Abstract

The person designated as the owner of the job by the Budget User or Power of Budget User and in charge of carrying out the acquisition of goods and services is known as the Commitment Maker Officer. Contract-based procurement operations necessitate a high level of comprehension and/or proficiency, beginning with the stages of purchase planning, purchase execution, control, contract signing, and reporting and submission of work results. As a result, the PPK acts as its representative when forming alliances or agreements with other parties; in the absence of the Office of the Commitment Maker, the instance is unable to do so. The Office of the Commitment Maker determines whether a procurement of goods and services within an agency is successful or unsuccessful. This indicates that the fundamental functions of the Office of Commitment Makers are intimately tied to the utilization of the State budget since their execution calls for a distinct set of skills, accountability, and rigor than those of another administrative officer. State losses from damage or other claim claims will arise from errors in the Office of the Commitment Maker's discharge of its obligations

Abstract

This research aims to examine the application of the KPKPU Law, as well as the urgency of renewing the KPKPU Law. this type of research uses normative juridical research. the data source of this research pays attention to, examines, and knows the application of legal principles. in the application of the KPKPU Law, there is a discrepancy with the purpose of the birth of bankruptcy law. Since the enactment of the Bankruptcy Law, filing for bankruptcy against debtors seems to have been made easier, which has resulted in many debtors being declared bankrupt. In addition, the PKPU time limit is very fast. Therefore, if PKPU is filed by a creditor, the debtor is required to submit a peace proposal to all creditors. In practice, due to force majeure, it is not uncommon for debtors to default less than a year after the approval of the peace plan. Bankruptcy law should not only pay attention to creditors and debtors, but more importantly pay attention to the interests of stakeholders, which in this case the most important is workers. In order for the effectiveness of bankruptcy law to be realized fairly, it is necessary to refresh the KPKPU Law.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap konsumen dalam transaksi e-commerce di Indonesia, dengan fokus pada efektivitas Undang-Undang Perlindungan Konsumen (UUPK) dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). Metode yang digunakan adalah pendekatan kualitatif melalui studi literatur terhadap peraturan perundang-undangan, jurnal ilmiah, dan hasil penelitian terdahulu. Hasil penelitian menunjukkan bahwa perlindungan konsumen masih lemah akibat implementasi regulasi yang tidak adaptif, lemahnya mekanisme perlindungan data pribadi, serta belum tersedianya sistem penyelesaian sengketa yang efektif dan digital. Ketidakseimbangan informasi antara konsumen dan pelaku usaha juga memperburuk posisi konsumen dalam transaksi daring. Penelitian ini menyarankan perlunya sinergi antara regulasi perlindungan konsumen dan kebijakan keamanan digital, serta pembentukan sistem penyelesaian sengketa daring yang terintegrasi. Temuan ini memberikan kontribusi terhadap pengembangan hukum perlindungan konsumen berbasis teknologi digital di Indonesia.

Abstract

This study aims to analyze the challenges and solutions in the legal protection of music royalties in the digital era, identify systemic problems in the existing legal framework and royalty distribution system, and explore the potential of emerging technologies as alternative solutions. The research method uses a qualitative approach with a systematic literature review of relevant academic publications, legal documents, and industry reports, analyzed using thematic content analysis and comparative analysis techniques to identify key patterns and themes. The results of the study reveal three main findings: first, legal challenges include the complexity of cross-border jurisdictions, weaknesses in enforcement mechanisms, and ambiguity in the classification of digital music use, which create regulatory gaps; second, the digital royalty distribution system suffers from problems of lack of transparency, unfairness of the pro-rata model, complexity of the distribution chain, and the phenomenon of unclaimed royalties, which is detrimental to music creators; third, blockchain technology, artificial intelligence, and tokenization offer potential solutions through smart contracts, automated content identification, and user-centric payment systems. The study concludes that comprehensive reforms are needed that integrate international regulatory harmonization, transformation of the royalty distribution system, and the implementation of advanced technology to create effective, transparent, and fair digital music royalty protection for all stakeholders in the global music industry.
