Abstract

This research analyzes the regulations regarding the right to control official houses on state land based on positive law in Indonesia. The research method used is descriptive-analytic, with thorough data disclosure and explanation as the basis for discussion. The law is reviewed using relevant legal theories and regulations, with descriptive-analytic research as the writing approach. The analysis results explain that state or regional property required to implement government duties cannot be transferred without permission from the Indonesian Regional Representative Council or the Provincial Regional Representative Council. The conclusion is that state or regional property transfer can be done through sale, exchange, donation, or addition as government capital. Still, giving state or regional property to pay off debts with national or regional authorities is prohibited. In addition, granting pledges or utilizing state or regional property as collateral for loans is not allowed. Government regulations set technical and administrative standards for managing state and local property. Keywords: juridical analysis, office house, tenure right

Abstract

Studi ini mengkaji kritik terhadap ketergantungan Indonesia pada KUHPerdata kolonial yang dinilai tidak lagi relevan dalam menghadapi dinamika sosial, ekonomi, dan teknologi modern. Sebagai hukum warisan abad ke-19, KUHPerdata tidak mampu merespons isu kontemporer seperti perlindungan data pribadi, perkembangan e-commerce, fintech, dan mekanisme penyelesaian sengketa modern. Penelitian ini bertujuan mengidentifikasi kelemahan mendasar KUHPerdata kolonial, menelaah dampaknya terhadap kepastian hukum dan keadilan, serta merumuskan rekomendasi reformasi hukum perdata yang lebih adaptif dan responsif. Dengan menggunakan metode penelitian yuridis normatif melalui pendekatan perundang-undangan, pendekatan konseptual, dan analisis doktrinal, penelitian ini menemukan bahwa revisi komprehensif terhadap KUHPerdata sangat mendesak untuk mewujudkan sistem hukum perdata yang modern, berkeadilan, dan sesuai kebutuhan masyarakat Indonesia. Hasil penelitian menegaskan perlunya harmonisasi regulasi, pembentukan regulasi khusus terkait data pribadi, penguatan mekanisme penyelesaian sengketa alternatif, serta peningkatan kapasitas penegak hukum sebagai bagian dari agenda besar reformasi hukum perdata nasional.

Abstract

This paper analyses the Family Planning Programme (KB) in Indonesia through the perspective of Economic Analysis of Law (EAH) developed by Richard A. Posner, with a focus on legal efficiency in internalising demographic externalities and maximising social wealth. This study uses a legal-economic approach, combining normative legal research methods with economic analysis of public policy, particularly Law No. 52 of 2009 on Population Development and Family Development, Government Regulation No. 87 of 2014 concerning Population Development and Family Development, Family Planning and Family Information Systems, and Presidential Regulation No. 72 of 2021 on Accelerating Stunting Reduction. The results show that family planning policies are legal interventions that meet the Kaldor–Hicks efficiency criteria, as their social benefits, such as a decrease in the total fertility rate (TFR), increased female economic participation, and the creation of a demographic bonus, aggregate to exceed their implementation costs. However, inefficiencies still occur due to increased transaction costs and unmet needs, which reflect market failures and bureaucratic constraints. The analysis shows that the 2025 fiscal efficiency policy, which cuts the budget for contraceptive procurement, has the potential to cause greater social deadweight loss in the future. Therefore, it is recommended that family planning policies be directed towards long-term efficiency through budget protection based on incremental cost-effectiveness ratio (ICER), reduction of transaction costs, and strengthening of access rights to family planning services.
