Abstract

This thesis is entitled "Juridical Review of the Merger of Compensation Lawsuits in Traffic Accident Criminal Cases and its Obstacles Based on Article 98 of the Criminal Procedure Code at the Kupang District Court Class 1A". The regulation of the merger of compensation claims is regulated in general through the provisions in articles 98-101 of Law Number 8 of 1981 concerning the Criminal Procedure Code. Based on Article 98 of the Criminal Procedure Code, the filing of a compensation claim is submitted no later than before the public prosecutor files a criminal charge. The role of the public prosecutor in the incorporation of compensation itself is to convey the rights of the victim to claim compensation at once in the judicial process and if the victim wants a civil compensation claim then the prosecutor will incorporate it into the criminal charges at once with the highest charge limit. The title of this thesis is directed to examine and research two problem formulations, namely: (1) How is the implementation of the merger of compensation claims in traffic accident cases at the Class 1A District Court, and (2) What are the inhibiting factors in the implementation of the merger of compensation claims in traffic accident cases at the Class 1A Kupang District Court. Based on the two problem formulations, the purpose of writing this thesis is to find out the mechanism of combining compensation claims in traffic accident cases and to find out the inhibiting factors. From the results of the author's research, there are obstacles that cause victims of traffic accidents not to file a merger of compensation claims, including the lack of proper socialization of article 98 of the Criminal Procedure Code, the ignorance of victims regarding the merger of compensation claims, and the lack of explanation from the prosecutor and the court regarding the merger of compensation claims according to article 98 of the Criminal Procedure Code to victims. It is hoped that the merger of lawsuits based on Article 98 of the Criminal Procedure Code, which facilitates victims in obtaining legal certainty effectively and efficiently, can be implemented for the realization of justice based on fast, cheap and low cost justice

Abstract

Kekerasan dalam rumah tangga (KDRT) memiliki peran besar dalam menyumbangkan jumlah kasus di dunia saat ini, KDRT adalah kekerasan yang dilakukan di dalam rumah tangga oleh suami, isteri, maupun anak yang berdampak buruk bagi keutuhan fisik, psikis, dan keharmonisan hubungan dalam berkeluarga. Penyelesaian KDRT dapat diselesaikan di luar pengadilan (Nonlitigasi) dengan alternatif penyelesaian perkara pidana (crime clearence) di luar pengadilan dengan tujuan untuk mencapai perdamaian dengan cara musyawarah. Rumusan masalah dalam penelitian ini yaitu: (1) Mengapa kasus KDRT perlu diselesaikan secara Nonlitigasi? (2) Bagaimanakah penyelesaian kasus KDRT secara Nonlitigasi di Kepolisian Sektor Kelapa Lima? (3) Apakah faktor-faktor yang mendukung dan menghambat keberhasilan dalam penyelesaian kasus KDRT secara Nonlitigasi di Kepolisian sektor Kelapa Lima Kota Kupang? Penelitian ini menggunakan metode yuridis-empiris yang dilaksanakan di kepolisian Sektor kelapa Lima. Teknik pengumpulan data menggunakan Teknik wawancara, observasi, dan studi kepustakaan/dokumen. Data yang digunakan adalah data primer dan sekunder. Penelitian ini dilakukan di Kota Kupang. Hasil pengelolaan data tersebut dianalisis secara deskriptif kualitatif dengan menggunakan metode induktif. Berdasarkan hasil penelitian dan pembahasan diketahui: (1) Kasus KDRT perlu diselesaikan secara Nonlitigasi karena para penyidik di Kepolisian Sektor Kelapa Lima Kupang mengarahkan korban dan pelaku untuk bermediasi bersama degan tujuan untuk mengambil keputusan dan perundingan yang menghasilkan penyelesaian akhir untuk mencegah terjadinya kembali kasus secara berulang. (2) Penyelesaian Kasus KDRT yang masuk ke Kepolisian Sektor Kelapa Lima Kota Kupang melalui tahap melakukan pemeriksaan terhadap pelaku, pelapor, saksi yang mengetahui adanya peristiwa KDRT, melengkapi administrasi penyelidikan, melakukan gelar perkara, menetapkan perkara tersebut apakah dapat ditingkatkan ke penyidikan atau tidak, memanggil terhadap terlapor atau diduga pelaku dalam kasus KDRT, dan melakukan penjilidan berkas dan pengiriman berkas ke kejaksaan atau pembatalan tuntutan (setuju berdamai). (3) Faktor-faktor pendukung penyelesain secara Nonlitigasi yaitu menjaga citra/nama baik, alasan pelaporan korban yang tidak paten, pemberian solusi dari pihak penyidik sebagai pihak yang netral, bentuk pembinaan, pertimbangan hubungan antara korban dan pelaku, berbelit atau birokrasi panjang, waktu, hubungan sosial (menjaga hubungan persahabatan/ kekeluargaan), dan biaya perkara. Adapun faktor penghambat yaitu faktor internal dan faktor eksternal.

Abstract

This research was conducted in the Nusa Cendana University Kupang campus. The background to this research is that campuses are a place to study but there are also perpetrators of sexual violence. The problems studied are: (1) How is law enforcement regarding the prevention and handling of sexual violence in the Undana Kupang Campus environment, (2) What are the procedures for handling sexual violence in the Undana Kupang campus environment. This research is a descriptive analysis research using a normative juridical approach method that analyzes and examines Nusa Cendana University Chancellor's Regulation No. 8 of 2022. The research results show that: (1) Law enforcement regarding the prevention and handling of sexual violence in the Undana Kupang Campus environment has been implemented through Undana Chancellor's Regulation No. 8 of 2022 and has been implemented in Undana, from this Chancellor's Regulation a special Task Force has been formed to handle the problem of sexual violence in Undana. (2) Procedures for handling sexual violence within the Undana Kupang Campus have been carried out properly by the Task Force. This shows that it is important for Undana Higher Education to require Chancellor's Regulation No. 8 of 2022 is included in general courses and create a guidebook on preventing and handling sexual violence for all parties within the Undana campus.

