Abstract

This article aims to analyze the ideal construction of criminal liability for corporations responsible for violations of goods transportation with over-dimensional and overloading (ODOL) specifications. The problem is focused on the lack of effective legal framework and enforcement mechanisms to address corporate responsibility in ODOL vehicle violations that contribute to traffic accidents, road damage, and safety hazards. In order to approach this problem, a theoretical reference of corporate criminal liability and transportation law enforcement is used. The data is collected through legal research methodology including statute analysis, case studies, and regulatory examination, and analyzed qualitatively through normative legal analysis. This study concludes that an ideal construction of corporate criminal liability requires comprehensive regulations with firm government commitment, active participation from vehicle-owning companies, and strict sanctions targeting not only drivers but also their superiors and companies that order ODOL transportation, as well as vehicle owners, to create effective deterrent effects and maximize law enforcement in controlling over-dimensional and overloaded vehicles while addressing resulting problems such as traffic congestion, road infrastructure damage, and traffic accidents that may cause injuries or fatalities.

Abstract

Jalan berlubang pada musim hujan merupakan hazard keselamatan yang signifikan karena meningkatkan risiko kecelakaan lalu lintas sekaligus menimbulkan persoalan pertanggungjawaban hukum penyelenggara jalan. Penelitian ini bertujuan untuk menganalisis pertanggungjawaban hukum berbasis kerangka kausalitas (duty–breach–causation–damage) serta mengevaluasi efektivitas biaya intervensi keselamatan menggunakan pendekatan Incremental Cost-Effectiveness Ratio (ICER). Metode yang digunakan adalah mixed-methods dengan desain sekuensial terintegrasi, meliputi pemodelan multilevel (kejadian–segmen–wilayah/musim), Difference-in-Differences (DiD), dan analisis yuridis empiris. Hasil penelitian menunjukkan bahwa kecelakaan bersifat multikausal akibat interaksi faktor infrastruktur, perilaku pengemudi, dan lingkungan. Model multilevel mengidentifikasi bahwa segmen jalan berisiko tinggi dipengaruhi oleh kombinasi potholes dan curah hujan, sementara faktor perilaku memperkuat tingkat keparahan kecelakaan. Analisis cost-effectiveness menunjukkan bahwa intervensi terpadu (respons cepat, perbaikan infrastruktur, dan penegakan hukum) merupakan pilihan paling efisien, terutama dalam skenario sensitivitas musim hujan. Kesimpulan penelitian menegaskan bahwa pertanggungjawaban hukum perlu didistribusikan secara proporsional berdasarkan kontribusi kausal masing-masing pihak. Rekomendasi kebijakan meliputi penguatan respons cepat, peningkatan infrastruktur berbasis risiko, serta penegakan hukum adaptif. Implikasi penelitian menunjukkan bahwa integrasi analisis kausal multilevel, evaluasi ICER, dan pendekatan hukum dapat memperkuat kebijakan keselamatan jalan berbasis bukti dan meningkatkan akuntabilitas pengelolaan infrastruktur publik.
