Abstract

This study aims to evaluate the effectiveness of digital contract law in mitigating e-commerce business risks in Indonesia’s digital economy, focusing on three local platforms (XYZ, ABC, DEF) from January to November 2024. Using a qualitative case study approach, data were collected through semi-structured interviews with 15 business actors (UMKM owners, platform managers, and legal practitioners) and analysis of regulatory documents (Electronic Information and Transaction Law, PDP Law). Thematic analysis via NVivo 12 revealed that 70% of platforms lack explicit personal data protection clauses, while 85% of MSMEs use generic contract templates, increasing legal disputes by 40%. Cybersecurity challenges were exacerbated by low budget allocation (5% of revenue), leading to vulnerabilities in 3 out of 10 MSMEs. The study recommends: (1) AI-based regulatory education platforms for MSMEs, (2) standardized digital contract guidelines with mandatory cyber-risk clauses, and (3) fiscal incentives for cybersecurity investment. These findings contribute to legal theory by bridging the gap between normative frameworks and practical risk management, while offering actionable strategies for policymakers and businesses to enhance transactional security and compliance..

Abstract

Penelitian ini bertujuan untuk mengetahui pengaruh kompensasi dan disiplin kerja terhadap kinerja karyawan pada PT Pramesta Baja Utama Jatake Kabupaten Tangerang. Metode penelitian yang digunakan adalah kuantitatif dengan jumlah sampel 67 responden. Analisis data meliputi uji validitas, reliabilitas, asumsi klasik, regresi linier berganda, koefisien korelasi, determinasi, dan uji hipotesis. Hasil penelitian menunjukkan bahwa kompensasi berpengaruh positif dan signifikan terhadap kinerja karyawan. Disiplin kerja juga berpengaruh positif dan signifikan terhadap kinerja karyawan. Secara simultan kompensasi dan disiplin kerja berpengaruh signifikan terhadap kinerja karyawan. Dengan demikian, ketiga hipotesis diterima. Temuan ini menunjukkan pentingnya kompensasi yang memadai dan disiplin kerja yang baik dalam meningkatkan kinerja karyawan di perusahaan.

Abstract

Penelitian ini bertujuan untuk mengoptimalkan kompetensi akuntansi dan manajerial mahasiswa STIE Ganesha melalui penerapan metode mind mapping guna meningkatkan kesiapan karier di era global. Kompetensi akuntansi dan manajerial merupakan kemampuan esensial bagi mahasiswa bidang ekonomi dan bisnis dalam memahami proses bisnis serta mendukung pengambilan keputusan secara efektif. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Pengumpulan data dilakukan melalui wawancara mendalam, observasi, dan dokumentasi terhadap mahasiswa yang mengikuti kegiatan pelatihan dan pendampingan berbasis mind mapping. Hasil penelitian menunjukkan bahwa penerapan mind mapping mampu meningkatkan pemahaman konseptual, kemampuan analisis, dan kepercayaan diri mahasiswa dalam mengintegrasikan konsep akuntansi dan manajerial. Selain itu, metode ini mendorong terciptanya proses pembelajaran yang lebih aktif, sistematis, dan aplikatif. Dengan demikian, mind mapping dapat direkomendasikan sebagai metode pembelajaran strategis yang relevan dan berkelanjutan untuk diterapkan dalam pembelajaran akuntansi dan manajemen di perguruan tinggi.

Abstract

The increasing volume of goods and services transactions in South Tangerang City, in line with the growth of the trade and service sectors, has led to a higher potential for consumer disputes. These disputes generally relate to product non-conformity, services that disadvantage consumers, and the suboptimal fulfillment of consumer rights. Dispute resolution through litigation is often considered less effective due to the time, cost, and complex procedures involved. Therefore, non-litigation consumer dispute resolution mechanisms have become an important alternative in ensuring the protection of consumer rights in a manner that is fast, simple, and equitable. However, the implementation of non-litigation mechanisms in South Tangerang City still faces various challenges, including institutional limitations, low levels of public legal literacy, and issues related to practical effectiveness. This study aims to: (1) analyze the implementation of non-litigation consumer dispute resolution mechanisms in protecting consumer rights; (2) identify the obstacles encountered in their implementation; and (3) formulate strategies to strengthen these mechanisms to enhance their effectiveness. This research employs an empirical juridical approach with a descriptive-analytical design. Data were collected through literature review and field research, including interviews and observations involving relevant stakeholders and consumers who have experienced disputes. The data were analyzed qualitatively to provide a comprehensive understanding of the implementation of non-litigation dispute resolution mechanisms. The findings indicate that non-litigation mechanisms have not yet operated optimally due to limited public awareness, institutional constraints, and insufficient dissemination of information. Nevertheless, these mechanisms hold significant potential to improve access to justice if strengthened through enhanced legal literacy, institutional capacity, and more effective implementation at the local level.
