Abstract

Immigration law enforcement has undergone significant developments in line with social, political, and technological changes. In the era of the Golden Generation 2045, new challenges arise along with demographic changes and increasingly complex global dynamics. This paper examines how immigration law enforcement and oversight are evolving by analyzing changes and the impact of technological developments, economic growth, the environment, and long-term approaches to improving law enforcement efficiency. It also explores efforts to achieve a balance between firm law enforcement and policies that respect human rights, and their impact on immigration law enforcement. This article aims to provide insight into the role of immigration law enforcement in the era of the Golden Generation 2045 and its implications for an increasingly connected global society.

Abstract

Perbatasan negara menghadapi tekanan meningkat dari migrasi ilegal, perdagangan orang, dan kejahatan lintas batas, sehingga intelijen keimigrasian perlu bertransformasi dari sekadar administratif menjadi sistem deteksi dini yang adaptif dan terintegrasi. Penelitian ini bertujuan menganalisis peran deteksi dini dalam intelijen keimigrasian Indonesia melalui perspektif intelligence cycle untuk mengidentifikasi faktor penyebab keterlambatan pengawasan/penindakan dan merumuskan strategi penguatan berbasis risiko. Metode yang digunakan adalah kualitatif-deskriptif dengan studi pustaka, memanfaatkan data sekunder (jurnal bereputasi, laporan lembaga pemerintah dan internasional, regulasi, serta buku), dianalisis melalui analisis tematik dan model interaktif Miles–Huberman, dengan kerangka collection–processing–analysis–dissemination (McDowell). Hasil menunjukkan hambatan utama pada sinkronisasi data pusat-daerah dan antarinstansi, keterbatasan kapasitas SDM dan pemanfaatan teknologi analitik, serta rendahnya pemanfaatan produk intelijen dalam pengambilan keputusan, yang bersama-sama menurunkan kecepatan peringatan operasional. Implikasinya, penguatan intelijen menuntut integrasi sistem informasi nasional real-time, pelatihan strategic intelligence, revitalisasi TIM PORA, dan adopsi risk-based intelligence agar deteksi dini lebih responsif terhadap dinamika ancaman global.

Abstract

This study examines the misuse of visit stay permits by foreign nationals from the perspective of Indonesian immigration law, focusing on a case involving 17 Vietnamese nationals working at a cosmetic surgery clinic. Occurring between 2018 and 2025, this case drew significant attention due to the violation of immigration regulations, as the individuals were engaged in activities that did not align with the purpose of their permitted stay. The aim of this research is to analyze how immigration law enforcement was applied in this case and to formulate preventive legal measures to avoid similar violations in the future. The research adopts a normative-empirical method with a qualitative approach. Data was collected through legal literature, academic journals, and other supporting documents, which were then analyzed normatively. This study emphasizes the importance of legal substance and institutional structure in the imposition of administrative sanctions for immigration violations. The case of the 17 Vietnamese nationals serves as a critical reference point in evaluating the effectiveness and fairness of immigration law enforcement on the ground. The findings reveal that the effectiveness of administrative sanctions in cases of permit misuse is influenced by five key factors: the clarity of applicable laws, the competence of law enforcement officials, the availability of supporting infrastructure, and public participation. Therefore, it is essential to implement sanctions that are not only legally appropriate but also capable of delivering a strong deterrent effect. The recommendations from this study are expected to contribute to the development of more responsive immigration policies and better prevention of future violations.

Abstract

Education is a fundamental right guaranteed to every child, including refugee children in Indonesia. Although Indonesia has ratified the Convention on the Rights of the Child (UNCRC) and issued national policies supporting access to education for refugees, implementation still faces various challenges. According to UNHCR data at the end of 2023, there were 12,295 registered refugees in Indonesia, including 3,555 children, of whom 227 were unaccompanied by parents or relatives and 106 were separated from their families, making them the most vulnerable group in terms of fulfilling their right to education. This study aims to analyse the gap between government regulations and the reality of implementing basic education for refugee children in Indonesia. The method used is a qualitative descriptive approach with a documentary study technique on circular letters from the Ministry of Education, Culture, Research, and Technology, UNHCR reports, KPAI data, and other relevant publications. The results of the study show that although regulations such as the Secretary General of Kemendikbudristek Circular Letter No. 75253/A.A.4/HK/2019 have established mechanisms for providing education for refugee children, in reality only a small proportion of children have access to formal education. Out of 1,595 school-age children registered as of 2022, only 646 have accessed formal education, either in public or private schools. The main obstacles include administrative challenges, limited school capacity, lack of budgetary support from the state or local budgets, and insufficient readiness of communities and educational institutions to accept refugee children. Therefore, more technical operational policies, enhanced capacity of educational institutions, and inter-institutional coordination are needed to truly realise inclusive and equitable basic education.
