Abstract

ABSTRACT This research explains how restorative justice based on local wisdom in the Banjar society and how criminal cases can be resolved effectively through restorative justice based on local wisdom. This research is a normative legal research that uses a conceptual approach to explain the data used in the content analysis method. The results show that restorative justice based on local wisdom or what is called the practice of beendam is an effective mechanism in resolving criminal cases in the Banjar region. However, the problem is that there are still many people who have not applied the badamai custom as a solution beyond the initial stage of criminal cases in the Banjar community. This research also shows that the local wisdom-based restorative justice method in Banjar society brings together perpetrators and victims and allows dialogue to achieve a win-win solution, therefore this local wisdom-based restorative justice demonstrates by upholding family values. ABSTRAKPenelitian ini menerangkan bagaimana restorative justice berbasis kearifan lokal pada masyarakat Banjar dan bagaimana kasus pidana dapat diselesaikan secara efektif melalui restorative justice berbasis kearifan lokal. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan conceptual approach untuk menjelaskan data yang digunakan dalam metode content analysis. Hasil penelitian menunjukkan bahwa restorative justice berbasis kearifan lokal atau yang disebut praktik beendam merupakan mekanisme yang efektif dalam menyelesaikan perkara pidana di wilayah Banjar. Namun permasalahannya masih banyak masyarakat yang belum menerapkan adat badamai sebagai solusi di luar tahap awal kasus pidana pada masyarakat banjar. Penelitian ini juga menunjukkan bahwa metode restorative justice berbasis kearifan lokal pada masyarakat Banjar mempertemukan pelaku dan korban serta memungkinkan adanya dialog untuk mencapai win-win solution, oleh karena itu restorative justice berbasis kearifan lokal ini menunjukkan dengan menjunjung tinggi nilai-nilai kekeluargaan.

Abstract

The naming of food is very influential on public interest in food products, the sellers compete to provide attractive names that describe the taste of the food. However, many of the sellers do not know the law of naming a food with negative things like the word "devil". It is the aim of this study to review why this is prohibited and whether people are aware of the law on naming food with the word "satan". The method used in this study is a qualitative descriptive method, namely the source of the discussion is obtained from zinterviews and literature studies. From the results of this study it can be concluded that the naming of food with bad words such as "satan" is prohibited because it has a negative meaning, except for food names that have become a tradition ('urf) with the condition that they do not contain haram ingredients. Abstract

Abstract Positive law and Islamic law have different views on the use of speed limiting devices, positive law clearly regulates the use of speed limiting devices of various kinds up to the authority of the user, whereas in Islamic law it is not regulated clearly and in writing, Islamic law is only based on the Al-Qur'an and Al-Hadith that humans are prohibited from interfering with fellow humans, and roads have rights that must be fulfilled as well as prohibitions against interfering with the rights of the road and its users, let alone obstructing and causing harm to road users. The type of research that will be used in this research is descriptive normative legal research using a comparative approach, which focuses on the study of Islamic law and positive law by examining Islamic regulations and books, especially the Minister of Transportation's regulations regarding road barrier and safety devices and books. fiqh as material for analysis. The results of this research are that speed limiting devices are legally positive and valid with complex and detailed regulations. The latest Minister of Transportation Regulation No. 43 of 2023 states that speed limiting devices are divided into 3 types, Speed ​​Bump, Speed ​​Hump and Speed ​​Table, as well as with road categories and predetermined v shapes. Speed ​​limiting devices according to Islamic law are not discussed in detail and in writing, Islamic law only states that rights of way must be respected, one of which is that the road must not be obstructed, so in general speed limiting devices are prohibited. Ulama mention the same thing in the form of dakah, there are differences of opinion regarding the use of dakah, Imam Nawawi and Imam Rafi'i forbid it, while Ibn Hajar Al-Haitami and Ibnu Rafi'ah allow it as long as it does not cause potential disturbances. Keywords: Speed ​​Limiting Devices, Islamic Law, Positive Law Abstrak Hukum positif dan hukum Islam memiliki pandangan berbeda dalam penggunaan alat pembatas kecepatan, hukum positif mengatur secar jelas penggunaan alat pembatas kecepatan macam sampai kewenangan penggunanya, sedangkan dalam hukum Islam tidak di atur secara jelas dan tertulis, hukum Islam hanya berpatokan dengan Al-Qur’an dan Al-Hadist bahwa manusia dilarang mengganggu sesama manusia, dan jalan memiliki hak yang harus dipenuhi serta larangan untuk mengganggu hak jalan dan penggunanya apalagi menghalang-halangi serta memberikan mudharat terhadap pengguna jalan. Jenis penelitian yang akan digunakan dalam penelitian ini adalah penelitian hukum normatif bersifat deskriptif melalui pendekatan komparatif, yang berfokus terhadap kajian hukum Islam dan hukum positif dengan menelaah peraturan dan buku-buku Islam, terutama peraturan mentri perhubungan tentang alat pembatas dan pengaman jalan dan kitab-kitab fiqih sebagai bahan analisis. Hasil penelitian ini adalah alat pembatas kecepatan secara hukum positif sah dengan peraturan yang komplek dan rinci. Permenhub No 43 tahun 2023 yang terbaru menyebutkan bahwa alat pembatas keceptan terbagi menjad 3 macam, Speed Bump, Speed Hump dan Speed Table, serta dengan kategori jalan dan bentukv yang sudah di atur. Alat pembatas kecepatan menurut hukum islam tidak di bahas secara rinci dan tertulis, hukum Islam hanya menyebutkan bahwa hak-hak jalan harus dipenuhi, salah satunya jalan tidak boleh di beri gangguan, maka secara umum alat pembatas kecepatan dilarang. Ulama menyebutkan hal serupa dalam bentuk dakkah, ada perbedaan pendapat mengenai penggunaan dakkah, Imam Nawawi dan Imam Rafi’I mengharamkannya, sedangkan Ibnu Hajar Al-Haitami dan Ibnu Rafi’ah mebolehkannya selama tidak menimbulkan potensi gangguan.
