Abstract

This study aimed to analyse a shifting paradigm of Dominus Litis (judge activeness) in the Indonesian state administrative justice. This principle emphasises that judges expand the paradigm that judges are not limited to being used in processes regulated in law. However, judges need to actively develop the paradigm to make legal discoveries oriented towards substantive justice and expand the paradigm from merely resolving disputes positivistically to resolving conflicts with paradigms. Legal realism and sociological jurisprudence to create substantive justice. This paper uses the normative research method, with a statutory approach and case approach by analysing two decisions of state administrative court judges. The result showed that Dominus Litis in the dispute's accomplishment is not limited to the implementation of juridical-legal positivism factors, but on how judges use their mindset to provide ideal decisions and conduct legal reasoning use socio-legal and socio-cultural paradigms. The development of demands for justice has also experienced a paradigm shift of justice. It requires the principle of an active judge who always follows developments in public policy, such as the principle of sustainable development related to environmental and natural resource issues, and finding the legal material truth.

Abstract

The development of the current flow of law in Indonesia in the context of law enforcement is unquestionably still evident in the application of positivism in law enforcement, which, of course, with the application of legal positivism is enforced the law that is more important, if one considers that the philosophical goal of the law is the creation of justice, and so on. This is a declaration of Pancasila values in law enforcement in the Indonesian state. In some instances, it appears that the flow of positivism continues to exert a strong influence on law enforcement in Indonesia, which, of course, can affect the values of justice in law enforcement. As stated in Article 24 paragraph 1 of the Constitution of the Republic of Indonesia, in order to realize the Indonesian state as a rule of law, both law enforcement and justice must be properly enforced in the context of judicial power.

Abstract

BUMDes Janti Jaya is a village-owned business entity located in Janti Village, Polanharjo District, Klaten Regency. If supervised and managed properly, all profits generated by BUMDES Janti Jaya can have a significant impact on the welfare of the community in Janti Village. However, in reality, the management of BUMDes in Janti Village has not met the basis of the principles of BUMDes management, namely the lack of participatory attitude from the community. In order to improve the management of BUMDes Jaya Janti, especially in terms of asset management, the Service Team held socialization related to this. This service activity was carried out by the lecture method to provide knowledge to the community about the urgency of BUMDes in the economic growth of the community. As a result, the implementation of service by lecturers at the Faculty of Law, Universitas Sebelas Maret (UNS) has had a significant positive impact on the management and preparation of BUMDes financial statements.

Abstract

Artikel ini menganalisis secara kritis efektivitas penegakan hukum bisnis di Indonesia dengan menitikberatkan pada kapasitas kelembagaan dan konsistensi regulasi dalam penyelesaian sengketa. Berdasarkan pendekatan normatif-sosiolegal, studi ini mengidentifikasi bahwa kelemahan institusional, tumpang tindih yurisdiksi, serta ambiguitas prosedural secara signifikan menghambat kepastian hukum dan mereduksi kepercayaan investor. Melalui pemetaan regulasi, analisis indikator kelembagaan, serta studi kasus pasca-implementasi Omnibus Law, ditemukan bahwa inkonsistensi antar rezim hukum (perdata, komersial, investasi) memperburuk fragmentasi kebijakan dan memperbesar risiko forum shopping. Studi ini merekomendasikan pembentukan kamar pengadilan niaga yang terintegrasi dengan mekanisme ADR, kodifikasi terpadu atas prosedur penyelesaian sengketa, dan penguatan kapasitas hakim serta arbiter melalui pelatihan dan teknologi. Temuan ini menjadi dasar untuk reformasi hukum komersial yang lebih adaptif, prediktabel, dan selaras dengan praktik internasional dalam menjamin iklim investasi yang kondusif.
