Abstract

Tujuan tulisan ini adalah untuk mengkaji bagaimanakah proses hak penguasaan tanah Gua Bitauni dari pihak adat ke pihak Keuskupan Atambua dan bagaimanakah kedudukan yuridis Keuskupan Atambua atas tanah Gua Bitauni. Penelitian ini merupakan penelitian hukum normatif di mana penelitian perpustakaan (libraryresearch), berdasarkan hasil sekunder. Artinya mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan, yurisprudensi, dan kebiasaan-kebiasaan yang berlaku di masyarakat. Jenis dan bahan hukum yang diperoleh adalah melalui bahan hukum primer dan didukung dengan bahan hukum tersier yang berasal dari buku, peraturan perundang-undangan dan lain-lain. Bahan hukum yang diperoleh akan diolah dan dianalisis secara dekskriptif-kuantitatif. Hasil penelitian ini menunjukan bahwa: (1) Tanah Gua Bitauni adalah tanah adat milik Raja Insana (Usif) yang penguasaanya dipercayakan/dibagikan kepada suku Aplasi Fatubola untuk diolah, dirawat dan dijaga kemudian raja Insana bersama suku Aplasi bersepakat untuk menyerahkan ke Gereja secara sadar, sukarela dan iklas tanpa ada tuntutan apapun. (2) Kedudukan keuskupan Atambua atas tanah gua Bitauni diakui secara sah berdasarkan bukti dalam hal ini sertifikat dan juga keterangan para tokoh adat yang saat itu terlibat dalam proses pengalihan hak atas tanah tersebut sebab proses pengalihan tersebut juga melalui prosesi adat yang melibatkan semua pihak tokoh adat.

Abstract

The aim of this research is to explain and analyze the Tala resulting from traditional divorce (Cear Kaeng Kilo) in Manggarai traditional marriages. The research method used in this research is an empirical legal research type. The data source for this research was obtained from primary data, namely obtained from the people of Longko Village, Wae Ri'i District, Manggarai Regency, East Nusa Tenggara Province, while secondary data was obtained from various books, journals, articles and internet sites that were related to the problem. what is being observed is then processed through three stages, namely editing, coding, and data systematization and analyzed through three stages, namely data reduction, data display, and verification. The results of this research show that 1. The meaning of tala in Manggarai marriage customary law, tala is a form of customary fine that must be paid by a woman and her family to a man for violating customary law, namely committing cear kaeng kilo (divorce). 2. The consequences of tala law in Manggarai traditional marriage law. When cear kaeng kilo occurs, it causes many legal consequences, including: (a). Legal consequences for heirs, (b). Consequences of customary law on the couple's inheritance, (c). Customary obligations arising from c ear kaeng kilo in Manggarai customary marriage law, (d). The impact of Tala customary law on Wina and Rona children. 3. Implementation of tala in Longko Village, Wae Ri'I District, includes: (a). The man visits the woman's house to see the woman's condition, (b). The male family does lonto leok, (c). Leso tuning.

Abstract

Zaakwarneming is a voluntary agreement without any order to that effect. In decision Number 1574 K/Pdt/2011 there is an oral agreement between the Bekasi city government and Pt. Hilma Genractor which causes zaakwarneming. The problem formulation of this research is: (1) Is the spirit of zaakwaarneming legal according to the Civil Code? (2) Is verbal agreement proposed the defendant/applicant for cassation in the case of decision Number 1574 K/Pdt/2011 is categorized as a zaakwaarneming legal act? (3) How is the zaakwarneming law applied in decision Number 1574 K/Pdt/2011? This research uses a normative research method, namely research that examines the literature on primary, secondary and tertiary legal materials related to zaakwarneming. The results of the researchs how (1) Legal Spirit forgets the value of being a support in making laws. Therefore, the legal spirit of zaakwarneming according to the Civil Code is the legal principle of kaptuhan and the legal principle of freedom of contract (2) The verbal agreement in decisioncase Number 1574 K/Pdt/2011 cannot be categorized as a legal act of zaakwarneming, because the land clearing work was carried out by the plaintiff is not in the work contract so it does not fulfill the requirements of an agreement in Article 1320 of the Civil Code (3) considerations for the public interest and verbal agreement made by the defendant, thus the plaintiff carried out work outside the contract in good faith.

Abstract

This study aims to analyze the perspective of the Indonesian Civil Code (KUHPerdata) on binding contracts between the Sahabat Keluarga Daycare Bintang Al-Qur’an Foundation and service users (parents) in childcare. This research employs a normative empirical legal approach, combining theoretical studies with field data collected through interviews and observations at the daycare. The findings indicate that the contract plays a crucial role in defining the rights and obligations between both parties, while providing legal protection for those involved. In practice, the contract at Bintang Al-Qur’an daycare has not fully complied with the formal and substantive requirements stipulated in KUHPerdata, which poses potential legal risks, especially if there is any violation of children's rights or unlawful acts. This research is expected to serve as a guide for daycare management to formulate more comprehensive contracts in accordance with civil law principles.
