Abstract

Tujuan penelitian ini adalah untuk mengetahui bagaimanakah sistem pembagian tanah warisan menurut hukum adat Manggarai serta peran tetua adat dalam penyelesaian konflik tanah warisan menurut hukum adat Manggarai. Metode penelitian yang digunakan adalah yuridis empiris, yaitu: penelitian yang dilakukan langsung ke pihak terkait agar dapat mendapatkan informasi tentang masalah yang diteliti. Terdapat 2 cara teknik pengumpulan data yang digunakan yaitu; wawancara, peneliti melakukan tanya jawab dengan responden yang telah ditentukan dengan berpedoman pada daftar pertanyaan yang telah disiapkan. Yang kedua dengan cara studi kepustakaan, yaitu suatu bentuk pengumpulan data lewat membaca buku literatur, hasil penelitian terdahulu dan dokumen-dokumen yang berhubungan dengan topik penelitian. Berdasarkan hasil penelitian, masyarakat Manggarai menganut sistem pewarisan patrilineal yang dimana hanya anak laki-laki yang berhak mendapatkan warisan berupa tanah. Peran tua adat dalam penyelesaian konflik tanah warisan adalah sebagai penengah dalam penyelesaian secara lonto leok (musyawarah adat masyarakat Manggarai) dan bertindak sebagai saksi jika masalah tersebut tidak bisa diselesaikan secara adat sehingga ditempuh melalui jalur hukum.  Masyarakat Manggarai menganut sistem waris patrilineal serta peran tetua adat dalam penyelesaian konflik tanah waris adalah sebagai penengah.

Abstract

Dalam kehidupan manusia perkawinan merupakan salah satu hal yang penting terutama dalam pergaulan hidup masyarakat. Perkawinan adalah suatu jalan yang amat mulia untuk mengatur kehidupan rumah tangga dan keturunan. Pada dasarnya perkawinan mempunyai tujuan bersifat jangka panjang sebagaimana keinginan dari manusia itu sendiri dalam rangka membina kehidupan yang rukun, tenteram dan bahagia dalam suasana cinta kasih dari dua jenis mahluk ciptaan Allah. Metode penelitian ini menggunakan pendekatan kualitatif, penelitian kualitatif adalah prosedur penelitian yang menghasilkan data deskriptif berupa kata-kata tulisan atau lisan dari orang-orang dan perilaku yang dapat diamati. Hasil penelitian ini menujukkan salah satu benturan itu ditemukan dalam perjumpaan antara hukum perkawinan Katolik dan model perkawinan dalam budaya Manggarai. Hukum Gereja berada dalam konteks budaya Manggarai yang didalamnya memiliki hukum adat tentang perekawinan adat. Dalam hukum perkawinan Gereja Katolik,salah satu halangan ialah apabila pasangan memeiliki hubungan darah. Konsep perkawinan agama Katolik sangat bertentangan dengan paham perkawinan Tungku dalam budaya Manggarai. Model menurut hukum agama dan kepercayannya  masing-masing pihak yang melangsungkan perkawinan Tungku merupakan salah satu bentuk tradisi perkawinan. Dapat disimpulkan bahawa Perkawinan sedarah (Tungku) telah melanggar ketentuan Pasal 8 Undang-Undang Nomor 1 Tahun 1974 yang mengatur larangan perkawinan karena masih adanya hubungan darah antara saudara dan Perkawinan Sedarah (Tungku) yang telah dilakukan di dalam tradisi masyarakat Manggarai dianggap sah menurut hukum adat masyarakat Manggarai.

