Abstract

Penelitian ini membahas kedudukan dan perlindungan hukum anak yang lahir di luar perkawinan berdasarkan Putusan Nomor 109/PDT/2022/PT BTN. Metode yang digunakan adalah yuridis normatif dengan pendekatan kasus dan konseptual melalui studi kepustakaan serta analisis data menggunakan metode Miles & Huberman. Hasil penelitian menunjukkan bahwa NKT diakui sebagai anak biologis dari RAD (Tergugat) dan WAK (Penggugat), berhak mendapatkan hak asuh dari keduanya, dibuktikan melalui kesaksian dan tes DNA. Perlindungan hukum terhadap NKT merujuk pada UU No. 4 Tahun 1979 dan UU No. 23 Tahun 2002, yang mencakup hak atas kesejahteraan, perawatan, pendidikan, perlindungan, pelayanan sosial, dan bantuan sesuai prinsip perlindungan anak di Indonesia.

Abstract

This research aims to analyze the criminal liability of perpetrators of fraud through bounced checks and the legal protection provided to victims. The study focuses on Decision Number 1698/Pid.B/2022/PN Sby, in which the defendant was found guilty of fraud under Article 378 of the Indonesian Criminal Code (KUHP). Using a normative juridical approach through literature study with statutory and conceptual approaches, the findings demonstrate that the panel of judges correctly applied the elements of fraud, including malicious intent (mens rea), the use of deception or a series of lies, and actual loss suffered by the victim. The judge's legal considerations have reflected the principles of legality, justice, and legal certainty in criminal law. Legal protection for victims can be pursued through both criminal and civil legal remedies, where victims may report to police for criminal prosecution under Article 378 KUHP and claim compensation through civil breach of contract lawsuits. Law enforcement against perpetrators is carried out through repressive and preventive criminal sanctions. This decision confirms that bounced check fraud is not merely a civil breach of contract but can be classified as a criminal offense when accompanied by malicious intent to deceive others.

Abstract

Overlapping land rights disputes between historical evidence claims and modern administrative registration trigger complex legal uncertainty in Indonesia. This study aims to analyze the implementation of the rechtmatigheid principle by the Supreme Court in Decision Number 281 K/TUN/2023 regarding the cancellation of Building Use Rights Certificates based on Article 30 paragraph (1) letter c of PP No. 24 of 1997, as well as to dissect the judge's considerations in rejecting the Judicial Review in Decision Number 124 PK/TUN/2024. The research method used is normative legal research with a statute approach and a case approach. The results of the study indicate that the Supreme Court prioritizes the value of procedural legal certainty (Rechtssicherheit) over the material claims of individuals who neglect to use the 90-day deadline for filing a lawsuit after a deadlocked mediation, in line with the doctrine of vigilantibus non dormientibus iura subveniunt. The definitive rejection of the application for Judicial Review is based on the failure to fulfill the criteria of decisive novum (new, decisive evidence) as regulated in a restrictive manner in SEMA Number 2 of 2019. The conclusion of the study confirms that the validity of certificates in the land administration system is highly dependent on the integration between compliance with official procedures and the vigilance of legal subjects in defending their rights.