Abstract

Customary law was born at the same time as humans as its creators. Where there is society there is law (Ibi Ius Ibi Societas). At the implementation level, customary law can provide decisions that prioritize the goal of achieving togetherness and upholding the principle of kinship, rather than upholding provisions that have been determined by the government with positive law which tends to ignore togetherness and the principle of kinship. Cunca Lolos Village is one of the traditional villages in West Manggarai, therefore every problem in Cunca Lulus Village is resolved through adata and the same applies to the application of cultural values ​​and traditions in Cunca Lolos Village, Mbeliling District, West Manggarai Regency in resolving property disputes. This research is empirical legal research. This research is descriptive in nature and analyzes primary data to determine the process of resolving customary land disputes in the village of Cunca Lolos. Data collection uses interview, observation and documentation techniques. The results of this research show that; (1) the customary land dispute resolution process in Cunca Lulu village is divided into two parts, namely the land settlement process based on stages and the land settlement process based on land ownership (2) the inhibiting factors include changing times which have resulted in the loss of respect for tua golo and how difficult it is to collect old golo devices when completing a task in the village of Cunca escaped.

Abstract

This study analyzes the process of resolving criminal acts of persecution committed by military members within the scope of the Kupang III-15 military court. The research method used is qualitative research with a case study approach. Data was collected through interviews with the Staff of the Military Court III-15 Kupang and the perpetrators of the crime of persecution. The analysis was carried out to identify whether there is a difference between the process of resolving crimes of persecution in civil courts and military courts and to find out whether there is special treatment in the process of resolving crimes within the scope of the Kupang Military Court. The formulation of the problem in this study is 1. What is the process of settling criminal acts of persecution committed by Military Members (Case Study of Military Justice III-15 Kupang)? 2. What are the factors that affect the effectiveness of military justice in dealing with criminal acts of persecution committed by Military Members (Case Study of Military Justice III-15 Kupang)? The results of the study show that the process of resolving criminal acts of persecution committed by military members is carried out in accordance with Law Number 31 of 1997 concerning Military Justice, which involves various stages, ranging from reports or direct findings by officers, examinations to prosecution and criminal acts in the process according to the Criminal Procedure Code. Military members who commit criminal acts of persecution will be examined by the ankum, if the persecution is light, then the ankum is of the opinion that the problem does not need to be resolved through the judicial process. This finding provides insight into efforts to improve the supervision system in each TNI unit and improve the law enforcement system in terms of transparency in the process of resolving criminal acts of persecution committed by military members within the scope of the military court III-15 Kupang.

Abstract

The judge's consideration is very important aspect in determining the realisation of the value of a decision that contains elements of justice in the court, legal certainty and contains benefits for the parties concerned so that it must be addressed properly, carefully and carefully. The formulation of the problems in this study are: (1) How are the judges' considerations in determining the punishment for the perpetrator of the crime of sexual intercourse with a child in Decision No.80/Pid.sus/2023/PN.Kpg? (2) What are the factors that influence the sentencing decision in Decision No.80/Pid.sus/2023/PN.Kpg? This research is normative research, namely legal research that examines documents using legislation, court decisions, legal theories, and can be in the form of scholars' opinions. The results of the research conducted by analysing the decision No.80/Pid.Sus/2023/PN.Kpg of the suspect on behalf of Leo Luha Djami Kale: (1) The judge considered that the defendant was proven to have committed a criminal act in accordance with Article 81 paragraph (1) of the Child Protection Law. However, the judge imposed a sentence below the minimum. (2) Based on juridical factors, the judge stated that the defendant's actions had fulfilled the elements of the article in Article 81 paragraph (1) of the Child Protection Law that had been charged against him and based on non-juridical factors that there had been peace between the two families in accordance with Supreme Court Circular Letter No. 1 of 2017 concerning the Implementation of the Formulation of the Results of the Plenary Meeting of the Supreme Court Chamber in 2017 as Guidelines for the Implementation of Duties for Courts.

Abstract

Customary law was born together with humans as its creators. Where there is society there is law. As is the case in Biau village which has customary law known as ukun banur. Ukun banur means teachings or prohibitions that have been established and are still maintained today in resolving various cases that occur. The specification of this research is empirical legal research. The data taken is primary data and secondary data collected by interviewing informants, literature review and qualitative descriptive analysis. The objectives of this research are (1) To determine the application of Ukun Banur customary law to the resolution of cases of domestic violence in Biau village, Io Kufeu subdistrict, Malacca district. (2) To find out what are the inhibiting factors in the application of Ukun Banur customary law in resolving cases of domestic violence in Biau village, Io Kufeu subdistrict, Malaka district. Based on the research results, the researcher found that the application of Ukun Banur customary law to resolve cases of domestic violence in Biau village, Io Kufeu subdistrict, Malaka district, uses two mechanisms, namely using a pure customary law mechanism and a mixed mechanism, namely involving the local government. The inhibiting factor in implementing Ukun Banur customary law is that public awareness is still low and they are not afraid and ashamed of the customary sanctions they receive. The customary sanctions given do not have legal force and there are no regulations from the local government so they are not binding for all communities.
