Abstract

The phenomenon of carrying out marriage contracts and divorces via telephone has raised debate among Muslim scholars and intellectuals regarding its legal validity according to Islamic law. This issue has become increasingly relevant in the era of globalization and the COVID-19 pandemic which limits physical meetings, thus requiring in-depth study through the perspective of ushul fiqh to provide comprehensive legal clarity. This study aims to analyze the validity of marriage contracts and divorces carried out via telephone based on the rules of ushul fiqh, identify the conditions that must be met in their implementation, and formulate practical guidelines for Muslims in dealing with situations that require the implementation of these contracts via long-distance communication media. The research method used is qualitative research with a normative legal approach, using descriptive-comparative analysis techniques. Primary data were obtained from the Qur'an, Hadith, and the opinions of classical and contemporary scholars, while secondary data came from fiqh literature, ushul fiqh, and relevant previous research. The analysis was carried out using ushul fiqh rules such as qiyas, istihsan, istislah and Sad Ad-Dzariah. The results of the study indicate that the application of ushul fiqh to marriage contracts and divorce via telephone can be considered valid on the condition that the pillars and requirements of marriage that have been determined by sharia are fulfilled, including the clarity of the identities of the parties, the presence of witnesses who can hear clearly, and the certainty that the ijab qabul really comes from the parties concerned. Divorce via telephone has a more complex level of validity, where its validity is highly dependent on the clarity of the wording, the full awareness of the husband, and the verifiability of the identity of the person pronouncing the divorce. The application of the maslahah and dharurah (emergency conditions) rules provides flexibility in special situations that require the implementation of the contract via telephone.

Abstract

AbstractThe development of the era and the demands of modern industry have brought about major changes in the procedures for slaughtering animals, one of which is the emergence of mechanical slaughtering methods that are widely used in the global food industry. On the one hand, this method offers efficiency, speed, and cleanliness. On the other hand, doubts and questions arise from Muslims regarding the validity of this method from the perspective of Islamic law. Through qualitative analysis methods of primary and secondary data obtained through literature studies, it was found that there is no clear regulation regarding the mechanical method of slaughtering animals, which has led to doubts and questions from Muslims regarding the validity of mechanical slaughtering. From these findings, it can be concluded that a clear regulation is needed regarding the mechanical slaughter of animals with the standard of maslahah mursalah within the framework of ushul fiqh. Because through this maslahah mursalah, a strict control mechanism, audit, and accountability for the entire slaughtering process are needed. In addition, it is also accompanied by tawthīq (verification) of the halalness of the product which is able to create public trust in the halal industry itself. For this reason, the author suggests that religious authorities and fatwa institutions be proactive in establishing regulations, compiling technical guidelines, and providing education to the public regarding mechanical animal slaughter.Keyword: Animal Slaugther, Mechanical, Islamic Jurisprudence

Abstract

Abstract:This research examines the application of non-material mahr (dower) in Islamic law through the lens of usul al-fiqh (Islamic legal theory). Mahr, as a mandatory gift from the groom to the bride in a marriage contract, is not limited to tangible assets but may also take the form of non-material benefits, such as the recitation or teaching of the Qur'an or a spiritual commitment. In contemporary Muslim communities, particularly among those who prioritize religious values and simplicity in marriage, the practice of non-material mahr has become increasingly accepted. This study employs a normative qualitative method with a juridical-theological and usul fiqh approach, using descriptive-analytical techniques based on primary sources (the Qur’an, Hadith, classical and contemporary Islamic legal texts) and secondary sources (scholarly journals and field observations). The findings indicate that non-material mahr is legally valid in Islamic jurisprudence, provided it brings benefit (maslahah), is mutually agreed upon, and does not contradict Islamic legal principles. From the perspective of usul al-fiqh, concepts such as maslahah mursalah, istihsan, and ‘urf justify and strengthen the permissibility and social relevance of non-material mahr. This form of mahr offers a practical and spiritually meaningful solution to modern marital challenges while aligning with the objectives of Islamic law (maqasid al-shari‘ah). Mahar, sebagai pemberian wajib dari mempelai pria kepada mempelai wanita dalam suatu akad nikah, tidak terbatas pada harta berwujud, tetapi juga dapat berupa manfaat nonmateri, seperti pembacaan atau pengajaran Al-Qur'an atau komitmen spiritual. Dalam masyarakat Muslim kontemporer, khususnya di kalangan yang mengutamakan nilai-nilai agama dan kesederhanaan dalam perkawinan, praktik mahar nonmateri semakin diterima. Penelitian ini menggunakan metode kualitatif normatif dengan pendekatan yuridis-teologis dan ushul fiqh, dengan menggunakan teknik deskriptif-analitis berdasarkan sumber-sumber primer (Al-Qur'an, Hadits, teks-teks hukum Islam klasik dan kontemporer) dan sumber-sumber sekunder (jurnal-jurnal ilmiah dan pengamatan lapangan). Temuan penelitian menunjukkan bahwa mahar nonmateri sah secara hukum dalam yurisprudensi Islam, dengan syarat membawa manfaat (maslahah), disepakati bersama, dan tidak bertentangan dengan prinsip-prinsip hukum Islam. Dari perspektif ushul fiqh, konsep-konsep seperti maslahah mursalah, istihsan, dan ‘urf membenarkan dan memperkuat kebolehan dan relevansi sosial dari mahar non-material. Abstract

This study investigates the reorientation of waqf utilization from a traditional charity-based model to a strategic investment framework, analyzed through the lens of maqashid al-shariah. In Lhokseumawe City, Aceh, waqf assets comprise approximately 485,877.42 m² across 296 locations; however, only about 7% are managed productively, indicating a substantial gap in socio-economic impact. The contemporary transformation of waqf practice signifies a paradigm shift from donation-oriented approaches to investment-driven strategies, necessitating a robust theoretical foundation. Adopting a qualitative field research design, the study employed purposive sampling of 15 informants, including nazhir, government officials, and Sharia economic practitioners. Data were collected through in-depth interviews and participatory observation. Findings demonstrate that the five pillars of maqashid al-shariah provide a comprehensive evaluative framework for productive waqf management. Three key patterns were identified—substitution (ibdal–istibdal), functional expansion, and asset conversion—each assessed in relation to principles such as hifzh al-din, hifzh al-mal, and hifzh al-nafs. Aligning waqf practices with maqashid principles enables the integration of Islamic spiritual values with community economic empowerment. While Indonesia’s Law No. 41 of 2004 establishes the legal foundation for waqf governance, policy innovations are required to harmonize it with contemporary Islamic financial instruments. The study recommends regulatory reform, nazhir certification, and the adoption of digital governance to enhance transparency and sustainability. It concludes that embedding maqashid al-shariah within the waqf management framework can unlock the full potential of national waqf assets as a catalyst for sustainable economic development, while preserving the core values of Sharia at every stage of asset management.
