Abstract

ABSTRAC This study aims to determine and analyze the role of the Camat in the Implementation of Government and Regional Development Based on Law No.23 of 2014 (Case Study in Mariso District. This empirical legal research method is basically a combination of normative legal approaches with the addition of various elements. Based on the results of this study, it can be concluded that the role of the Camat in Mariso District has been carried out in accordance with Law Number 23 of 2014 Article 225, which in the contents of Article 225 is carried out, namely coordinating community empowerment activities by involving all existing elements. in Mariso Subdistrict, coordinate efforts to maintain peace and public order by actively coordinating with the Polsek and Danramil, coordinating the implementation and enforcement of Regional Regulations and Regional Regulations where the active socialization of regional regulations and local regulations in the community cooperates with the Makassar City DPRD and implementing its implementation, coordinating the maintenance of public service infrastructure and facilities with the active work programs of the Mariso District such as garden maintenance, Clean Canal Program (PROKASIH), Clean-Up Mosques (BBM), Normalization of Drainage, coordinating the implementation of government activities carried out by Regional Apparatus in The sub-district, in coordination with the relevant offices, fosters and supervises the implementation of village and/or kelurahan activities, actively evaluating the performance of each kelurahan. One of the factors that support the running of the government system is Mariso Subdistrict, which always has regular evaluations and coaching so that the apparatus knows the tasks that must be done to increase the awareness of the apparatus, while the regulatory factors are set out in standard operating procedures (SOPs) and service standards as instructions for the service process. to society. Meanwhile, the obstacle faced in the last few years is the reduction in human resources available every day in the office with the division of the workday schedule to enter the office and the rest working from home (WFH) during the pandemic. ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis Peran Camat Dalam Penyelenggaraan Pemerintahan Dan Pembangunan Daerah Berdasarkan Undang-Undang No.23 Tahun 2014 (Studi Kasus di Kecamatan Mariso. Metode penelitian hukum empiris ini pada dasarnya ialah penggabungan antara pendekatan hukum normatif dengan adanya penambahan dari berbagai unsur-unsur empiris. Berdasarkan hasil penelitian ini adalah maka dapat ditarik kesimpulan Peran Camat di Kecamatan Mariso telah terlaksana sesuai dengan Undang - Undang Nomor 23 Tahun 2014 Pasal 225, yang dimana dalam isi pasal 225 dijalankan yaitu mengoordinasikan kegiatan pemberdayaan masyarakat dengan melibatkan seluruh elemen yang ada di Kecamatan Mariso, mengoordinasikan upaya penyelenggaraan ketenteraman dan ketertiban umum dengan aktif berkordinasi bersalam Polsek dan Danramil, mengoordinasikan penerapan dan penegakan Perda dan Perkada yang dimana aktifnya sosialisasi perda dan perkada di masyarakat bekerja sama dengan DPRD Kota Makassar dan menjalankan penerapannya, mengoordinasikan pemeliharaan prasarana dan sarana pelayanan umum dengan aktifnya program kerja Kecamatan Mariso seperti pemeliharaan taman, Program Kanal Bersih (PROKASIH), Bersih-Bersih Masjid (BBM), Normalisasi Drainase, mengoordinasikan penyelenggaraan kegiatan pemerintahan yang dilakukan oleh Perangkat Daerah di Kecamatan dengan berkordinasi bersama Dinas terkait, membina dan mengawasi penyelenggaraan kegiatan Desa dan/atau kelurahan aktifnya mengevaluasi kinerja disetiap kelurahan. Faktor yang mendukung jalannya sistem pemerintahan dengan baik salah satunya adalah Kecamatan Mariso selau adanya evaluasi dan pembinaan secara rutin sehingga aparatur mengetahui tugas yang harus dikerjakan untuk meningkatkan kesadaran aparatur, adapun faktor aturan ditetapkan dalam standar operasional prosedur (SOP) dan standar pelayanan sebagai petunjuk proses pelayanan ke masyarakat. Sedangkan hambatan yang di hadapi bebrapa tahun terakhir adalah berkurangnya SDM yang ada disetiap hari kantor dengan adanya pembagian jadwal hari kerja untuk masuk kantor dan sisanya kerja dengan work from home (WFH) selama masa pandemi.

