Abstract

Kasus Churchill Mining PLC dan Planet Mining Pty Ltd vs Pemerintah Indonesia di ICSID menjadi salah satu sengketa investasi internasional terbesar yang melibatkan Indonesia. Investor asing menuduh pencabutan izin pertambangan di Kutai Timur sebagai bentuk ekspropriasi yang melanggar TBI Indonesia–Inggris 1976 dan Indonesia–Australia 1992, dengan tuntutan kompensasi lebih dari USD 2 miliar. Namun, Pemerintah Indonesia berhasil membuktikan bahwa izin yang dipakai investor cacat hukum karena diperoleh melalui dokumen palsu. Majelis arbitrase ICSID menolak seluruh klaim tersebut pada 2016. Analisis ini menunjukkan bahwa prinsip perlindungan dalam TBI tidak mutlak, melainkan hanya berlaku bagi investasi yang sah dan beritikad baik. Kemenangan Indonesia juga memperkuat kedaulatan negara dalam forum arbitrase internasional serta mendorong lahirnya kebijakan investasi baru yang lebih seimbang antara perlindungan investor asing dan kepentingan nasional.

Abstract

In e-commerce, there are often cases where customers are not satisfied with COD (Cash on Delivery) packages. Problems that often occur include delivery delays, lost packages, discrepancies between orders and products received, and difficulty canceling orders if there are problems or errors in delivery. Customers who experience COD delivery problems may lose trust in the seller and the e-commerce platform. Therefore, sellers and e-commerce platforms should ensure timely delivery of cash-on-delivery parcels in line with customer expectations, and resolve issues quickly and efficiently when they arise. By doing so, customer trust can be maintained and COD services can be used in the future. Keywords: e-commerce; selling shop
