Abstract

The development of digital technology has increased the threat of cybercrime, including revenge porn, which has a broad impact on victims, psychologically, socially and economically. Although Indonesia already has regulations such as the ITE Law and the Pornography Law, these regulations have not been fully effective in ensnaring perpetrators and providing maximum protection for victims. Meanwhile, other countries such as the United Kingdom and the United States have more specific regulations in dealing with revenge porn. This study aims to analyze the effectiveness of law enforcement against revenge porn in Indonesia and provide recommendations for improving regulations to increase victim protection. The method used is normative legal research with a statutory and comparative approach, which involves analyzing national and international regulations, as well as reviewing court decisions and reports from various institutions. The results show that Indonesian regulations still have gaps in dealing with revenge porn, especially in the aspects of victim protection, content removal mechanisms, and sanctions for perpetrators and digital platforms. Therefore, more progressive legal reforms are needed, including the implementation of the right to be forgotten, increasing sanctions for perpetrators.

Abstract

The development of information and communication technology has created a new space for interaction through digital media, bringing not only benefits but also various forms of cybercrime, one of which is cyberbullying. This phenomenon is increasingly complex when carried out through social engineering techniques, namely the psychological manipulation of victims to obtain information, instill fear, or pressure them mentally and socially. Social engineering-based cyberbullying not only impacts the victim's psychological aspects but also causes social, reputational, and even economic losses. This article aims to analyze the forms of cyberbullying that use social engineering and examine the legal protections available to victims within the cyber law framework in Indonesia. The research method used is normative legal research with a statutory and conceptual approach, which examines related regulations, such as the Electronic Information and Transactions Law, the Criminal Code, and other relevant regulations. The results of the study indicate that although positive legal instruments have provided a basis for protection for victims of cyberbullying, regulations related to social engineering are still implicit and have not been specifically regulated. Therefore, it is necessary to strengthen regulations, improve digital literacy, and adopt an integrated preventive and repressive approach to ensure effective legal protection for victims of cyberbullying in the digital era.

Abstract

Pembaruan hukum pidana di Indonesia, telah memasuki babak baru dengan disahkannya Undang-Undang Nomor 1 Tahun 2023 (KUHP Baru) dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Penelitian ini bertujuan untuk menganalisis secara mendalam implikasi dari kedua regulasi tersebut, terhadap penegakan hukum pidana di sektor kesehatan, khususnya terkait delimitasi antara risiko medis dan kelalaian pidana. Metode yang digunakan adalah kualitatif dengan pendekatan studi pustaka (library research). Hasil penelitian menunjukkan bahwa integrasi prinsip keadilan restoratif (restorative justice) dalam UU Kesehatan terbaru, memberikan perlindungan hukum yang lebih seimbang bagi tenaga medis melalui mekanisme mediasi sebelum memasuki ranah peradilan. Tetapi, proses sinkronisasi operasional dengan KUHP Baru masih menghadapi tantangan pada aspek pembuktian unsur kelalaian (culpa). Artikel ini merekomendasikan adanya pedoman teknis yang lebih rigid bagi aparat penegak hukum, untuk menghindari kriminalisasi profesi medis tanpa mengabaikan hak konstitusional pasien atas keselamatan.