Abstract

ABSTRAC This study aims to find out how PD parking manages parking in Makassar City and to find out how to overcome illegal parking in Makassar City. This research is empirical research, namely research using field data as the main data source, such as the results of interviews and observations. The result of this research is parking management by PD. Makassar Raya parking is still not effective enough because there are many obstacles in carrying out the process, such as the lack of supervision by the PD. Parking in overcoming illegal parking in Makassar City, and also many people who violate such as parking carelessly on the side of the road so that it disrupts traffic flow. Recommendations from this study are for the case of PD illegal parking attendants. Makassar Raya Parking must be more intensive to carry out supervision so as not to increase the number of illegal parking attendants carrying out illegal parking fees or extortion in Makassar City. ABSTRAK Penelitian ini bertujuan untuk mengetahui bagaimana cara PD parkir mengelola perparkiran di Kota Makassar dan untuk mengetahui bagaimana cara mengatasi parkir liar di Kota Makassar. Metode penelitian ini bersifat penelitian hukum empiris, yaitu penelitian dengan menggunakan data-data lapangan sebagai sumber data utama, seperti hasil wawancara dan observasi. Hasil dari penelitian ini adalah pengelolaan parkir yang dilakukan PD. Parkir Makassar Raya masih belum cukup efektif di karena kan banyaknya kendala dalam menjalankan prosesnya seperti kurangnya pengawasan yang dilakukan PD. Parkir dalam mengatasi parkir liar di Kota Makassar, dan juga banyak masyarakat yang melanggar seperti parkir sembarangan di pinggir jalan sehingga mengganggu arus lalu lintas. Rekomendasi dari penelitian ini adalah untuk pada kasus juru parkir liar PD. Parkir Makassar Raya harus lebih intensif untuk melakukan pengawasan agar tidak semakin maraknya oknum juru parkir liar melakukan tindakan retribusi biaya parkir illegal atau pungli di Kota Makassar.