Abstract

Land disputes are unavoidable in this day and age, this is because land disputes arise from complaints from a party (person / agency) containing objections and demands for land rights, priorities and ownership in the hope of obtaining administrative settlements in accordance with applicable regulations. The problems in this thesis are: (1) What are the factors that cause land disputes between landowners in Sanggoen Village and the Government of Rote Ndao Regency in Civil Case Decision Number 14/Pdt.G/2014/PN.Rno? and (2) What is the position of land grants against the issuance of certificates of ownership on behalf of Executive and Legislative Officials in Civil Case Decision Number 14/Pdt.G/2014/PN.Rno?. This research is a normative legal research by collecting, reading, tracing a number of library materials and analyzing Decision Number 14/Pdt.G/2014/PN.Rno. Data processing is carried out by several processes, namely the data obtained is studied then processed and analyzed. The last stage is drawing conclusions from the data that has been processed. The results of this study show: (1) factors causing land disputes between landowners in Sanggoen Village and the Government of Rote Ndao Regency, namely: The annexation of the Plaintiffs' land by issuing certificates to 40 Executive and Legislative Officials in Rote Ndao Regency and the Plaintiffs' and Defendants' proof that the disputed land is their legitimate property and (2) The position of the land grant against the issuance of certificates of ownership on behalf of 40 Executive and Legislative Officials, namely: referring to Article 1365 of the Civil Code, the issuance of certificates which is a product of the National Land Agency of Rote Ndao Regency contains legal defects. The certificate does not have binding legal force and should be canceled by law.

Abstract

In the definition of divorce, it is said that sufficient reasons are needed for divorce, and these reasons will be proven in a court trial. Divorce cannot be done as easily as turning the palm of your hand. The most important consequence of the breakdown of a marital relationship is the division of joint assets. If a separation of assets agreement was not entered into before marriage, then the assets acquired during the marriage must be divided upon divorce. The author conducted research on the Kupang District Court Decision, Number: 79/PDT.G/2021/PN KPG, so it was deemed necessary for the author to review whether the Decision was in accordance with the problem formulation in the research on Law Number 1 of 1974 concerning Marriage. (1) Does the Kupang District Court Decision Number: 79/PDT.G/2021/PN KPG fulfill the requirements for reasons for divorce according to Law Number 1 of 1974 concerning Marriage? (2) How do the judges' considerations in the Kupang District Court Decision Number: 79/PDT.G/2021/PN KPG fulfill justice for the parties that have an impact on the divorce? This research is normative legal research with the approach method used in this research, namely: (1) Legal Approach (2) Conceptual Approach and (3) Comparative Approach then analyzed prescriptively juridically. The results of this research show that: (1) The decision given by the judge in the Kupang District Decision Number: 79/PDT.G.2021/PN KPG is clear in accordance with the reasons for the divorce in the explanation of article 39 of Law Number 1 of 1974 JO. Article 19 of Government Regulation Number 9 of 1975, states that because the plaintiff and the defendant have had separate houses and beds for up to five years, and the plaintiff has been abandoned. (2) In this case, the researcher sees that the Kupang District Court Decision Number: 79/PDT.G/2021/PN KPG, is in accordance with the actions of the plaintiff, namely that he had come to appear at the trial, but the defendant did not come to appear or asked other people to appear to appear. Represent him legally, at the trial in this case even though he had been summoned using valid court procedures, the defendant was not present at the trial and also did not show his legal representative to represent him at the trial, so that according to the researcher, there was balanced justice between the parties. those in dispute, both plaintiffs and defendants.

