Abstract

Penelitian ini mengkaji legalitas kendaraan bermotor roda tiga sebagai angkutan penumpang dan barang berdasarkan hukum normatif di Indonesia. Metode penelitian yang digunakan adalah hukum normatif atau doktrinal. Hasil penelitian ini menunjukkan kendaraan bermotor roda tiga sebagai angkutan penumpang diatur dalam PM 177 Tahun 2018 Pasal 33 yang menyatakan penggunaan angkutan roda tiga hanya pada kawasan tertentu. Penggunaan kendaraan roda tiga sebagai angkutan barang dilakukan pada kondisi tertentu yang dijelaskan dalam PP 60 Tahun 2019. Berdasarkan fenomena yang terjadi di lapangan menunjukkan pelanggaran dari segi spek teknis kendaraan dan penggunaan kendaraan roda tiga yang tidak sesuai dengan kegunaan. Penelitian ini direkomendasikan sebagai kajian hukum dalam penggunaan kendaraan bermotor roda tiga sebagai angkutan penumpang dan angkutan barang di Indonesia.

Abstract

This research aims to make a decision study of criminal liability of road-based mass transport drivers in special bus lanes. The research method used is normative juridical. This result of the research shows that drivers of road-based mass transportation buses who enter special bus lanes should not be punished if someone breaks through the special bus lane which results in an accident and the victim dies. This is based on legal experience, namely on court decisions based on articles relating to road user negligence. The decision made by the judge in the case of death due to someone breaking into a special bus lane exampale in case Decision Number 1086 K/PID/2016 and others is not commensurate with the driver's fault because the incident occurred due to the fault of the perpetrator or the victim themselves. This decision also cannot apply to mass transit bus drivers because basically it is necessary to pay more in-depth attention to causal factors, as well as Victim Precipitation conditions which are the initial causes of accidents in special bus lanes. This research is a form of proposed change in Law No. 22 of 2009 concerning Traffic and Road Transportation.

Abstract

The seminar “Generation Z's Concern for Mental Health as the Key to Success in Facing the World of Work in the Era of Revolution 4.0” was held at STIE Ekadharma Indonesia with the aim of increasing awareness and understanding of generation Z regarding the importance of mental health in the world of work. This activity was attended by 36 participants from the SMA / SMK level and the general public. Through the presentation of material by resource persons, participants were given insights on how to maintain mental health and strategies to deal with pressure in the world of work. The seminar evaluation results showed a significant increase in participants' understanding of mental health. Indicators of pre-test and post-test results recorded an average increase in the level of understanding of participants by 82.25%. This increase reflects the effectiveness of the seminar in delivering information and equipping participants with the necessary knowledge to face challenges in the Revolution 4.0 era.

Abstract

This article aims to analyze the ideal construction of criminal liability for corporations responsible for violations of goods transportation with over-dimensional and overloading (ODOL) specifications. The problem is focused on the lack of effective legal framework and enforcement mechanisms to address corporate responsibility in ODOL vehicle violations that contribute to traffic accidents, road damage, and safety hazards. In order to approach this problem, a theoretical reference of corporate criminal liability and transportation law enforcement is used. The data is collected through legal research methodology including statute analysis, case studies, and regulatory examination, and analyzed qualitatively through normative legal analysis. This study concludes that an ideal construction of corporate criminal liability requires comprehensive regulations with firm government commitment, active participation from vehicle-owning companies, and strict sanctions targeting not only drivers but also their superiors and companies that order ODOL transportation, as well as vehicle owners, to create effective deterrent effects and maximize law enforcement in controlling over-dimensional and overloaded vehicles while addressing resulting problems such as traffic congestion, road infrastructure damage, and traffic accidents that may cause injuries or fatalities.

Abstract

The crime of sexual violence in Indonesia is in an emergency phase. The massive number of reports of cases of sexual violence has created its own paranoia for the community, especially in terms of the process of handling cases of sexual violence in Indonesia. This study aims to analyze cases and phenomena of sexual violence in Indonesia and to carry out a normative approach as a study of handling cases of sexual violence. The research method used is normative legal research and the method of analyzing literature and case studies of sexual violence in Indonesia. The results of this study indicate that cases of sexual violence have evolved along with the times. The emergence of gender-based cyber sexual violence (KSBG), abortion cases, and efforts to handle cases using the Alternative Dispute Resolution (ADR) system are injustices to victims. Settlement of cases of sexual violence must be in accordance with Law Number 12 of 2022 concerning Crimes of Sexual Violence, namely the implementation of a legal judicial process.

Abstract

This study aims to implement the djikstra algorithm to overcome the problem of optimizing the shortest route determination in aplousing and maintenance activities of Shipping Navigation Assistance Facilities (SBNP) in the working area of the Tanjung Perak Type A Navigation District Office. The Navigation Pier has historically been a strategic facility to face the challenges of maintaining fuel efficiency, sailing times and reducing emissions in environmental pollution due to suboptimal routes. The djikstra algorithm is known to be effective in finding the shortest route on a weighted graph by representing strategic location points such as ports and marine navigation areas as nodes and the distance between nodes is calculated using the haversine formula based on geographic coordinates as weights. Before the implementation of travel route optimization, a total mileage of 1,210.30 km was obtained and after the optimization was applied using the djikstra algorithm, a total mileage of 1,110.44 km was obtained. This comparison shows a significant distance savings of 99.86 km or 8.25% travel efficiency. This optimization is able to contribute to time reduction, fuel savings and reduction of environmental pollution exhaust gas emissions so that it is able to optimize the operational effectiveness of ships as a whole. This study confirms the positive and relevant capabilities to be applied in shipping navigation route planning and support decision-making in the management of sea routes or logistics transportation in areas with a varied distribution of mileage points that require high efficiency and mobility. In the next research, it is hoped that it will be able to add external factors such as sea currents, waves, and wind according to the geographical characteristics of the territorial waters so that the results of route planning can be more accurate in the real operational area in the shipping work area.
