Abstract

The development of waqf assets in the form of adding the function of waqf is a new phenomenon in the problems of Islamic law jurisprudence even in positive law in Indonesia. In national law (positive), Indonesia has regulated this issue with the existence of laws and government regulations regarding waqf both movable and immovable waqf assets, even in its development every property in waqf must have an Deed and / or certificate. Whereas in Islamic jurisprudence, the development of waqf assets in the form of additional functions is one of the problems that can be said to be new, it needs legal conclusions and even has to be seen from various theoretical concepts such as maqashidu sharia. Therefore this research will examine the issue of developing waqf assets based on the Waqf Law and maqashid syari'ah. This research is an empirical legal research using a sociological legal approach, with data collection through documentation and interviews. The results of the research show that the development of waqf assets is permitted according to the law, but with the stipulated conditions, besides that the development of waqf assets is also permissible in Islamic jurisprudence as long as it is solely for reasons in accordance with the concept of maqasidu syari'ah and the point is to seek maslahat.

Abstract

Perceraian sering terjadi dalam kehidupan masyarakat yang sudah memiliki ikatan perkawinan sah dengan segala macam permasalahan dan sebabnya. Kalimat cerai sama dengan pisah adalah merupakan putusnya hubungan suami dan isteri. Ucapan talak yang disampaikan secara langsung adalah yang diucapkan oleh suami sendiri. Sedangkan tidak langsung yaitu yang diucapkan melalui perantara. Dalam pembahasan kita disini adalah pada proses perceraian yang terjadi baik langsung maupun tidak langsung. Dalam proses perceraian terdapat perbedaan pendapat antara yang mewajibkankan adanya saksi dengan yang tidak mewajibkan saksi. Jumhur ulama baik dari kalangan salaf maupun khalaf berpendapat bahwa talak dapat jatuh tanpa adanya saksi.

Abstract

When many business entity activities start to appear that use the sharia label, the resolution must be carried out by institutions that truly understand sharia economics. So, creating economic products that have the term sharia attached to them is not easy and requires various kinds of adjustments, such as; applicable laws and regulations, contemporary economic developments in global society which tend to be value-free, varied transaction models, and so on. All of this must be able to be adjusted to sharia principles. The problem formulation in this research is: What is the Sharia Economic Dispute Resolution Model seen from Qanun No. 11 of 2018 concerning Sharia Financial Institutions? The type of research used is library research, namely by studying and examining sources. written text that is relevant to the discussion material. The results of this research are a model for Sharia Economic Dispute Resolution after the implementation of Qanun No. 11 of 2018 concerning Sharia Financial Institutions, a model for resolving disputes through non-litigation (outside of court), namely a model for resolving disputes that is carried out using methods that exist outside of court. usually called an alternative dispute resolution institution.

Abstract

Based on data released by the Central Statistics Agency, the divorce rate in Indonesia continues to increase every year due to various factors behind it. The rise of divorce and the fragility of family resilience is partly due to the ineffectiveness of customary law in preventing this. So this research was conducted to examine the existence of customary law in creating family resilience and preventing divorce. This type of research is descriptive-qualitative with a phenomenological approach. Data collection was carried out through focus group discussions (FGD) with traditional leaders about customary rules that are applied to create family resilience and prevent divorce. The research results show that traditional institutions have made customary regulations to create family resilience and prevent divorce, including making customary rules to minimize divorce, requiring prospective brides and grooms to take pre-marital courses, resolving husband and wife conflicts and preserving marriage traditions. However, the application of customary law in creating family resilience and preventing divorce faces a number of internal and external challenges. Internally, the obstacles include weak competence of traditional leaders in carrying out their functions as executors of customary law, decreased public trust in traditional leaders, and decreased public awareness of implementing customary law in marriage processions. External challenges include government policies that amputate the role of customary law in society, and the lack of government support for customary institutions. So the role of customary law needs to be revitalized as local wisdom which really functions to solve various problems in society.

Abstract

This study examines the reorientation of waqf utilization from a traditional social charity approach toward strategic investment from maqâsid al-shari'ah perspective. The transformation of contemporary waqf reflects a shift from charity-oriented practices to an investment-driven model. This research employs a qualitative field method, with data collected through interviews and participatory observation. Data analysis is conducted using As-Syatibi's maqâsid al-shari'ah framework. The findings reveal that the five pillars of maqâsid al-shari'ah provide an effective framework for assessing the productivity and socio-economic impact of waqf utilization. The maqâsid-based approach enables the integration of Islamic spiritual values with community economic empowerment. This study concludes that incorporating maqasid principles into waqf management can optimize the potential of national waqf assets as a driver of sustainable economic development. Therefore, the development of productive waqf models oriented toward strategic investment while maintaining Sharia values is strongly recommended.Keywords: Islamic economics, maqâsid al-shari'ah, productive waqf, strategic investment, sustainable development
