qur'an. Artikel ini menjelaskan metode penelitian yang digunakan dan menguraikan hasil analisis konten dari karya-karya tulis ulama terkait. Temuan dari penelitian ini memberikan wawasan mendalam tentang pentingnya dan penerapan prinsip korelasi munasabah sebagai alat utama dalam memahami Al-Qur'an secara komprehensif dan kontekstual.
