Abstract

Digital transformation has created significant opportunities in supporting societal activities; however, it also poses serious threats to data security and personal data protection. Indonesia has faced various data breach cases that reveal the weaknesses of the legal system in providing effective protection. Normatively, the Indonesian Civil Code (KUHPerdata) does not explicitly regulate personal data, while a new regulatory framework was only introduced through Law Number 27 of 2022 on Personal Data Protection (PDP Law). This research aims to analyze personal data protection from a civil law perspective, examine the challenges in implementing the PDP Law, and assess the relevance of classical civil law principles within the digital context. The research employs a normative legal method with statutory, conceptual, and comparative approaches. The findings indicate that personal data protection still encounters obstacles such as low public awareness, limited legal infrastructure, and conflicting interests among the state, corporations, and individuals. Therefore, strengthening civil law instruments to be more adaptive, ensuring consistent implementation of the PDP Law, and renewing civil law doctrines are necessary to remain relevant to the dynamics of digital technology.

Abstract

Interfaith marriage remains a complex legal issue in Indonesia, particularly when conducted abroad by Indonesian citizens. The Indonesian legal framework, primarily governed by Law No. 1 of 1974 on Marriage, does not explicitly recognize or regulate interfaith marriages, leading many couples to solemnize their unions overseas to circumvent domestic legal constraints. This practice raises crucial questions about the legal recognition, registration, and civil implications of such marriages within the Indonesian legal system. Despite increasing global mobility and pluralistic societies, existing scholarship largely focuses on interfaith marriage from a domestic perspective, leaving a gap in understanding transnational legal challenges. This study aims to provide a comprehensive juridical analysis of interfaith marriages involving Indonesian citizens abroad by examining their validity, registration mechanisms, and implications on citizenship, inheritance, and family status under Indonesian law. By comparing international practices and highlighting legal inconsistencies, the study offers policy recommendations to enhance legal clarity and protection. The novelty lies in addressing the transnational dimension of interfaith marriages—a subject rarely explored in-depth within Indonesian legal scholarship—thus contributing to the reform of family law in a globalized context.
