Abstract

Artikel ini menganalisis secara kritis efektivitas penegakan hukum bisnis di Indonesia dengan menitikberatkan pada kapasitas kelembagaan dan konsistensi regulasi dalam penyelesaian sengketa. Berdasarkan pendekatan normatif-sosiolegal, studi ini mengidentifikasi bahwa kelemahan institusional, tumpang tindih yurisdiksi, serta ambiguitas prosedural secara signifikan menghambat kepastian hukum dan mereduksi kepercayaan investor. Melalui pemetaan regulasi, analisis indikator kelembagaan, serta studi kasus pasca-implementasi Omnibus Law, ditemukan bahwa inkonsistensi antar rezim hukum (perdata, komersial, investasi) memperburuk fragmentasi kebijakan dan memperbesar risiko forum shopping. Studi ini merekomendasikan pembentukan kamar pengadilan niaga yang terintegrasi dengan mekanisme ADR, kodifikasi terpadu atas prosedur penyelesaian sengketa, dan penguatan kapasitas hakim serta arbiter melalui pelatihan dan teknologi. Temuan ini menjadi dasar untuk reformasi hukum komersial yang lebih adaptif, prediktabel, dan selaras dengan praktik internasional dalam menjamin iklim investasi yang kondusif.

Abstract

The increasing number of children facing the law in Indonesia indicates that the repressive legal approach has not been fully effective in addressing juvenile crime. Children, as subjects of law, have social and psychological characteristics that differ from adults, so law enforcement against them must consider humanitarian and educational aspects. This research aims to analyze the factors causing children to commit criminal acts and formulate a model for addressing them based on developing a legal culture rooted in Pancasila values. This research employs a normative juridical method with conceptual and legislative approaches, and analyzes data qualitatively thru literature review and positive legal norms. The research findings indicate that the causes of children committing criminal acts are multidimensional, encompassing family factors, social environment, education, economics, and psychological factors. Therefore, mitigation efforts cannot be done partially, but must be thru a preventive, educational, and restorative approach. This research offers a model for overcoming challenges thru the development of a legal culture based on five main pillars: family, education, society, the state, and the legal system. This model emphasizes the importance of synergy between law enforcement and moral development in accordance with the values of Divinity, Humanity, Unity, Deliberation, and Social Justice. Thus, the development of Pancasila legal culture is expected to realize a child criminal justice system that is humanistic, substantively just, and oriented toward social rehabilitation in accordance with the legal ideals of a Pancasila state of law.

Abstract

The development of social media has given rise to the phenomenon of digital challenges, which in practice are not only entertaining but also have the potential to cause accidents, serious injuries, and even death. This condition raises legal issues regarding the criminal liability of both the creators and disseminators of dangerous content on social media. This research aims to analyze criminal liability for perpetrators of social media challenge content that causes accidents and to examine the problems of law enforcement and criminal law policy regarding harmful content in the digital space. The research uses a normative juridical method with a legislative approach and a conceptual approach thru the analysis of Law Number 1 of 2023 on the Criminal Code, Law Number 1 of 2024 on the Second Amendment to the Electronic Information and Transactions Law, as well as other related regulations. The research results show that criminal liability for social media challenge content creators can be constructed thru provisions regarding negligence, criminal participation, and the dissemination of electronic information that harms the public. However, law enforcement still faces various obstacles, such as the absence of specific regulations regarding harmful content, difficulties in proving causal relationships, and weak supervision of digital platforms. Therefore, there is a need for an update to the criminal law policy that is more adaptive and comprehensive in order to provide legal protection to society in the digital era.

Abstract

Legal awareness is an important aspect in shaping a child's character and preventing the emergence of various forms of delinquency that can lead to legal issues. However, there are still many children who do not understand their rights, obligations, or the legal consequences of their actions. This condition is also found among the children under the care of the Aldyan Citra Insania Foundation, who still have limited understanding of child protection and the Juvenile Criminal Justice System (SPPA). Therefore, this community service activity aims to raise legal awareness among the children in the foundation's care, the foundation's management, and volunteers thru legal counseling and assistance regarding child protection and the Juvenile Criminal Justice System. The method used is a participatory approach with stages of observation, partner needs identification, legal counseling, interactive discussions, consultation, mentoring, and evaluation. The material provided includes legal awareness, children's rights and obligations, child protection, forms of juvenile delinquency along with their legal consequences, as well as mechanisms for resolving juvenile cases thru diversion and restorative justice. The results of the activity show an increase in participants' understanding of the material presented, a heightened concern for child protection, and an improvement in the foundation's administrators' ability to mentor the children in their care. In addition, this activity encourages the growth of a shared commitment to creating a safe, child-friendly environment free from various forms of violence. Legal counseling and assistance provided have proven to be effective means in raising legal awareness while simultaneously strengthening the foundation's capacity to conduct ongoing child guidance and protection.