Abstract

ABSTRAC This study aims to find out and analyze the legal rules regarding the Minimum Limit of 30% Quota of Female Legislative Candidates proposed by Political Parties and to know and analyze the implications of the application of the minimum 30% quota for female legislative candidates proposed by Political Parties in the Legislative Election. This study uses the Legal Research method with the type of normative legal research, which is a study that examines the law based on statutory regulations. The results of this study show that the opportunity for women's involvement in politics has been wide open when the affirmative action policy was introduced. This policy requires that the quota that must be fulfilled by political parties in compiling the list of candidates for legislative members is 30%. These formal regulations are strengthened by various regulations such as the Election Law No.10/2008, Election Law No.8/2012, PKPU No.7/2013 and Election Law No.7/2017.UU.No.22 of 2007 There are formal legal guarantees for women to be involved in politics is already open, but there are still obstacles faced by women to enter the political sphere, especially as members of the legislature. Affirmative action against women in politics began with the passing of Law Number 12 of 2003 concerning the Election of DPR, DPD, and DPRD. Article 65 paragraph (1) of Law Number 12 of 2003 concerning the Election of DPR, DPD, and DPRD states that: Every Election Contesting Political Party may nominate candidates for Members of DPR, Provincial DPRD, and Regency/Municipal DPRD for each Electoral District with due observance of representation. women at least 30%." The result does appear to be progress, explicitly requiring political parties to place at least 30 percent of women in the management of political parties, while Article 55 paragraph 2 of Law Number 10 of 2008 adopts a modified zigzag or zipper model list of candidates and the presence of provisions for fulfilling a 30% quota in every election. has implications for increasing women's representation in parliament. Suggestions from this research Affirmative Policy should be accompanied by more intensive fulfillment of political education for women, given that there is no significant effect on women's issues, it is better that the quality of human resources needs to be improved. The government needs to carry out comprehensive socialization to the community regarding sustainable women's empowerment in order to strengthen claims in obtaining positions in political and bureaucratic institutions. ABSTRAK Penelitian ini bertujuan untuk untuk mengetahui dan menganalis aturan Hukum mengenai Batas Minimal 30% Kuota Calon Legislatif Perempuan yang diajukan oleh Partai Politik serta mengetahui dan menganalis implikasi terhadap pemberlakuan batas minimal 30% kuota calon anggota legislatif perempuan yang diajukan oleh Partai Politik pada Pemilu Legislatif. Penelitian ini menggunakan metode Penelitian Hukum (Legal Research) dengan tipe penelitian hukum normatif, yaitu suatu penelitian yang mengkaji hukum berdasarkan peraturan perundag-undangan. Hasil penelitian ini menunjukan Peluang keterlibatan perempuan dalam ranah politik sudah terbuka lebar saat hadirnya kebijakan affirmative action. Kebijakan ini mensyaratkan kuota yang harus dipenuhi oleh partai politik dalam menyusun daftar calon anggota legislatif banyak 30 %. Peraturan formal tersebut dikuatkan dengan berbagai peraturan sepertu UU pemilu No.10/2008, UU Pemilu No.8/2012, PKPU No.7/2013 dan UU Pemilu No.7/2017.UU.No.22 Tahun 2007 Terdapat jaminan legal formal bagi perempuan untuk terlibat dalam bidang politik sudah terbuka, namun masih ada kendala yang dihadapi perempuan untuk memasuki ranah politik khususnya sebagai anggota legislatif. Kebijakan afirmatif (affirmative action) terhadap perempuan dalam bidang politik dimulai dengan disahkannya UU Nomor 12 Tahun 2003 tentang Pemilu DPR, DPD, dan DPRD. Dalam pasal 65 ayat (1) UU Nomor 12 Tahun 2003 tentang Pemilu DPR, DPD, dan DPRD menyatakan bahwa: ‟Setiap Partai Politik Peserta Pemilu dapat mengajukan calon Anggota DPR, DPRD Provinsi, dan DPRD Kabupaten/Kota untuk setiap Daerah Pemilihan dengan memperhatikan keterwakilan perempuan sekurang-kurangnya 30%.” Hasilnya memang tampak ada kemajuan, secara eksplisit mengharuskan parpol menempatkan sedikitnya 30 persen perempuan dalam kepengurusan parpol sedang Pasal 55 ayat 2 Undang-undang Nomor 10 Tahun 2008 mengadopsi susunan daftar calon model zigzag atau zipper yang dimodifikasi serta Hadirnya ketentuan pemenuhan kuota 30% pada setiap pemilu berimplikasi pada meningkatnya keterwakilan perempuan di parlemen. Saran dari penelitian ni Kebijakan Afirmatif sebaiknya dibarengi dengan semakin gencarnya pemenuhan Pendidikan politik bagi perempuan, mengingat bahwa belum hadirnya efek yang begitu siginifikan terhadap isu-isu perempuan, maka sebaiknya kualitas sumber daya manusia perlu untuk ditingkatkan. Pemerintah perlu melakukan sosialisi secara menyuluruh kepada masyarakat terkait pemberdayaan perempuan yang berkelanjutan dalam rangka penguatan klaim dalam memperoleh posisi di institusi politik maupun birokrasi.

