Abstract

Transnational crime, particularly Trafficking in Persons (TPPO), poses a serious threat to national security due to globalization and the ease of cross-border movement. Indonesia's geographical position as an archipelagic state makes it highly vulnerable to this form of modern slavery. This research aims to analyze the vital role of immigration supervision at the border in combating TPPO from a criminological perspective. The research method is qualitative with a normative juridical approach, utilizing a literature study of relevant laws and literature. The results indicate a strong correlation between weak immigration supervision and the rise of TPPO. Indonesia has a legal foundation through its Immigration Law (UU No. 6/2011), Anti-Trafficking in Persons Law (UU No. 21/2007) , and the ratification of the UN Convention Against Transnational Organized Crime. Operationally, countermeasures include administrative and field supervision, the establishment of the "Kresna" Intelligence Team, and synergy within the Customs, Immigration, and Quarantine (CIQ) system. From a criminological aspect, crime prevention is paramount. It is concluded that strengthening border supervision is imperative. Recommendations include enhancing inter-agency cooperation, utilizing technology, increasing the capacity of officials, and strengthening international cooperation to dismantle criminal networks.

Abstract

Era globalisasi saat ini, mobilitas lintas negara semakin mudah dilakukan. Sayangnya, kemudahan ini juga membuka celah bagi maraknya kejahatan terorganisir lintas negara (Transnational Organized Crime/TOC), salah satunya lewat praktik eksploitasi tenaga kerja WNI di industri judi ilegal di Kamboja. Penelitian ini bertujuan untuk mengulas bagaimana keimigrasian Indonesia berperan dalam melindungi WNI dari ancaman tersebut. Dengan menggunakan metode studi pustaka, penelitian ini menggali berbagai sumber informasi, termasuk kebijakan, laporan internasional, dan data terkini. Hasil kajian menunjukkan bahwa WNI kerap menjadi korban karena lemahnya penegakan hukum, pemalsuan dokumen perjalanan, serta terbatasnya edukasi tentang migrasi aman. Sementara itu, tantangan di lapangan bagi petugas imigrasi tidaklah mudah: keterbatasan sumber daya, modus perekrutan yang makin canggih, hingga kurangnya koordinasi antarnegara. Namun, berbagai langkah telah dilakukan, seperti memperkuat kerja sama bilateral, memberikan edukasi publik, memperbaiki regulasi, serta meningkatkan pelatihan bagi aparat penegak hukum. Penelitian ini menyimpulkan bahwa pendekatan menyeluruh dan kolaboratif menjadi kunci dalam melindungi WNI dari jeratan TOC yang bersembunyi di balik industri judi Kamboja.

Abstract

Transnational Organised Crime (TOC) is a complex crime because it involves actors from several countries and has a structured mechanism. One case that is currently rife is Indonesian citizens (WNI) who are victims of TOC behind the gambling industry in Cambodia. This happens because they are tempted by high salaries and lack of literacy about opportunities to work abroad. In reality, they do not work as expected, they are exploited and work under threat. Therefore, there is a need for prevention by the government so that these crimes do not happen again. One of the agencies that has the authority to prevent such crimes is immigration. Immigration can prevent people from leaving Indonesian territory for administrative or state security reasons. It is expected that the immigration function can be implemented optimally so that Indonesian citizens do not become victims of exploitation abroad. So that national security and citizen protection are maintained.

Abstract

Education is a fundamental right guaranteed to every child, including refugee children in Indonesia. Although Indonesia has ratified the Convention on the Rights of the Child (UNCRC) and issued national policies supporting access to education for refugees, implementation still faces various challenges. According to UNHCR data at the end of 2023, there were 12,295 registered refugees in Indonesia, including 3,555 children, of whom 227 were unaccompanied by parents or relatives and 106 were separated from their families, making them the most vulnerable group in terms of fulfilling their right to education. This study aims to analyse the gap between government regulations and the reality of implementing basic education for refugee children in Indonesia. The method used is a qualitative descriptive approach with a documentary study technique on circular letters from the Ministry of Education, Culture, Research, and Technology, UNHCR reports, KPAI data, and other relevant publications. The results of the study show that although regulations such as the Secretary General of Kemendikbudristek Circular Letter No. 75253/A.A.4/HK/2019 have established mechanisms for providing education for refugee children, in reality only a small proportion of children have access to formal education. Out of 1,595 school-age children registered as of 2022, only 646 have accessed formal education, either in public or private schools. The main obstacles include administrative challenges, limited school capacity, lack of budgetary support from the state or local budgets, and insufficient readiness of communities and educational institutions to accept refugee children. Therefore, more technical operational policies, enhanced capacity of educational institutions, and inter-institutional coordination are needed to truly realise inclusive and equitable basic education.
