Abstract

Abstrak Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana peran pemerintah desa dalam pelayanan umum, pembangunan pemberdayaan, dan perlindungan di desa kuta pinang dalam mewujudkan desa yang mandiri dan berkeadilan serta faktor-faktor yang mempengaruhinya. Jenis penelitian ini merupakan penelitian deskriptif dengan pendekatan kualitatif. Kemudian dalam pengumpulan data dilakukan dengan menggunakan metode observasi lapangan, wawancara, dan dokumentasi baik data primer dan juga sekunder. Hasil penelitian ini menunjukkan bahwa didalam peran pemerintah desa dalam mewujudkan desa yang mandiri dan berkeadilan di desa kuta pinang yang masih belum optimal, yang dimana dari pihak pemerintah desa masih belum mampu untuk memanfaatkan sumber daya alam dan sumber daya lingkungan yang ada dan adanya keterbatasan dana serta masih banyak masyarakat yang pasif dalam hal berpartisipasi. Kata Kunci: Pemerintah Desa, Desa Mandiri Dan Berkeadilan,Pembangunan Pemberdayaan, Perlindungan Desa Abstract This research was conducted with the aim of finding out the role of the village government in public services, development, empowerment and protection in Kuta Pinang village in realizing an independent and just village and the factors that influence it. This type of research is descriptive research with a qualitative approach. Then data collection was carried out using field observation methods, interviews and documentation of both primary and secondary data. The results of this research indicate that the role of the village government in realizing an independent and just village in Kuta Pinang village is still not optimal, where the village government is still unable to utilize existing natural and environmental resources and there are limited funds and There are still many people who are passive in terms of participation. Abstract

This research discusses the influence of Islamic law on the development of the civil law and common law systems in Indonesia, a country founded on the rule of law with diverse ethnicities, cultures, and religions. With a majority Muslim population, Islamic law plays a significant role in complementing the legal certainty of the civil law system through substantive justice values, such as in the regulation of waqf and zakat. In the common law system, Islamic law is accommodated formally or informally depending on the societal context. The research employs a normative juridical method, which refers to analyzing legal norms and concepts relevant to the issues being studied. Data sources are obtained through literature studies, including journal articles, books, and previous research. The findings indicate that Islamic law holds an essential role in both civil law and common law systems. In the civil law system, Islamic law complements legal certainty with values of substantive justice, as seen in the regulations of waqf and zakat. Meanwhile, in the common law system, Islamic law is formally or informally accommodated, depending on the majority or minority Muslim context of a given society.