Abstract

Brand is a sign to identify the origin of goods and services (an indication of origin) of a company with the goods and / or services of other companies. Moke is a typical drink from the island of Flores made from siwalan (palm tree) and enau plants. This drink has many names such as sopi, dewe, and moke. But the most familiar and characteristic name of Flores Island is moke. This research is an empirical juridical research, located in Kupang City, The aspects studied in this study are: a) Factors that cause low registration of traditional Moke beverage brands in Kupang City b) Procedures for registering trademark rights of traditional Moke Moke drinks in Kupang City. Data Types and Sources consist of primary and secondary data with data collection techniques, namely by means of interviews and questionnaires, then the data is obtained and analyzed in a qualitative descriptive manner. The main problems in this study are a) What are the factors that cause the low registration of traditional Moke beverage brands in Kupang City? b) What is the procedure for registering trademark rights for traditional moke Moke drinks in Kupang City? The purpose of this study is to determine the factors that cause the low registration of traditional Moke beverage brands in Kupang City and the procedure for registering Moke Moke traditional beverage trademark rights in Kupang City. The results showed that the factors causing the low registration of moke marks in Kupang city were due to the lack of public knowledge about trademark registration, the assumption factor that the mark does not need to be registered, the readiness factor of the community to register its mark, the class determination factor, the expensive factor of trademark registration fees and the assumption that the moke brand liquor is still small and the trademark registration procedure in Kupang city has been regulated in Law No. 20 years 2016 in article 4 of the Trademark Registration Facility Procedure. The trademark registration procedure is very easy and not difficult. Moke brand registration requirements are the first required applicant's personal data, namely name, address, email, cellphone number and the second is needed brand logo or commonly called brand etiquette. After the data is collected, the billing code is printed and paid to the bank, after paying at the bank, it is immediately processed in the application. The advice in this study is that it is expected for producers who own traditional liquor brands to be able to register trademarks with IPR in order to obtain legal protection, so that others cannot misuse existing brands. And it is also expected that the government, especially in this case IPR which handles trademark registration, can socialize the importance of trademark registration, both for these individuals and for others.

Abstract

Abstract: Abstracts The main problem with PTSL that occurs in Ende Regency is the difficulty of finding village/sub-district areas that are willing to have their land plots legalized. This happens because the majority of Mosalaki refuse to make their area a PTSL object, even though the local village/sub-district government agrees. This research is a type of empirical legal research in which the data is obtained directly from the field or research location. This research uses interview guidelines from several data sources and is analyzed descriptively. The results of this research show that indigenous communities have the existence of legal unity, unity of authority and territorial unity which is recognized by the regional government. The existence of the authority of traditional leaders makes it a challenge for most villages in Ende Regency to still have Mosalaki. Mosalaki, as a symbol of the existence of traditional communities, is responsible for carrying out traditional authority over rituals and control of traditional lands. Therefore, in implementing PTSL, the Ende Regency Land Office is obliged to consult with Mosalaki to obtain support and approval for the area to be designated as a PTSL location. The difficulty in obtaining Mosalaki's approval is a major inhibiting factor in PTSL activities from village to village. Concerns about the release of land ownership from members of the traditional community to other people as well as the disorderly methods of members of the traditional community regarding customary provisions after land certification became Mosalaki's basis for rejecting the location of PTSL in his territory.

Abstract

The dynamics of belis demands during marriage in the community in Oen oh Hamlet. Oebafok Village, Rote Ndao Sub-district, that is, that in ancient times if the belis did not comply with the agreement then the marriage or marriage was annulled. If it is completed according to the agreement of the two extended families or the two families who will carry out the marriage, the marriage will take place. But in this day and age there began to be a world of education, and slowly the community has begun to understand and no longer want to burden their children, so there are no longer demands when something is not in accordance with the agreement then there is only a discussion between the two families concerned. So there are no more fines or dynamics on belis demands that often occur. This research is an empirical legal research method with direct data collection techniques at the research site and conducting interviews with four respondents. The data were analyzed in a qualitative descriptive manner.The results of this study show that: (1) In ancient times if the belis was not in accordance with the agreement then the marriage was annulled. If it is completed according to the agreement of the two extended families, the marriage takes place. (2) If you do not meet the belis, you will be subject to a fine in the form of Mai, which means that one Mai has a nominal value of five million, but it can be one Mai valued at two million hundred or it can also go down based on the results of discussions between the two families.

