Abstract

  This study aims to determine the implementation of the DSN MUI fatwa Number 26 of 2013. Furthermore, how it affects the purchase decision of Generation Muslimah Y and Z in choosing and buying cosmetic products—using qualitative methods with triangulation techniques, namely using various data collection methods consisting of observations, interviews, questionnaires, and documentation studies. The results show that the critical point of halal in cosmetics consists of the composition of the ingredients used and the resistance of cosmetics to water. Among the Muslim generations Y and Z, some already know, and some do not know the halal standards of cosmetics. However, according to Generations Y and Z, cosmetic halal standards in DSN – MUI Fatwa Number 26 of 2013 can affect their purchase decision on halal cosmetic products. Halal certification is still the main reason for purchasing halal cosmetics compared to prices, trends, and brands. It did by the Muslimah Generation Y and Z. In conclusion, DSN Fatwa–MUI Number 26 of 2013 applies effectively to The Muslimah Generation Y and Z as a consideration in choosing and buying halal cosmetics. This research implies that halal labeling can be used as a marketing strategy for a cosmetic product. The originality of this research lies in the object of research, which is only limited to Generations of Muslim women Y and Z and Fatwa DSN MUI Number 26 of 2013 as an analytical tool.

Abstract

Semakin majunya teknologi, media sosial dan marketplace menjadi alat penting dalam mempromosikan bisnis. Banyak orang cenderung menitikberatkan pada jumlah followers karena dianggap meningkatkan keuntungan produk. Namun, keberhasilan ini bergantung pada pengikut yang aktif, sedangkan akun dengan pengikut pasif (palsu atau bot) dapat berdampak negatif karena kurangnya interaksi yang nyata. Penelitian ini bertujuan untuk mengetahui hukum jual beli followers melalui situs irvankedesmm.co.id menurut Hukum Ekonomi Syariah. Penelitian mencakup identifikasi metode transaksi, cara kerja penambahan followers, serta profil pengguna dan penyedia layanan. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif. Sumber data primer berasal dari website irvankedesmm.co.id dan wawancara dengan pemilik serta pengguna situs tersebut. Sumber data sekunder diperoleh dari penelitian relevan, buku, laporan, dan peraturan terkait. Pengumpulan data dilakukan melalui wawancara, dokumentasi, dan observasi untuk mendukung analisis masalah yang diteliti. Penelitian menemukan bahwa mekanisme jual beli followers di situs irvankedesmm.co.id adalah inovasi pemasaran yang sepenuhnya digital, melibatkan pembayaran melalui QR, E-wallet, atau transfer bank. Namun, transaksi ini dinilai tidak sah menurut hukum ekonomi syariah karena terdapat ketidakjelasan objek transaksi (followers), potensi kerugian bagi pembeli, dan adanya unsur gharar (ketidakpastian). Praktik ini juga bertentangan dengan prinsip syariah, seperti kejujuran dan transparansi, serta mengandung unsur tadlis (penipuan), sehingga dianggap tidak sah secara moral dan etis.

Abstract

The incident in the case of children's snacks certified halal but containing pork elements raises serious issues related to the legal certainty of halal certification and consumer protection, especially Muslim consumers and children. In this condition, a more in-depth study is needed regarding the governance of halal certification and the implemented oversight mechanisms, especially regarding food products circulating in the market and consumed by the public or Muslim consumers. This study aims to analyze the legal certainty of halal certification and consumer protection in the case of children's snacks contaminated with pork in Indonesia from the perspective of Sharia Economic Law and the Consumer Protection Law. The research method used is qualitative with an empirical juridical approach and analytical descriptive method, through interviews with BPJPH and consumers as well as a literature study of related laws and regulations and fatwas. This study fills the gap in the study regarding the legal certainty of halal certification for products that have obtained halal certification but are later proven to contain pork elements. The research findings indicate that the weakness of the traceability system, post-halal certification supervision of products that have been certified but are proven to contain pork elements and internal halal audits of companies are the main factors that cause changes or non-conformities in raw materials not to be detected early. As a result, non-halal elements can enter the production process and are only revealed after laboratory testing is carried out on products circulating in the community. From the perspective of Sharia Economic Law, this condition reflects a violation of the principles of trust, honesty, and the prohibition of tadlis and gharar, while in the Consumer Protection Law, this incident is a violation of consumers' rights to correct information and a sense of security.