Abstract

ABSTRAC This study examines the application of the law to the regulation regarding the procedures for the delivery of public facilities and social facilities in settlements inMakassar City and the status of certificates of ownership of land for public facilitiesabove settlements. This research is a normative-empirical legal research obtainedfrom field studies and literature related to the problem. The type of data used is Primary, which is obtained from field studies, by analyzing a legal problem through facts and questionnaires and secondary, namely legal data that is closely related to primary legal materials that can help analyze and understand primary legal data. The government has regulated the basics and provisions for the control, ownership, use and utilization of agrarian resources contained in Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles. The law also includes basic principles and provisions, rights to land, water and space as well as land registration, criminal and transitional regulations. The results show that the regulation regarding the procedure for the delivery of public facilities and social facilities in settlements in Makassar City isin the Makassar City Regional Regulation Number 9 of 2011 concerning Provision andDelivery of Infrastructure, Facilities, Utilities in Industrial, Trade, Housing and Settlement Areas specifically funds in general. regulated in the Minister of Home Affairs Regulation Number 9 of 2009 concerning Guidelines for the Delivery of Housing and Settlement Infrastructure, Facilities, and Utilities in the Regions. Regarding the issue of the status of the certificate of property rights above public and social facilities, it must be resolved fairly according to the legislation. ABSTRAK Kajian ini mengkaji penerapan undang-undang terhadap pengaturan mengenai tata cara penyerahan fasilitas umum dan fasilitas sosial pada permukiman di Kota Makassar dan status sertifikat hak milik atas tanah fasilitas umum di atas permukiman. Penelitian ini merupakan penelitian hukum normatif-empiris yang di peroleh dari studi lapangan dan literatur yang berkaitan dengan masalah. Jenis data yang di gunakan adalah primer, yang di peroleh dari lapangan dengan menganalisis suatu masalah hukum melalui fakta fakta dan kuesioner dan sekunder ,yaitu data hukum yang erat kaitannya dengan bahan hukumprimer yang dapat membantu menganalisis dan memahami data hukum primer. pemerintah telah mengatur tentang dasar dan ketentuan mengenail penguasaan, pemilikan penggunaan dan pemanfaatan sumber daya agrariya yang tertuangdalam Undang-Undang Nomor 5 Tahun 1960 tentang peraturan Dasar Pokok-PokokAgraria. Undang-Undang tersebut juga mencakup prinsip dan ketentuan dasar ,hak atas tanah, air dan ruang angkasa serta pendaftaran tanah,peraturan pidana dan transisi. Hasil penelitian menunjukan bahwa pengaturan mengenai tata cara pemberian fasilitas umum dan fasilitas sosial pada permukiman di Kota Makassar terdapat dalam peraturan Daerah Kota Makassar Nomor 9 Tahun 2011 tentang penyediaan dan penyediaan prasaran, saranautulitas perumahan dan permukiman di Daerah. Soal Status Sertifikat hak milik di atas fasilitas umum dan sosial ,harus di selesaikan secara adil sesuai peraturan perundang-undangan.

Abstract

This study aims to find out and explain the process of investigating illegal cosmetics distribution crimes in Makassar and to find out and explain the factors that influence the investigation of illegal cosmetics distribution crimes in Makassar. This study uses an empirical legal method with a qualitative descriptive approach. Data were obtained through interviews and data collection with law enforcement officers. The results of this study indicate that the process of investigating illegal cosmetics distribution crimes in Makassar by the South Sulawesi Regional Police is basically carried out in accordance with the provisions of the applicable Criminal Procedure Code (KUHAP). The factors that hinder the process of investigating illegal cosmetics distribution crimes in Makassar. This research recommendation requires and is important to have a more efficient coordination system between police investigators and BPOM officers to facilitate the investigation process until the determination of suspects

Abstract

This study uses empirical legal research methods, empirical legal research is basically a combination of normative legal approaches with the addition of various empirical elements. In this empirical research method, it is also about the implementation of the legal provisions of the law in action in every particular legal research that occurs in society. The results of this study indicate that the procedure for granting Working Capital Credit (KMK) at PT. Bank Sulselbar Mamuju Branch is guided by the procedures and principles of providing sound credit and in accordance with applicable regulations. And the efforts made by Bank Sulselbar Mamuju in terms of overcoming debtors who default are by making efforts to save credit, this is considered very important for banks to avoid the occurrence of bad loans that can affect the soundness of the bank . The recommendation of this research is for creditors and debtors to further enhance their cooperation and compromise with each other so as to establish a more sustainable and effective agreement. In order for the implementation of working capital under the auspices of Bank Sulselbar Mamuju to run smoothly and each party does not suffer losses, the parties fulfill their respective rights and obligations where the debtor must be aware of his obligations.
