Abstract

Perkembangan persyaratan perundang-undangan untuk pemasyarakatan tidak sepenuhnya tercakup dalam Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan. Undang-Undang Pemasyarakatan, Undang-Undang Nomor 12 Tahun 1995, juga dianggap tidak memadai dalam memfasilitasi pelaksanaan perlindungan hak sebagaimana yang digariskan dalam Pasal 28D Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pengaturan Undang-Undang Nomor 12 Tahun 1995 terhadap beberapa subsistem pemasyarakatan yang beroperasi secara independen dan tidak terhubung dengannya pada akhirnya berisiko menyebabkan tumpang tindih dan inkonsistensi norma. Penelitian ini menggunakan pendekatan hukum empiris dan bersifat kualitatif. Semua konsep pemasyarakatan berfungsi sebagai landasan bagi undang-undang pemasyarakatan yang baru. Sementara itu, mengubah paradigma pemasyarakatan didasarkan pada landasan filosofis, sosial, dan hukum. Sebagai subsistem peradilan pidana yang mengoordinasikan penegakan hukum, sistem pemasyarakatan yang komprehensif termasuk dalam ruang lingkup dan arah aturan dalam ukuran ini.

Abstract

The main objective of the company is to enhance the overall value of the company. This increase in value then impacts the welfare of employees, thereby influencing the long-term valuation of the organization. Researchers aim to investigate the elements affecting the high valuation of manufacturing businesses listed on the Indonesia Stock Exchange (IDX) during the period 2016-2022. This research examines several independent factors, including company growth, dividends, profitability, and capital structure. The dependent variable studied is the company's value. This study utilizes secondary data derived from the annual financial reports issued by manufacturing companies during the period 2016-2021, obtained from the official website of the Indonesia Stock Exchange. The research employs a research methodology utilizing quantitative techniques, particularly simple linear regression and multiple linear regression, as the primary research methods. The study focuses on the research population, namely manufacturing companies listed on the Indonesia Stock Exchange during the period 2016-2021. The sample size for this study consists of a total of 12 companies. The research findings indicate that company expansion has a detrimental impact on company value, while dividends have a beneficial effect in increasing company value. Furthermore, profitability is proven to have a significant positive relationship with company value, and capital structure also appears to have a significant positive impact on company value. Additionally, the simultaneous testing conducted, either jointly or simultaneously with the dependent variable, shows that all independent factors examined in this study have statistically significant and positive impacts on the dependent variable, namely company value.

Abstract

This study aims to examine the problem of personal data leakage in Indonesia, with a focus on the factors causing the leakage, its impact on citizens' privacy rights, and legal protection measures taken by authorized institutions and electronic system organizers (ESE) within the framework of the Indonesian rule of law.This study uses a qualitative descriptive-analytical approach, combining empirical data from field interviews with legal analysis. Key stakeholders from government institutions responsible for the management and protection of personal data were interviewed, and existing regulations, such as the Personal Data Protection Law and Permendagri No. 17/2020, were analyzed to understand the effectiveness of existing legal protection. Research findings show that data breaches in Indonesia are caused by inadequate data security infrastructure, limited expertise at the local level, and inconsistent implementation of national regulations. Although regulatory frameworks such as ISO 27001 certification are in place, a lack of resources and training in local governments hampers effective data protection. Coordination between central and local governments is essential, but faces challenges in ensuring uniform data management practices and protecting personal data from external threats.