Abstract

BPJS Ketenagakerjaan participants who are workers are entitled to legal protection, because it is included in the National Social Security System and is a state program with the aim of providing certainty of protection and social welfare for all Indonesian people. Legal protection has the purpose of providing protection to human rights that are harmed by other individuals. Legal protection is a variety of legal efforts that must be given by law enforcement officers in order to form a sense of security, either physically or mentally from various threats from any party and given to the community so that they can enjoy all the rights granted by law. This study is included in Empirical Legal Research is a method of legal research that seeks to see the law in a real sense or can be said to see, examine how the law works in society, which then uses a research approach, a type of qualitative approach. Efforts to overcome the fulfillment of the rights and obligations of BPJS Ketenagakerjaan participants and obstacles in the fulfillment of the rights and obligations of BPJS ketenagakerjaan participants. The results showed that: (1) in Oesena Village, efforts to fulfill the rights and obligations of BPJS Ketenagakerjaan participants have been implemented but not maximally in accordance with the vision and mission of BPJS Ketenagakerjaan, this can be seen from the difficulty of the BPJS Ketenagerjaan claim process for work accident insurance. Then, the disbursement of Old-Age Security for participants who die or experience permanent disability should be able to take place more quickly because it is urgent, and many participants do not understand their rights as BPJS Ketenagakerjaan participants due to lack of socialization. (2) There are several factors that become obstacles in fulfilling the rights and obligations of BPJS Ketenagakerjaan participants, namely internal factors and external factors.

Abstract

The state of Indonesia, which is a state of law, should have a society that is aware of the law. One form of awareness of the Indonesian people towards the law is to realize how important and necessary it is for someone to have written evidence in determining the status of that person for events or events that always exist. in the course of human life, among others; marriage events, birth events, child recognition or legalization events, divorce events and by registering the event or incident at the Civil Registry Institution in the form of a Civil Registry Deed. This is in accordance with the law in the Decree of the Minister of Home Affairs Number 54 of 1999 concerning Guidelines for the Implementation of Population Registration in articles 3 and 5 which essentially states that every resident and temporary resident is obliged to register and register every event of birth, marriage, divorce and death listed in the Deed of Population Registration. The formulation of the problem that will be examined by the author is (1) What are the legal consequences if someone is late in registering a birth certificate in terms of Law No. 23 of 2003. (2) What is the proper procedure in registering a birth certificate for those who are too late to register according to Law No. 23 of 2003. This study uses an empirical juridical method, namely research whose data is obtained directly from interviews with respondents in the research field to investigate the legal reality that exists in social life. Data processing techniques using editing, coding and tabulating techniques. The respondents were the Head of the East Flores Regency Dispenduk, Civil Registration Service Division, People who were Late in Registering a Birth Certificate. and data analysis techniques using descriptive qualitative analysis. The results of the study show: (1) Legal Consequences If Someone is Late in Registering a Birth Certificate In terms of Law No. 23 of 2003, the ADMINDUK Act if there is a delay in registering a child's birth certificate is usually subject to sanctions. (2) Appropriate Procedures in Registering Birth Certificates for those who are late in registering according to Law No. 23 of 2003. Applicants enter data, birth form data filled in from the village, original birth information from the hospital or from the village, and even then giving birth at home.

Abstract

The aim of this research is to explain and analyze the Tala resulting from traditional divorce (Cear Kaeng Kilo) in Manggarai traditional marriages. The research method used in this research is an empirical legal research type. The data source for this research was obtained from primary data, namely obtained from the people of Longko Village, Wae Ri'i District, Manggarai Regency, East Nusa Tenggara Province, while secondary data was obtained from various books, journals, articles and internet sites that were related to the problem. what is being observed is then processed through three stages, namely editing, coding, and data systematization and analyzed through three stages, namely data reduction, data display, and verification. The results of this research show that 1. The meaning of tala in Manggarai marriage customary law, tala is a form of customary fine that must be paid by a woman and her family to a man for violating customary law, namely committing cear kaeng kilo (divorce). 2. The consequences of tala law in Manggarai traditional marriage law. When cear kaeng kilo occurs, it causes many legal consequences, including: (a). Legal consequences for heirs, (b). Consequences of customary law on the couple's inheritance, (c). Customary obligations arising from c ear kaeng kilo in Manggarai customary marriage law, (d). The impact of Tala customary law on Wina and Rona children. 3. Implementation of tala in Longko Village, Wae Ri'I District, includes: (a). The man visits the woman's house to see the woman's condition, (b). The male family does lonto leok, (c). Leso tuning.
